&lt;p&gt; &lt;span style="color: black"&gt;La Junta de Gobierno Local en sesión ordinaria celebrada el día 13 de marzo de 2014, aprobó la convocatoria, por el sistema de concurso oposición, de una bolsa de trabajo de arquitectos i las Bases que regirán dicha convocatoria i que a continuación se transcriben cono Anexo I, II y II: &lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="color: black"&gt;“ &lt;strong&gt;ANEXO I&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="color: black"&gt;BASES ESPECÍFICAS DE LA CONVOCATORIA PARA LA CREACIÓN DE UNA BOLSA DE TRABAJO DE ARQUITECTOS, MEDIANTE CONCURSO OPOSICIÓN, PARA EL AYUNTAMIENTO DE SANT ANTONI DE PORTMANY.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;1ª.- OBJETO DE LA CONVOCATORIA&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Es objeto de la presente convocatoria la creación, por el procedimiento de concurso oposición, de una bolsa de trabajo de arquitectos para cubrir las necesidades del servicio que puedan subvenir, como necesidades urgentes derivadas del aumento de la demanda, bajas laborales o vacaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Las funciones del puesto de trabajo serán, entre otras:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Elaborar la planificación urbanística del municipio.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Realizar el seguimiento y elaborar los informes relacionados con los instrumentos de planeamiento, gestión urbanística, licencias de obras y disciplina urbanística.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Asesorar e informar a los órganos de gobierno en materia urbanística.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Elaborar, redactar, dirigir y supervisar los proyectos de obras municipales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Atender al público en materia relativa a su ámbito de trabajo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Esta selección se regirá por las prescripciones contenidas en las bases reguladoras de la convocatoria específica y, en lo que no se prevea en éstas, en la normativa general aplicable.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;El anuncio de la presente convocatoria se publicará en el Boletín Oficial de las Illes Balears y en el tablón de anuncios y en la página web del Ayuntamiento (www.santantoni.net). El texto íntegro de las bases que han de regir la convocatoria y los sucesivos anuncios del proceso selectivo se publicarán en el tablón de anuncios y en la página web municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;2ª.- REQUISITOS DE LOS ASPIRANTES&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Para tomar parte en las pruebas selectivas será necesario reunir, a la fecha de finalización del plazo de presentación de solicitudes, los requisitos siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;a) Poseer la nacionalidad española, sin perjuicio de lo que dispone el artículo 57 de la Ley 7/2007, de 12 de abril, del Estatuto básico del empleado público.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;b) Tener 16 años cumplidos y no haber alcanzado la edad de jubilación forzosa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;c) Estar en posesión del título de licenciado en arquitectura o equivalente, o en condiciones de obtenerlo en la fecha que finalice el plazo de presentación de solicitudes.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;d) No padecer enfermedad y poseer las capacidades físicas y psíquicas que sean necesarias para el ejercicio de las funciones del cuerpo al que corresponde la bolsa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;e) No haber sido separado mediante expediente disciplinario del servicio de ninguna Administración Pública, ni hallarse inhabilitado para el empleo o el ejercicio de la función pública.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;f) Poseer el carné de conducir B.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;3ª.- PRESENTACIÓN DE SOLICITUDES Y DOCUMENTACIÓN.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;1. Las personas interesadas en participar en el concurso oposición deberán presentar una solicitud de acuerdo con el modelo del Anexo II de las presentes bases.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;2.- Las solicitudes se presentarán en el Registro General del Ayuntamiento de Sant Antoni de Portmany, o bien en la forma establecida en el artículo 38.4 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común. En este último supuesto, necesariamente se deberá enviar, mediante fax o correo electrónico al Ayuntamiento de Sant Antoni de Portmany, copia de la solicitud registrada para tener conocimiento de la presentación (Fax. 971344175, correo electrónico: &lt;/span&gt;&lt;a href="mailto:oac@santantoni.net"&gt;&lt;span style="color: rgb(0, 0, 128)"&gt;oac@santantoni.net&lt;/span&gt;&lt;/a&gt;&lt;span style="color: black"&gt;).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;3.- El plazo de presentación de solicitudes será de 15 días hábiles, contados desde el día siguiente al de la publicación del anuncio de la convocatoria en el Boletín Oficial de las Illes Balears (BOIB). Se publicará también en el tablón municipal de anuncios y en la página web municipal (&lt;/span&gt;&lt;a href="http://www.santantoni.net/"&gt;&lt;span style="color: rgb(128, 0, 128)"&gt;www.santantoni.net&lt;/span&gt;&lt;/a&gt;&lt;span style="color: black"&gt;).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;4.- Junto con la solicitud, se deberá adjuntar la siguiente documentación:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; 1) Fotocopia del DNI o, en el caso de no ser español, del documento oficial acreditativo de la personalidad.&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;2) Original o fotocopia compulsada de los requisitos exigidos en la base 2ª.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;3) Relación de los méritos que se aleguen para la fase de concurso. Esta relación deberá presentarse en forma de listado donde constarán detallados los méritos que se alegan ordenados de acuerdo con los distintos bloques que conforman el baremo de valoración del concurso (apartado B) de la base 6ª.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;Este listado de méritos debe acompañarse, necesariamente, con los documentos acreditativos de cada mérito, originales o fotocopia cotejada. Los méritos alegados que no se justifiquen documentalmente dentro del plazo de presentación de instancias no se tendrán en consideración, tampoco se valorarán otros méritos que no formen parte de los bloques que conforman el baremo de valoración del concurso.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;4) Las personas aspirantes con discapacidad igual o superior al 33%, deberán presentar dentro del plazo de presentación de solicitudes, un certificado de los equipos multiprofesional de la Dirección General de Familia, Bienestar Social y Atención a Personas en Situación Especial o del organismo público equivalente sobre las condiciones personales de aptitud para ejercer las funciones correspondientes a la categoría profesional de la bolsa a la que la persona candidata aspira y que debe expresar que se encuentra en condiciones de cumplir las tareas fundamentales del cuerpo mediante, si corresponden a juicio de la administración, las adaptaciones necesarias del puesto de trabajo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;4ª.- ADMISIÓN DE LOS ASPIRANTES&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;1. Finalizado el plazo para la presentación de solicitudes, se dictará resolución y se publicará en el tablón de anuncios y en la página web del Ayuntamiento la lista provisional de personas admitidas y excluidas, con indicación de las causas de exclusión, concediendo un plazo de 3 días hábiles a efectos de posibles reclamaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;2. Si no se presentan reclamaciones dentro de este plazo, la lista provisional se entenderá elevada a definitiva sin necesidad de nueva resolución y publicación.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;En esta resolución igualmente se fijará el lugar, día y hora para la realización de la fase de oposición. Igualmente en la misma resolución se incluirá el nombramiento de los miembros del Tribunal Calificador.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;5ª.- ÓRGANO DE SELECCIÓN&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;1. El Tribunal Calificador estará integrado por tres miembros y por el mismo número de suplentes de la siguiente forma: Presidente y dos vocales, entre los cuales, el tribunal escogerá uno para actuar como secretario. Los miembros del Tribunal de selección deben ser funcionarios de carrera con titulación académica igual o superior a la exigida para el acceso a la bolsa convocada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;2. El Tribunal queda facultado para resolver las dudas que se presenten y tomar los acuerdos necesarios para el buen orden del procedimiento en lo no previsto en estas bases. Igualmente, puede incorporar, en los trabajos que lleve a cabo, asesores especialistas, que actuarán con voz pero sin voto.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;3. La abstención y la recusación de los miembros del tribunal se ajustará a lo previsto en los artículos 28 y 29 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;6ª.- PROCESO SELECTIVO&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;El procedimiento de selección es el de concurso oposición, dado que se considera necesario que el órgano de selección, de acuerdo con las características de la plaza, pueda valorar los conocimientos así como la experiencia y la formación de los aspirantes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;La puntuación mínima para poder acceder a la bolsa es de 20 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;&lt;strong&gt;A) Fase de oposición: &lt;/strong&gt;puntuación máxima 40 puntos&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Prueba teórico-práctica: de carácter obligatorio y eliminatoria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Consistirá en resolver un ejercicio de carácter teórico-práctico propuesto por el tribunal y en contestar preguntas breves directamente relacionadas con las funciones asignadas a la plaza y sobre el contenido del temario que figura como Anexo III. Durante la realización de este ejercicio, los aspirantes podrán hacer uso de los textos legales no comentados con los cuales vendrán proveídos en soporte de papel.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Se valorará fundamentalmente la capacidad de razonamiento, la correcta interpretación de la normativa aplicable, la adecuada formulación de conclusiones y los conocimientos expuestos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Este ejercicio se puntuará de 0 a 40 puntos, siendo eliminados los aspirantes que obtengan una puntuación inferior a 20 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;&lt;strong&gt;B) Fase de concurso: &lt;/strong&gt;puntuación máxima 30 puntos&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;No tendrá carácter eliminatorio. La puntuación obtenida en esta fase en ningún caso se podrá aplicar para superar los ejercicios de la fase de oposición. Se valorarán los méritos alegados y acreditados documentalmente con la solicitud de participación en el proceso selectivo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Únicamente serán valorados los méritos siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;1.- Experiencia profesional: puntuación máxima 12 puntos&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;a) Servicios prestados con relación laboral o funcionarial en la Administración Pública, ejerciendo funciones de naturaleza o contenido técnico análogos a las del cuerpo, escala y especialidad de la bolsa: 0,25 puntos por mes completo trabajado. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;A tal efecto se deberá presentar certificado del organismo correspondiente en el que se haga constar: tiempo trabajado, jornada, categoría, grupo o subgrupo y vinculación con la Administración.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;b) Servicios prestados con relación laboral empresa pública societaria o privada ejerciendo funciones de naturaleza o contenido técnico análogos a las del cuerpo, escala y especialidad de la bolsa: 0,20 puntos por mes completo trabajado.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;A tal efecto se deberá presentar copia de los contratos de trabajo acompañados obligatoriamente del certificado de vida laboral emitido por la Seguridad Social. Debe constar el tiempo de trabajo, la categoría laboral y el grupo de clasificación profesional. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Para acreditar el trabajo de autónomos se exigirá el documento de alta de actividad económica junto con la vida laboral. Si la actividad profesional no queda reflejada en la vida laboral, se adjuntará el certificado del colegio profesional que acredita el ejercicio de la actividad en los períodos que corresponda&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Se otorgará la puntuación que proporcionalmente corresponda, a criterio del órgano de selección cuando la jornada sea inferior a la ordinaria. En ningún caso, ocupar un puesto de trabajo reservado a personal eventual constituirá mérito para acceder a la función pública o a la promoción interna. Si el aspirante ha desarrollado simultáneamente dos o más modalidades profesionales anteriores, sólo se ha de computar una a efectos de valoración, que debe ser la que otorga una puntuación más alta.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;2.- Cursos, jornadas o seminarios: máximo 9 puntos&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;A) Título de postgrado especialista universitario en Derecho Urbanístico y Ordenación del Territorio: 3 puntos&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;B) Otros cursos en materia de urbanismo y ordenación del territorio: 0,03 puntos/hora y se pueden obtener un máximo de 3 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;C) Otros cursos en materia de arquitectura: 0,01 puntos/hora y se pueden obtener un máximo de 3 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Estos méritos se valorarán mediante originales o copias compulsadas de los diplomas, títulos oficiales o certificados expedidos por centros o por organismos de carácter oficial. Además, se adjuntará el programa y/o los contenidos del curso, para que el órgano de selección pueda valorar, en caso de duda, su relación con las funciones de la plaza convocada. Los documentos que no acrediten el número de horas se puntúan como de dos horas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;3.- Trabajos realizados para la Administración Pública relacionados con las funciones a desarrollar: con un máximo de 5 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;En este bloque sólo se puntuarán:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;a) Trabajos relacionados con la redacción de instrumentos de planeamiento: 1,5 puntos por trabajo.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;b) Proyectos o direcciones de obras para la administración: 1 punto por trabajo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Estos méritos se valorarán mediante la presentación de un certificado emitido por la Administración para la que se han realizado los trabajos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;4.- Conocimientos de lengua catalana. La puntuación máxima de este apartado será de 4 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Se valorarán los certificados expedidos por la EBAP o por el órgano competente en materia de política lingüística. En caso de que un mismo aspirante disponga de distintos niveles, sólo se valorará el que tenga una puntuación superior, a excepción del nivel LA, la puntuación se sumará a otro nivel de catalán más alto acreditado.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Nivel B2 o equivalente (B): 1 punto.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Nivel C1 o equivalente &lt;/span&gt;(C1):&lt;span style="color: black"&gt; 2 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Nivel C2 o equivalente (D): 3 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;- Nivel LA o equivalente (E): 1 punto.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="color: black"&gt;C) Entrevista personal: máximo 5 puntos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;No tendrá carácter eliminatorio. El tribunal realizará una entrevista personal a los aspirantes que hayan superado las fases anteriores para valorar las aptitudes relacionadas con las características de la plaza. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;8a.- RESOLUCIÓN DE LA CONVOCATORIA Y FUNCIONAMIENTO DE LA BOLSA&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;1. La calificación final del proceso selectivo vendrá determinada por la suma de las puntuaciones obtenidas en las distintas fases. La puntuación mínima para poder acceder a la bolsa es de 20 puntos. En caso de empate, éste se resolverá aplicando la siguiente graduación: 1) mejor puntuación en la fase de oposición, 2) mejor puntuación en la fase de concurso, 3) de persistir el empate finalmente se procederá al sorteo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Se publicará en el tablón de anuncios y en la web municipal la lista de la relación de aspirantes que por orden de puntuación integrarán la bolsa de trabajo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Los candidatos dispondrán de un plazo de 3 días hábiles, contados a partir del día siguiente al de la publicación de la lista para alegar las rectificaciones pertinentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;2. El Ayuntamiento de Sant Antoni de Portmany, según sus necesidades y por orden riguroso de puntuación, realizará los ofrecimientos para la ocupación de los puestos de trabajo que tengan que cubrir interinamente o temporalmente. En todo lo no previsto en estas bases, se estará a lo previsto en la normativa general aplicable.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; 11a.- IMPUGNACIÓN&lt;/p&gt; 
&lt;p&gt; &lt;span style="color: black"&gt;Estas bases, la convocatoria y cuantos actos administrativos se deriven de ella podrán ser impugnados en los casos y en la forma establecida en la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
