&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;POR EL PRESENTE HAGO CONSTAR: Que en los autos de JUICIO DE FALTAS 0000995 /2013 ha recaído Sentencia, del tenor literal: &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;S E N T E N C I A&amp;nbsp;&amp;nbsp;&amp;nbsp; 76 &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En la Ciudad de Palma de Mallorca a 31 de marzo de dos mil catorce. Vistos en Juicio Oral y público por mí D. ANTONI ROTGER CIFRE MAGISTRADO-JUEZ del Juzgado de Instrucción número Ocho de los de esta Ciudad, los presentes autos de Juicio de Faltas nº 995/2013, sobre falta de ESTAFA, incoados en virtud de denuncia suscrita por D. ENRIQUE AVECILLA ÁLVAREZ contra D. DECKER BENEDICT, y en calidad de perjudicado el establecimiento HOTEL PALMA BAY, habiendo sido igualmente&amp;nbsp; parte por disposición legal el Ministerio Fiscal representado por D. Nicolás Pérez Serrano ejercitando la acción pública, y&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;ANTECEDENTES DE HECHO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt; Las presentes actuaciones se iniciaron en virtud de la meritada denuncia.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; Practicadas las diligencias preliminares que se estimaron pertinentes, se convocó a juicio a los presuntos culpables y demás personas que previene la Ley, celebrándose en el día señalado con las asistencias, en la forma y con el resultado sucintamente expresado en el acta correspondiente.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt; En el acto del Juicio Oral y en trámite de informe las partes formularon los oportunos informes de calificación de los hechos objeto del presente procedimiento, conforme resta documentado en la grabación audiovisual de dicho acto.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;HECHOS PROBADOS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;ÚNICO.-&lt;/strong&gt; A finales de octubre de 2013 el denunciado Decker Benedict hizo uso sin tener derecho de una pulsera de “todo incluído” en el hotel Palma Bay, consumiendo productos por un valor estimado de 135 euros.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;FUNDAMENTOS DE DERECHO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt;&amp;nbsp; Los hechos se declaran probados valorando la detallada y coherente declaración del empleado Sr. Avecilla que personalmente percibió los hechos constitutivos del ilícito, sin que el denunciado haya hecho alegación alguna.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; Los hechos que se declaran probados son legalmente constitutivos de una falta del artículo 623-4º del Código Penal.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt; Toda persona responsable de delito o falta lo es también civilmente (artículos 116 y siguientes del Código Penal), y viene obligada por ministerio de la Ley al pago de las costas procesales causadas según dispone el artículo 123 del Código Penal.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Vistos los artículos citados y demás de general y pertinente aplicación&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;F A L L O&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;Que debo CONDENAR Y CONDENO A DECKER BENEDICT como autor responsable de la falta precedentemente definida a la pena DE DOS MESES DE MULTA A RAZÓN DE DIEZ EUROS DIARIOS, Y QUE INDEMNICE AL ESTABLECIMIENTO HOTEL PALMA BAY EN LA CANTIDAD DE 135 EUROS, y AL PAGO DE LAS COSTAS PROCESALES CAUSADAS.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En caso de&amp;nbsp; impago de la multa impuesta, el mismo queda sujeto a una responsabilidad personal subsidiaria de un día de privación de libertad por cada dos cuotas diarias no satisfechas.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;La presente resolución no es firme y contra la misma cabe interponer recurso de apelación en este Juzgado para ante la Iltma. Audiencia Provincial de ILLES BALEARS en el plazo de &lt;strong&gt;CINCO DIAS&lt;/strong&gt; desde su notificación.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Así por ésta mi sentencia, lo pronuncio, mando y firmo.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Concuerda bien y fielmente con su original al que me remito y para que así conste, Y SIRVA DE NOTIFICACION EN LEGAL FORMA A DECKER BENEDICT actualmente en ignorado paradero, extiendo y firmo el presente testimonio en PALMA DE MALLORCA, a diez de Abril de dos mil catorce.&lt;/span&gt;&lt;/p&gt;
