&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;El Grupo de Acción Local para el Desarrollo Rural de Eivissa y Formentera, en adelante GALDREF, ha participado en el proyecto de cooperación interterritorial Agro-paisajes Insulares, aprobado por el Ministerio de Agricultura, Alimentación y Medio ambiente el 2010 con número de expediente 20105110501000011. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En este proyecto han participado tres grupos de acción local del Estado Español que tienen como características principales ser islas turísticas pequeñas y con un importante sector turístico:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- GALDREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Aider La Gomera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Ader La Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este proyecto tiene como objetivo principal ensayar diferentes metodologías para la custodia del territorio. Dentro del proyecto se han ensayado diferentes metodologías para la conservación del paisaje agrario tradicional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una de las vías exploradas para conservar el paisaje agrario ha sido la valorización de los productos agrarios; por esto el GALDREF, ante la inexistencia de maquinaria similar en Eivissa y Formentera, adquirió una máquina descascarilladora de almendra dentro del marco de este proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La incorporación de esta máquina al territorio permitirá lograr parte de los objetivos del proyecto, al facilitar el procesamiento de pequeñas producciones locales, manteniendo indirectamente el paisaje agrario tradicional de árboles productivos de secano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para que la explotación de la máquina se realice en las mejores condiciones de servicio para los productores de almendra, se realiza un concurso abierto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. OBJETO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El objeto del presente pliego de condiciones es regular las condiciones jurídicas y económicas que tienen que regir el procedimiento de cesión, por parte del GALDREF, de un conjunto de maquinaria para la rotura mecánica y separación manual de almendras, así como el contrato correspondiente a su explotación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. CARACTERÍSTICAS DE LA MAQUINARIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El conjunto de maquinaria objeto del contrato de cesión está formado por:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- 1 máquina partidora de sondas ref. 206/18577.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- 1 mesa de selección manual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- 5 cribas manuales. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las características facilitadas por el fabricante José Borrel S.L. se encuentran http://www.leadereivissaiformentera.com. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Este conjunto de máquina y herramientas anejas se denominará maquinaria de aquí en adelante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. CONDICIONES DE CESIÓN Y USO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.1. La maquinaria es propiedad de GALDREF. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.2. GALDREF, a través de la exposición pública del presente pliego hace de un procedimiento público abierto, para ceder la explotación de la maquinaria, por un periodo de 5 años, a la empresa u organización adjudicataria, en adelante adjudicatario. Después de este periodo se podrá renovar por un nuevo periodo a acordar por ambas partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.3. La maquinaria cedida será utilizada para dar servicio a los propietarios individuales y/o las cooperativas u otras agrupaciones de productores de Eivissa y Formentera que tengan almendros en producción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.4. Se establecerá un mínimo de 40 kg de almendra para procesar y unas condiciones mínimas de limpieza del producto para acceder al servicio de descascarillado de almendra. Estas condiciones estarán expuestas al público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.5. Para la realización del servicio se dispondrá de un horario de atención que será visible al público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.6. Se establecerá una frecuencia mínima de un día al mes para el procesamiento de almendras procedentes de agricultura ecológica, que podrá ser aumentada según demanda, cumpliendo con los requisitos del Reglamento CEE 889/2008 de producción de agricultura ecológica para mantener la cadena del producto ecológico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.7. El adjudicatario se encargará de los costes derivados de la instalación no incluidos en las condiciones de entrega de la maquinaria (apartado 5), mantenimiento de la maquinaria, así como los costes de posibles reparaciones, entre otros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.8. El precio del servicio para los usuarios no podrá incluir la amortización de la maquinaria ni habilitación de espacios cuando hayan sido realizados con ayudas públicas. Sí podrá incluir costes como electricidad, mantenimiento, mano de obra y otros costes de funcionamiento o amortización, siempre que estén debidamente justificados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.9. El precio del servicio se actualizará anualmente según las variaciones del precio de los costes, siempre debidamente justificado y con la aprobación del GALDREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.10. El beneficio del adjudicatario consistirá en la utilización de la maquinaria para procesar materia prima propia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.11. Se realizará un registro, manual y/o informático, de las personas usuarias de la maquinaria que contenderá como mínimo los siguientes datos: día, nombre, apellido, DNI, teléfono, número de registro de la explotación, kg de almendra procesados, procedente de agricultura ecológica (sí/no).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.12. Se informará a los usuarios, cumpliendo con la LOPD,&amp;nbsp; de que forman parte de un registro de usuarios y que sus datos serán cedidas al GALDREF. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.13. GALDREF podrá contactar con los usuarios del servicio para contrastar los datos de los informes y hacer uso de los datos agregados para informar del impacto de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.14. Trimestralmente el adjudicatario enviará un informe sobre el uso realizado de la maquinaria. El informe del último trimestre contenderá un resumen del servicio realizado en todo el año. El GALDREF establecerá el contenido, el formato y el procedimiento de la entrega del informe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.15. El adjudicatario tendrá que hacer un uso adecuado de la maquinaria y cumplir con los requisitos de mantenimiento establecidos por el fabricante. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.16. El adjudicatario no podrá vender, alquilar, trasladar o alterar la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.17. GALDREF podrá revocar el contrato si no se cumplen las condiciones pactadas, y se procederá a la retirada de la maquinaria y a la realización de un nuevo concurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.18. Una vez comunicada la decisión de retirada de la maquinaria, el adjudicatario no podrá oponerse, y se procederá a su retirada independientemente de que el adjudicatario pueda interponer demandas o recursos ante las instancias que considere oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5. CONDICIONES ECONÓMICAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.1. El contrato de cesión no supondrá ningún gasto para GALDREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.2. Están incluidos en el contrato de cesión los gastos de:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Transporte de la maquinaria a un puerto de la isla de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Montaje de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Puesta en marcha y pruebas por parte de un técnico de Borrell S.L.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.3. No está incluido:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Conexión eléctrica a la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Mecanización de la maquinaria, es decir elementos como tolvas automáticas de carga, cintas transportadores, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Ayudante con carretilla elevadora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;- Todo aquello no especificado en el apartado 5.2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.4. Serán por cuenta del adjudicatario todos los otros gastos que puedan derivarse de la instalación de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.5. Se establecerá una garantía de 3.000 € que se volverán, si la maquinaria se devuelve en perfectas condiciones, a la finalización del contrato. Esta garantía se depositará en una cuenta bancaria del GALDREF previamente a la entrega de la maquinaria. El GALDREF podrá devolver parte o la totalidad de la garantía transcurridos dos años de funcionamiento correcto de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.6. Por cada día que se impida el acceso por parte del adjudicatario a la retirada de la maquinaria por el GALDREF, una vez comunicada la decisión de retirada, se penalizará con 100 €/día.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6. ENTIDADES QUE PUEDEN OPTAR A LA MAQUINARIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Puede optar a la explotación de la maquinaria cualquier operador económico o entidad asociativa de Eivissa y/o Formentera. Se dará preferencia a las cooperativas agrarias de las islas de Eivissa y Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El hecho de presentarse al concurso supone la aceptación de las condiciones establecidas en el presente pliego de condiciones sin reserva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los solicitantes tendrán que contar con la habilitación empresarial o profesional que en su caso sea necesaria para poder ejercer la explotación de la gestión de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el supuesto de que un solicitante no tenga las correspondientes licencias de sanidad para el ejercicio de la actividad, se dará un plazo razonable para obtenerlas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7. PRESENTACIÓN DE OFERTAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presentación de las ofertas será secreta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cada solicitante sólo podrá presentar una oferta. La infracción de este requisito invalidará todas las ofertas presentadas por el solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las ofertas se presentarán en la oficina de GALDREF, en el edificio del Consell Insular de Eivissa, avenida de España, 49, 07800 Eivissa. El plazo de presentación de solicitudes es desde el día de publicación del pliego de condiciones en el Boletín Oficial de las Islas Baleares y los 30 días naturales siguientes. La convocatoria se publicará también en la página web del GALDREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las personas interesadas presentarán las propuestas en dos sobres cerrados, el sobre núm. 1: “ Documentación administrativa” y el sobre núm. 2: “Proposición y documentación técnica”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las personas interesadas facilitarán una dirección de correo electrónico a la cual se dirigirán las comunicaciones relacionadas con la tramitación del presente procedimiento de licitación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contenido de las proposiciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El sobre núm. 1 de “Documentación administrativa” contenderá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No se podrá añadir porcentaje de beneficio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Alejandro Montero, ingeniero técnico agrícola del Consell Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Jordi Masip, veterinario del Consell Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Justo González, arquitecto técnico del Consell Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Ramón Roca, ingeniero de Telecomunicaciones del Consell Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Concluido el plazo de presentación de ofertas, el equipo técnico asesor multidisciplinar examinará la documentación aportada en el sobre núm. 1 por las personas interesadas y otorgará en su caso un plazo de enmienda no superior a tres días habilidosos. La comunicación de los defectos o las omisiones subsanables se podrá realizar mediante fax o correo electrónico. La falta de subsanación en plazo de los defectos y las omisiones advertidos dará lugar a la exclusión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El sobre núm. 2 se abrirá en un plazo no superior a 7 días de la apertura del sobre núm. 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para la valoración de las proposiciones y la determinación de la oferta económicamente más ventajosa se atenderá al criterio de precio ofrecido y otras condiciones del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se tendrán en cuenta también otras mejoras ofrecidas que repercutan en el servicio al usuario final y que no supongan incremento de precio. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El equipo técnico asesor multidisciplinar acordará una propuesta que elevará a la consideración del Comité Ejecutivo del GALDREF. El Comité Ejecutivo del GALDREF resolverá motivadamente el concurso, ordenando las candidaturas por orden de prioridad en el acceso a la explotación de la maquinaria. Esta se otorgará a la candidatura primera de la lista, y el resto quedará en lista por si se tuviera que cambiar de adjudicatario. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el plazo máximo de 2 meses desde la apertura de las ofertas se hará la adjudicación y se notificará al adjudicatario la aceptación de la oferta para proceder a la firma del contrato de cesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;El contrato lo firmarán un representante autorizado del adjudicatario y el presidente del GALDREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;9. MOTIVOS DE DISOLUCIÓN DEL CONTRATO DE CESIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&amp;nbsp;GALDREF podrá disolver el contrato en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Negación de prestación de servicio, cuando el usuario cumpla con los requisitos establecidos para acceder.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Variación del precio del servicio injustificado o sin aprobación del GALDREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Falsedad documental en los informes de explotación de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Utilizar la maquinaria incorrectamente y/o para un uso diferente del establecido en el contrato.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Incumplimiento del procedimiento de mantenimiento de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Subarrendamiento o traslado de la maquinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- No cumplir con el plan de gestión y explotación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el supuesto de que se disuelva el contrato, se retirará la maquinaria. Los costes derivados de la retirada los asumirá el adjudicatario del contrato, así como la penalización en caso de no poderse realizar la retirada tal como se expone en su punto 5.6 del presente pliego.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
