    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Ayuntamiento ha intentado notificar por correo certificado a los interesados que se relacionan&amp;nbsp; en esta resolución, notificación en la cual consta que no se ha podido llevar a cabo la misma porque en unos casos se ignoraba la dirección de los interesados y en otros no se han encontrado en los mismos a los interesados.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Publicamos, por tanto esta resolución en el Boletín Oficial de las islas Baleares, así como en el tablón de anuncios del Ayuntamiento de Calvià y demás correspondientes, de conformidad con lo que estipulan los artículos 59.4 y 61 de la Ley 30/1992 de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común –BOE de 27 de noviembre-.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DECRETO DE ALCALDÍA.-&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SUP.AB (V.P.F)/ DIC-FEB/13-14&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;VEHÍCULOS EN VÍA PÚBLICA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Antecedentes de Hecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por Resolución de Alcaldía fue iniciado expediente administrativo a la vista de que el vehículo de su titularidad estuvo&amp;nbsp; estacionado por un periodo superior a un mes en el mismo lugar y/o&amp;nbsp; presentaba desperfectos evidentes que hacían imposible su desplazamiento por sus propios medios, o por no disponer de la documentación reglamentaria, o bien suponiendo riesgo o peligro para la seguridad de las personas, o porque le faltaban las placas de matrícula.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Transcurrido el plazo para formular alegaciones y/o presentar documentos no constando la presentación de prueba o documento alguno, en base a los siguientes&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de Derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Primero.- De conformidad con lo establecido en el artículo 86 del Texto Articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, aprobado por Real Decreto Legislativo 339/1990 de 2 de Marzo, modificado por Ley 18/2009, de 23 de noviembre, la administración competente en materia de&amp;nbsp; tráfico, podrá ordenar el traslado del citado vehículo&amp;nbsp; a un Centro Autorizado de Tratamiento de Vehículos (CAT) para su posterior destrucción&amp;nbsp; y descontaminación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Segundo.- La Ley 22/2011, de 28 de julio, de residuos y suelos contaminados, en su artículo 3 define&amp;nbsp; a los vehículos abandonados como “Residuos domésticos”, otorgando en su artículo 12.5.c)&amp;nbsp; a las Entidades locales competencia para la gestión de residuos, y tipificado en el artículo 46.3&amp;nbsp; como infracción de carácter grave “c) el abandono, vertido o eliminación incontrolado de cualquier tipo de residuos no peligrosos ...”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta Alcaldía, en virtud de las atribuciones que le confiere la legislación vigente,&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;RESUELVE:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1º.- Declarar al vehículo relacionado como Residuo Sólido Urbano, y ordenar su traslado a un Centro Autorizado de Tratamiento de Vehículos (CAT) para su posterior destrucción&amp;nbsp; y descontaminación, con la consiguiente&amp;nbsp; baja de oficio en el Registro de la Dirección General de Tráfico, abono de las tasas en los casos que procedan,&amp;nbsp; por la retirada del vehículo; estancia o custodia en el depósito municipal;&amp;nbsp; descontaminación, desguace&amp;nbsp; y gestión de la baja administrativa,&amp;nbsp; todo ello sin perjuicio de los débitos que se hayan contraído con la administración municipal u otras administraciones a los que deberá hacer frente el titular del vehículo, o se le dará la finalidad establecida en el artículo 86.3 del citado RDL 339/1990,&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2º.- Remitir el expediente al Área de Inspección e Infracciones municipal&amp;nbsp; para la incoación de expediente administrativo de carácter sancionador por abandono de&amp;nbsp; residuo sólido urbano.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3º.- Notifíquese la presente resolución al titular del vehículo .&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SUP.AB (DEP.F)/ ENE / 14&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VEHÍCULOS EN DEPÓSITO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Antecedentes de Hecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por Resolución de Alcaldía fue iniciado expediente administrativo a la vista de que en el depósito municipal de la Policía Local de Calvià&amp;nbsp; permanecía el vehículo relacionado al haber sido retirado de la vía pública o inmovilizado por alguna de las causas previstas en la ley.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Transcurrido el plazo para formular alegaciones y/o presentar documentos no constando la presentación de prueba o documento alguno, en base a los siguientes&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de Derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Primero.- De conformidad con lo establecido en el artículo 86 del Texto Articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, aprobado por Real Decreto Legislativo 339/1990 de 2 de Marzo, modificado por Ley 18/2009, de 23 de noviembre, la administración competente en materia de&amp;nbsp; tráfico, podrá ordenar el traslado del citado vehículo&amp;nbsp; a un Centro Autorizado de Tratamiento de Vehículos (CAT) para su posterior destrucción&amp;nbsp; y descontaminación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Segundo.- La Ley 22/2011, de 28 de julio, de residuos y suelos contaminados, en su artículo 3 define&amp;nbsp; a los vehículos abandonados como “Residuos domésticos”, otorgando en su artículo 12.5.c)&amp;nbsp; a las Entidades locales competencia para la gestión de residuos, y tipificado en el artículo 46.3&amp;nbsp; como infracción de carácter grave “c) el abandono, vertido o eliminación incontrolado de cualquier tipo de residuos no peligrosos ...”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta Alcaldía, en virtud de las atribuciones que le confiere la legislación vigente,&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;RESUELVE:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1º.- Declarar al vehículo relacionado como Residuo Sólido Urbano, y ordenar su traslado a un Centro Autorizado de Tratamiento de Vehículos (CAT) para su posterior destrucción&amp;nbsp; y descontaminación, con la consiguiente&amp;nbsp; baja de oficio en el Registro de la Dirección General de Tráfico, abono de las tasas en los casos que procedan,&amp;nbsp; por la retirada del vehículo; estancia o custodia en el depósito municipal;&amp;nbsp; descontaminación, desguace&amp;nbsp; y gestión de la baja administrativa,&amp;nbsp; todo ello sin perjuicio de los débitos que se hayan contraído con la administración municipal u otras administraciones a los que deberá hacer frente el titular del vehículo, o se le dará la finalidad establecida en el artículo 86.3 del citado RDL 339/1990,&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2º.- Remitir el expediente al Área de Inspección e Infracciones municipal&amp;nbsp; para la incoación de expediente administrativo de carácter sancionador por abandono de&amp;nbsp; Residuo Sólido Urbano.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3º.- Notifíquese la presente resolución al titular del vehículo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Contra la presente Resolución, que pone fin a la vía administrativa, cabe interponer, con carácter potestativo, recurso de reposición ante esta Alcaldía, de acuerdo con lo dispuesto en el art. 116 de la Ley 30/92, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común. El plazo para interponerlo es de un mes a contar desde el día siguiente al de la notificación/publicación de la presente resolución, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto el de reposición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;El recurso de reposición potestativo deberá presentarlo en el Registro General de este Ajuntament o en las dependencias a que se refiere el art. 38.4 de la Ley 30/92, de 26 de noviembre, antes citada, y se entenderá desestimado cuando no se haya resuelto y notificado la resolución en el término de un mes, a contar del día siguiente a su interposición, quedando en este caso expedita la vía Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;De no utilizar el recurso potestativo de reposición, cabe interponer directamente recurso contencioso-administrativo, conforme a lo establecido en el artículo anteriormente citado y a los artículos 45 y siguientes de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa ante los Juzgados de lo Contencioso Administrativo de Palma de Mallorca, en el plazo de dos meses, a contar desde el día siguiente al de la notificación/publicación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Todo ello sin perjuicio de cualquier otro recurso o acción que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;De conformidad con lo dispuesto en la Ley Orgánica 15/1999, de 13 de diciembre, de protección de datos de carácter personal:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;1.- Sus datos se incorporarán en un fichero de datos personales, denominado GESTIÓN DE VEHÍCULOS, del que es responsable el Ajuntament de&amp;nbsp; Calvià, cuya finalidad es que la Policía Local de Calvià, en el ejercicio de sus competencias, cuente con un sistema de gestión de retirada, precinto, inmovilización, depósito y custodio de las vías públicas del término municipal, la señalización de vías por eventos, obras y otras circunstancias, la gestión administrativa de los expedientes de abandono&amp;nbsp; y el tratamiento de los vehículos al final de su vida útil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;2.- Cesiones de los datos previstas: cesión de datos a la empresa concesionaria del servicio de gestión de retiradas, depósito y custodia de las vías públicas del término municipal de Calvià, la señalización de las vías por eventos, obras&amp;nbsp; y otras circunstancias, la gestión administrativa de los expedientes de abandono y el tratamiento de los vehículos al final de su vida útil. Estos datos también podrán ser cedidos en los términos previstos en la Ley Orgánica 15/1999, de protección de datos de carácter personal, a órganos judiciales, fiscalía y tribunales para la investigación de delitos y faltas y a la autoridad administrativa competente para la sanción de infracciones administrativas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;3.- El órgano administrativo ante el que puede ejercitar, en su caso, los derechos acceso, rectificación y cancelación, oposición y aquellos otros reconocidos en la citada ley orgánica, es el Servicio de Atención al Ciudadano del Ajuntament de Calviá, situado en la c/ Julià Bujosa Sans, batle, nº. 1, Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
