    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Pleno del Consell de Mallorca, en sesió de día 12 de diciembre de 2013, aprobó provisionalmente la modificación de la Ordenanza fiscal reguladora de la tasa por los servicios de inspección técnica de vehículos, para la adaptación al nuevo concepto de tasa con motivo de la modificación de la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El expediente se sometió a información pública, mediante la inserción de los anuncios correspondientes en el tablón de edictos desde día 20 de diciembre de 2013 a 10 de febrero de 2014, en el diario Ultima Hora de día 31 de diciembre de 2013, y en el BOIB núm. 178 de día 26 de diciembre de 2013, durant el plazo de treinta días, para que todas las personas interesadas lo pudieran examinar y pudieran formular las reclamaciones y las sugerencias pertinentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Durante este plazo no se presentó ninguna alegación, por lo cual y, de acuerdo con lo que acordó el Pleno, el acuerdo se convirtió en definitivo y se ordenó que se publicase íntegramente el texto en el&amp;nbsp; &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;, que se incorpora como anexo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra este acuerdo, que agota la vía definitiva, se puede interponer recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares, en el plazo de dos meses, a contar a partir del día siguiente a la publicación de este acuerdo. Todo ello, de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. Ello no obstante, se puede ejercitar, en su caso, cualquier otro recurso que se considere pertinente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px; text-align: left"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 1º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;FUNDAMENTO, NATURALEZA Y ÁMBITO DE APLICACIÓN.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local i con forme con lo que disponen los artículos 15 a 19 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, este Consell Insular de Mallorca establece la Tasa por la inspección técnica de vehículos, que se rige por la presente Ordenanza Fiscal, cuyas normas se atienden a lo previsto en el artículo 132 del citado Real Decreto Legislativo 2/2004.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. El ámbito de aplicación es la isla de Mallorca.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 2º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;HECHO IMPONIBLE.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Constituye el hecho imponible de la Tasa, la prestación, por el Consell Insular de Mallorca, de los servicios de inspección técnica de vehículos relativos a las revisiones periódicas, a las previas a la matriculación, así como las autorizaciones de reformas, expedición de duplicados, certificados y otras actuaciones relacionadas con el reconocimiento de los vehículos. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 3º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SUJETO PASIVO.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Son sujetos pasivos contribuyentes, las personas físicas o jurídicas y las entidades que figuran en el artículo 33 de la Ley General Tributaria que los hayan solicitado o aquellos a los que se preste cualquiera de los servicios que constituyen el hecho imponible de la Tasa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 4º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;TARIFA.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La tasa se exigirá de acuerdo con las siguientes tarifas:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Suplemento para la inspección fuera del horario de trabajo: el precio se incrementará en un 25% (sólo se podrán realizar fuera del horario de trabajo a petición del interesado).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Para la segunda inspección de comprobación de la corrección de los defectos observados en la inspección periódica con resultado desfavorable, se abonará una tasa del 30% de la primera, siempre que el plazo de presentación del vehículo no sea superior a dos meses; en este caso se procederá a realizar una inspección completa del vehículo, abonando el 100% de la tasa corresponendiente.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso de que el resultado de la inspección sea desfavorable, y que los defectos observados no obliguen a pasar por la línea de inspección para comprobar su corrección, y no sean más de 4 defectos graves, se concederá un plazo máximo de 7 días hábiles para poder pasar la segunda inspección sin abonar tasas.&amp;nbsp; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En las inspecciones periódicas a tractores y remolques agrícolas se aplicará la tasa de desplazamiento [P = 53,71€ + (n-1) * 5,38€], cuando sea necesario, limitando su importe a 7,79€ com a máximo por vehículo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Las tasas caducaran al año de la apertura de los expedientes que las motiven.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 5º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;EXENCIONES Y BONIFICACIONES.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No se concede ninguna exención ni bonificación en la exacción de esta tasa.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 6º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;MERITACIÓN.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se merita la tasa y nace la obligación de contribuir en el momento en que se inicie la actuación administrativa que constituye el hecho imponible.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 7º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;LIQUIDACIÓN E INGRESO.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El procedimiento de ingreso conforme lo que prevé el artículo 27 del Real Decreto Legislativo 2/2004 será el de autoliquidación, debiendo autoliquidar el sujeto pasivo la tasa, en el momento de inciarse la actuación administrativa de prestación del servicio o la realización de la actividad. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 8º.- &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;INFRACCIONES Y SANCIONES.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En todas las cuestiones relativas a la calificación de infracciones tributarias y también a las sanciones que les correspondan en cada caso, se aplicarán las disposiciones contenidas en los artículos 77 y siguientes de la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La presente Ordenanza, que fue aprobada provisionalmente por el Consell de Mallorca, en sesión de dia 12 de diciembre de 2013, entrará en vigor al día siguiente de su publicación íntegra en el, y permanecerá en vigor hasta su modificación o derogación expresa.&lt;/span&gt;&lt;/p&gt;
