    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Con fecha 6 de julio de 2012 se resolvió por el Presidente de la Autoridad Portuaria de Baleares (en adelante APB) autorizar la explotación de un edificio situado en el Espigón exterior del Puerto de Palma de Mallorca a GLOBAL YACHT FINISHING S&lt;/span&gt;&lt;span style="color: rgb(1, 1, 1)"&gt;.&lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;L. &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;otorgar la concesión de ocupación de dominio público&lt;/span&gt;&lt;span style="color: rgb(72, 79, 77)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Sobre la base de la cláusula 12.3 del Pliego de Cláusulas, GLOBAL YACHT FINISHING S.L. ha presentado escrito (Rto. de entrada 2013/010219 de 20-12-2013) donde insta que sean revisadas las mencionadas tarifas de acuerdo a la variación del Índice de Precios al Consumo del año 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;La Cláusula 12.3 del Pliego de Cláusulas de Explotación que rige el &amp;nbsp;contrato&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;establece : &lt;/span&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;&amp;quot;12&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(1, 1, 1)"&gt;.&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;3.- &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;Anualmente, &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;a partir del primero de &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;enero &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;del año siguiente a la&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt; adjudicación del concurso, la APB podrá autorizar la actualización de dichas tarifas &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;teniendo en &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;cuenta el incremento previsible de los diferentes elementos que integran el&lt;/span&gt;&lt;/em&gt; &lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;coste de los &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;servicios &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;prestados, estableciéndose &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;como &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;límite superior, para cada tarifa&lt;/span&gt;&lt;/em&gt; &lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;en particular, &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;el &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;que resulte de la aplicación del incremento del Indice de Precios al&lt;/span&gt;&lt;/em&gt; &lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Consumo en &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;el &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;ejercicio &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;económico &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;anterior&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(72, 79, 77)"&gt;, &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;si &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(47, 51, 52)"&gt;es &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;inferior a la &amp;nbsp;actualización&lt;/span&gt;&lt;/em&gt; &lt;em&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;calculada. &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(72, 79, 77)"&gt;&amp;quot;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;La empresa GLOBAL &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Y&lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;ACHT&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;FINISHING S.L. presenta propuesta basada en un estudio económico financiero, donde se establece que los incrementos de costes durante la explotación de la concesión son superiores a la cantidad solicitada. Los incrementos propuestos se justifican sobre la base de la distribución de su estructura de costes, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;los costes de explotación aumentan, tanto en los gastos generales, como de mantenimiento, de personal, así como en seguros &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;gastos financieros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Por el Jefe del Departamento de Explotación Portuaria ha sido examinada la propuesta presentada &lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;resultando la actualización solicitada del 0,3%, conespondiente a la variación del Índice de Precios al Consumo ( I.P.C.) en el año 2013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Lo q ue cú mpleme exponer a esa Presidencia, por si tiene a bien resolver &lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;en el ejercicio de la facultad prevista en el art. 30.5 del Texto Refundido de la Ley de Puertos del Estado y de la Marina Mercante&lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;aprobado por Real Decreto Legislativo 2/201 2&lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;,&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;de 5 de septiembre, delegada por acuerdo del Consejo de Admi nistración de fecha 1 1 de noviembre de 1993:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;&amp;quot;Autorizar a la empresa GLOBAL YACHT FINISHING S.L. la modificación de&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;tarifas máximas referentes a la Concesión para la explotación de un edificio situado en&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;el Espigón exterior del Puerto de Palma de Mallorca, con vigencia a partir del día 1 de&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;enero de 2014&lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;,&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Suministro de agua y energía eléctrica&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Tarifas de la APB, para el Puerto de Palma, vigentes en cada momento, en función del acuerdo adoptado, el 26 de enero de 1999, por el Consejo de Administración de la APB&lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;con las actualizaciones que, al respecto, pudieran aprobarse por el organismo competente, incrementadas como máximo un 1&lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;O&lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;%, en concepto de explotación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Suministro del servicio de telefonía y de transmisión de datos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;A los suministros del servicio de telefonía &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;de transmisión de datos, se aplicarán las tarifas de la(s) compañía(s) suministradora(s) incrementándolas un 10%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Explotación de locales y despachos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;30,65.-euros/m2&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;y mes o fracción, como precio máximo. Este precio se&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;entenderá como precio medio mensual &lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;promediado en el conjunto del año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Aseos públicos para usuarios del puerto&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Gratuito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Con carácter gratuito&lt;/span&gt;&lt;span style="color: rgb(56, 56, 56)"&gt;, &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;conforme establece el Pliego de Bases &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 29, 29)"&gt;Condiciones el&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;concesionario deberá encargarse de la limpieza y conservación del edificio, de&lt;/span&gt; &lt;span style="color: rgb(28, 29, 29)"&gt;los aseos públicos, así como de disponer de los medios suficientes para el &lt;/span&gt;&lt;strong&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;depósito &lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;y&lt;/span&gt;&lt;/strong&gt; &lt;strong&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;recogida &amp;nbsp;de los residuos sólidos &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;que &lt;/span&gt;&lt;span style="color: rgb(47, 45, 45)"&gt;se &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;puedan produc &lt;/span&gt;&lt;span style="color: rgb(31, 63, 93)"&gt;i&lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;r&lt;/span&gt; &lt;span style="color: rgb(28, 28, 28)"&gt;en dichas áreas &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;su traslado a vertedero autorizado o planta de tratamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;La empresa GLOBAL YACHT FINlSHING S.L. procederá a la inserción en &lt;/span&gt;&lt;span style="color: rgb(47, 45, 45)"&gt;el &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;B.0.I.B.&lt;/span&gt; &lt;span style="color: rgb(28, 28, 28)"&gt;de las tarifas aprobadas, así como el Clausulado de aplicación de tarifas, a los efectos de su&lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt; publicidad, que serán remitidas a la APB una vez publicadas&lt;/span&gt;&lt;span style="color: rgb(61, 61, 61)"&gt;. &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;De conformidad con la cláusula&lt;/span&gt; &lt;span style="color: rgb(28, 28, 28)"&gt;1&lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;0.4&lt;/span&gt; &lt;span style="color: rgb(28, 28, 28)"&gt;del Pliego de Cláusulas de Explotación la empresa GLOBAL YACHT FINISHING S.L. tendrá expuesto al público un cuadro de tarifas &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;condiciones de aplicación debidamente selladas por la Autoridad Portuaria, &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;y &lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;en la página web de GLOBAL YAHCT FINISHING S&lt;/span&gt;&lt;span style="color: rgb(87, 87, 87)"&gt;.&lt;/span&gt;&lt;span style="color: rgb(28, 28, 28)"&gt;L..&amp;quot;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
