    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-right: 0.24cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;Dado que las notificaciones realizadas por correo certificado, con acuse de recibo, no han surtido efecto y no se han podido hacer efectivas, por ignorarse el domicilio o no haber encontrado al interesado que se relaciona, se procede, en cumplimiento del que establecen los artículos 59.5 y 61 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común (BOE de 27 de noviembre) a la publicación en el Boletín Oficial de las Islas Baleares de la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: 0.24cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;“&lt;/span&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;Visto el expediente sancionador más abajo relacionado y haciendo uso de la facultad conferida en el artículo 21.1.n) de la Ley 7/1985, de 2 de abril, de Bases de Régimen Local, esta Alcaldía RESUELVE:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;Núm.exp.: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;2012/77579/1879&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Denunciado: LUÍS FERREIRO CASAL&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;Precepto infringido: Art. 16.e &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="text-decoration: none"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;OM DEFENSA Y CONSERVACIÓN PATRIMONIO VERDE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Sanción propuesta: 1.001 €&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin-right: 0.24cm; margin-bottom: 0cm; font-style: normal; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Fecha de resolución: 27 de diciembre de 2013&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: 0.24cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;1.º &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="font-weight: normal"&gt;Estimar las alegaciones presentadas contra el acuerdo de iniciación del presente procedimiento sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin-right: 0.24cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2.º Y, en consecuencia, archivar el expediente sancionador.&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin-right: 0.24cm; margin-bottom: 0cm; font-style: normal; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra esta resolución, que agota la vía administrativa, cabe interponer, con carácter potestativo, RECURSO DE REPOSICIÓN ante el mismo órgano que lo ha dictado, de acuerdo con lo dispuesto en el artículo 116 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, según la redacción dada al mismo por la Ley 4/1999, de 13 de enero. El plazo para interponerlo es de UN MES a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer RECURSO CONTENCIOSO-ADMINISTRATIVO hasta que se haya resuelto el de REPOSICIÓN.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-right: 0.24cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;EL RECURSO DE REPOSICIÓN POTESTATIVO deberá presentarlo en el Registro General de este Ajuntament o en las dependencias a que se refiere el Art. 38.4 de la Ley 30/92, de 26 de noviembre, antes citada, y se entenderá desestimado cuando no se haya resuelto y notificado la resolución en el término de UN MES, a contar del día siguiente a su interposición, quedando en este caso expedita la vía Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p lang="es-ES" style="margin-right: 0.24cm; margin-bottom: 0cm; font-style: normal; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De no utilizar el Recurso Potestativo de Reposición, cabe interponer directamente Recurso Contencioso-Administrativo, conforme a lo establecido en el artículo anteriormente citado, y a los artículos 45 y ss de la Ley 29/98, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa, ante el Juzgado de lo Contencioso-Administrativo en el plazo de 2 MESES, a contar desde el día siguiente al de la recepción de la presente notificación.&lt;/span&gt;&lt;/p&gt;
