    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p class="western" lang="es-ES" style="margin-top: 0.42cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dado que no ha sido posible notificar el acuerdo sancionador por incumplimiento de lo establecido en el artículo 26.1 de la Ordenanza Municipal de limpieza, se procede a su notificación de acuerdo con lo que determina el artículo 59.5 de la Ley 30/92 de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común a la persona que se detalla en el anexo, haciendo constar lo siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-top: 0.42cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;&lt;strong&gt;“Primero.&lt;/strong&gt; Sancionar al señor J.L.S.J, con DNI&amp;nbsp;53939578R , con una multa de&amp;nbsp; 350 euros, &lt;/span&gt;&lt;span style="font-variant: normal"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;como presunto responsable de una falta de carácter leve por incumplimiento de lo establecido en el artículo 26.1 de la Ordenanza Municipal de Limpieza, publicada en el BOIB de fecha 29 de mayo de 2001, que establece que “&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-variant: normal"&gt;&lt;span lang="es-ES"&gt;&lt;span style="font-style: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Queda totalmente prohibido tirar o abandonar en la vía pública cualquier objeto, ya sea sólido, líquido como gaseoso. Los pequeños residuos, como papeles, colillas, envoltorios y similares se tendran que depositar en las papeleras correspondientes &amp;quot;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-style: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-top: 0.42cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Notificar la presente Resolución al interesado.”&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-top: 0.42cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se le notifica que una vez transcurrido el plazo de pago en periodo voluntario sin haberse efectuado el pago, se incurrirá en el recargo ejecutivo del 5% y se iniciará el procedimiento de apremio con los recargos, intereses de demora y costas que correspondan (art. 28, 163 y siguientes de la Ley 58 /2003 General Tributaria).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-top: 0.42cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la presente Resolución puede interponer recurso de reposición ante la Alcaldía en el plazo de un mes a contar desde el día siguiente la de la recepción de la notificación, de acuerdo con el artículo 14 del Texto refundido de la Ley Reguladora de las Haciendas Locales (Real Decreto Legislativo 2/2004, de 5 de marzo).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western" lang="es-ES" style="margin-top: 0.42cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El expediente podrá consultarse en el Departamento de Secretaria del Ayuntamiento de Alaior (calle Major, núm. 11 de Alaior, teléfono 971 37 10 02, extensión 120).&lt;/span&gt;&lt;/p&gt;
