&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;Notificación por medio del BOIB&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dado que no ha sido posible notificar el acuerdo sancionador por incumplimiento de lo establecido en el artículo 47, apartado B9, de la Ordenanza Municipal de Uso y Aprovechamiento de Playas, procedemos a su notificación, conforme con lo que determina el artículo 59.5 de la Ley 30/1992 de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, a las personas que se detallan en el anexo adjunto, haciendo constar lo siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&amp;quot;Primero. Sancionar al señor M.B.G, con DNIY2274209Y, con una multa de 751 euros, como presunto responsable de una falta de carácter grave por incumplimiento de lo establecido en el artículo 47.&lt;i&gt;b&lt;/i&gt;9 de la Ordenanza Municipal de Uso y Aprovechamiento de Playas, publicada en el BOIB número 179 de fecha 18 de diciembre de 2004, que establece que se considera infracción la venta ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Segundo. Notificar esta Resolución al interesado.&amp;quot;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se le notifica que una vez transcurrido el plazo de pago en periodo voluntario sin haberse efectuado el pago se incurrirá en el recargo ejecutivo del 5 % y se iniciará el procedimiento de apremio con los recargos, intereses de demora y costas que correspondan (art. 28, 163 y siguientes de la Ley 58/2003 General Tributaria).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la presente Resolución se puede interponer recurso de reposición ante la Alcaldía en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 14 del Texto refundido de la Ley Reguladora de las Haciendas Locales (Real Decreto Legislativo 2/2004, de 5 de marzo).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Todo ello, de conformidad con lo establecido en los artículos 42.4 y 42.5 en relación con el artículo 44.2 de la Ley 30/1992, de 26 de noviembre, según redacción dada por la Ley 4/1999, de 13 de enero, de modificación de la anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El expediente puede consultarse en el Departamento de Secretaría del Ayuntamiento de Alaior (calle Major, núm. 11 de Alaior, teléfono 971 37 10 02, ext. 120).&lt;/span&gt;&lt;/p&gt;
