    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Dado que no se ha podido practicar la notificación personal de la resolución sobre caducidad de inscripciones en el Padrón Municipal de Habitantes de los extranjeros no comunitarios sin autorización de residencia permanente , que se relacionan a continuación, en cumplimiento del artículo 59 , 4 de la Ley 30 /02 de 26 de noviembre , de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, mediante el presente anuncio se notifica lo siguiente :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;DECRETO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Resolución de declaración de bajas por caducidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;En Lloret de Vistalegre , el Alcalde, Sr. . Juan Jaume Ramis , en presencia del secretario de la corporación , ha dictado la siguiente resolución de conformidad con los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Vista la tramitación del expediente de bajas por caducidad en el padrón municipal de habitantes .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;I. La Resolución de 28 de abril de 2005 , de la Presidencia del Instituto Nacional de Estadística y del Director General de Cooperación Local , establece las instrucciones técnicas a los ayuntamientos sobre el procedimiento para acordar la caducidad de las inscripciones padronales de los extranjeros no comunitarios sin autorización de residencia permanente que no hayan sido renovadas cada dos años .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;II . El Instituto Nacional de Estadística ha remitido a este Ayuntamiento fichero informatizado relativo a extranjeros no comunitarios sin autorización de residencia susceptibles de caducidad .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;III . Los extranjeros no comunitarios que más adelante se detallan , no han manifestado expresamente su voluntad de renovar su inscripción en el padrón municipal de habitantes .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Por todo ello RESUELVO :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;&lt;strong&gt;Primero &lt;/strong&gt;. - Declarar la caducidad de la inscripción padronal y , en consecuencia acordar la baja en el padrón municipal de este municipio , por no haber renovado su inscripción mediante un acto expreso de las siguientes personas :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;&lt;strong&gt;Segundo &lt;/strong&gt;. Las bajas por caducidad incluidas en esta resolución serán efectivas en el momento de realizarse la notificación a los interesados o en su caso , la publicación por edictos en el BOIB y en el tablón de anuncios de este Ayuntamiento .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;&lt;strong&gt;Tercero &lt;/strong&gt;. Notificar la presente resolución a los interesados de conformidad con lo dispuesto en la Ley 30/92 , de 26 de noviembre de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;&lt;strong&gt;Cuarto&lt;/strong&gt; . Dejar sin efecto el contenido de esta resolución para todos los extranjeros que figuran relacionados anteriormente y que durante el tiempo que transcurra entre la notificación y el plazo para recurrir , hayan efectuado el acto expreso la inscripción en el padrón .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;&lt;strong&gt;Quinto&lt;/strong&gt; . Trasladar esta Resolución a las personas interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Lo que se hace público para general conocimiento y efectos , significando que contra esta Resolución , se puede interponer:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;- En el plazo de un mes , a contar desde el día siguiente a la recepción de esta notificación , recurso potestativo de reposición ante el mismo órgano que la ha dictado . Transcurrido un mes desde la interposición del recurso de reposición sin que se haya notificado la resolución , se producirá la desestimación por silencio administrativo y se podrá interponer recurso contencioso administrativo en el plazo de seis meses a contar desde el día siguiente de la desestimación presunta .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;- En el plazo de dos meses , a contar desde el día siguiente a la recepción de esta notificación , recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma , salvo que se hubiera interpuesto recurso potestativo de reposición , en este caso se esperar la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Sin embargo , se puede interponer cualquier otro recurso si se considera procedente en derecho .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
