    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el procedimiento de referencia se ha dictado la resolución del tenor literal siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SENTENCIA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En Palma de Mallorca&amp;nbsp; a trece de enero del año dos mil catorce.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Vistos&amp;nbsp; por Dª. CLARA BESA RECASENS, Magistrado-Juez del Juzgado de Primera Instancia num. Ocho&amp;nbsp;&amp;nbsp; de esta Ciudad y su Partido Judicial, los autos seguidos en el Juicio Ordinario 584/2013 , promovido por COMUNIDAD DE PROPIETARIOS LOS PINOS , sito en el aseo de Illetas num.48 de Calvía, representado en Juicio por el Procurador de los Tribunales Dº. Carlos Ginard Nicolau., y asistido por el Letrado Dª. Mª Antonia Siquier Sampol , en ejercicio de una acción de&amp;nbsp; reclamación de cantidad dirigida contra, la HERENCIA YACENTE o los DESCONOCIDOS HEREDEROS&amp;nbsp; DE DOÑA JULIA PISTERS y Dº. HEINRICH DIETRICH SCHANZ,&amp;nbsp; declarados en situación de rebeldía procesal.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FALLO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ESTIMAR íntegramente&lt;/strong&gt; la demanda presentada por&amp;nbsp; el Procurador de los Tribunales &amp;nbsp;Dº. Carlos&amp;nbsp; Ginard Nicolua , en nombre y representación de&amp;nbsp; COMUNIDAD DE PROPIETARIOS EDIFICIO LOS PINOS, sito en el Paseo de Illetas num. 48 de Calvía ,&amp;nbsp;&amp;nbsp; condenando&amp;nbsp;&amp;nbsp; a los demandados en rebeldía&amp;nbsp;&amp;nbsp; HERENCIA YACENTE o los DESCONOCIDOS HEREDEROS&amp;nbsp; DE DOÑA JULIA PISTERS y Dº. HEINRICH DIETRICH SCHANZ&lt;strong&gt;, &lt;/strong&gt;a pagar a la actora el importe de&amp;nbsp;&amp;nbsp;&amp;nbsp; ocho mil ochocientos setenta y nueve euros y cuarenta y seis céntimos (8879,46&lt;strong&gt;€&lt;/strong&gt;) , más los intereses legales desde la interposición de la demanda y sin perjuicio de los intereses&amp;nbsp; de mora procesal desde la fecha de la sentencia , con expresa imposición de las costas causadas en la presente instancia. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así por esta mi sentencia, la pronuncio , mando y firmo,&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;( Magistrado-Juez) &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DILIGENCIA.- &lt;/strong&gt;Notifíquese a las partes la presente resolución.&amp;nbsp; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Modo de Impugnación: &lt;/strong&gt;Contra esta sentencia cabe recurso de apelación dentro de los&amp;nbsp; veinte días siguientes a su notificación, que se interpondrá ante este órgano judicial.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y como consecuencia del ignorado paradero de HERENCIA YACENTOE o los DESCONOCIDOS HEREDEROS DE DOÑA JULIA PISTERS Y D. HEINRICH DIETRICH SCHANZ, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;PALMA DE MALLORCA a trece de enero de dos mil catorce.&lt;/span&gt;&lt;/p&gt;
