    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Intentadas, sin efecto, las notificaciones por correro certificado con acuse de recibo, y dado que no han podido practicarse por ignorarse el domicilio o no haber sido localizadas las personas interesadas que se relacionan, se procede, en cumplimiento de lo que establece el artículo 59.5 de la Ley 30/1992 de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común a la publicación en el Boletín de las Islas Baleares del siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“DECRETO 807/2013. Vistos los expedientes de vehículos abandonados que se relacionan a continuación por haberse retirado de la vía pública y haber estado durante más de dos meses en el depósito municipal de vehículos sin que la personal titular haya realizado ninguna gestión para su retirada o haya formulado alegaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y una vez se ha intentado notificar a los titulares de los mismos &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dado que según el artículo 50.2a) de la Ordenanza Municipal de Gestión de Residuos Urbanos y Limpieza Pública en relación al artículo 86 del RDL 339/1990 una de las causa posibles a fin de iniciar expediente de tratamiento residual&amp;nbsp; es haber estado dos meses en el depósito municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;RESUELVO:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Requerir a las personas titulares de los vehículos, con anterioridad a la orden de traslado al Centro Autorizado de Tratamiento de Vehículos, a fin de que procedan a la retirada del vehículo en el &lt;strong&gt;plazo de un mes&lt;/strong&gt;, de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990, de 2 de marzo, por el que se aprueba el Texto Articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, previo pago de los gastos generados por la grúa municipal como por la custodia del vehículo tal y como establece el artículo 85.2 del RDL 339/1990 y el artículo 107 de la Ordenanza de Policía y Buen Gobierno.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1Si en este plazo no se retira el vehículo en cuestión, se procederá al tratamiento del vehículo como residuo doméstico con las siguientes consecuencias: traslado a un centro autorizado de tratamiento para su prosterior descontaminación y destrucción y la incoación del oportuno expediente sancionador en base al artículo 46.3c de la Ley 22/2011 de 28 de julio, de Residuos y Suelos Contaminados, con una multa de 901 hasta 45.000 euros.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Avisar a las personas titulares de los vehículos que en este plazo pueden presentar declaración de renuncia voluntaria del vehículo a favor del Ayuntamiento, previo pago de los gastos ocasionados, y en este caso no se incoarà el correspondiente expediente sancionador.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
