    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No habiéndose presentado por los interesados, durante el plazo de exposición al público, ninguna reclamación contra la ordenación y establecimiento de los precios públicos para la prestación del servicio de utilización de elementos de mobiliario municipal, así como la ordenanza reguladora de los mismos, aprobada provisionalmente por el Pleno del Ayuntamiento, en sesión celebrada el día 25 de noviembre de 2013, ha resultado definitivamente aprobada, y por este motivo, se publica el texto íntegro del mencionado acuerdo, que es el siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“PRIMERO.- Aprobar inicialmente el establecimiento de precios públicos por la prestación del servicio de utilización de elementos de mobiliario municipal, así como la ordenanza reguladora de los mismos, según la redacción siguiente: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;“ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR LA PRESTACIÓN DEL SERVICIO DE UTILIZACIÓN De ELEMENTOS DE MOBILIARIO MUNICIPAL&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Artículo 1. Fundamento legal. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;En uso de las atribuciones conferidas en los artículos 41 a 47 y 127 del Real decreto Legislativo 2/2004, de 5 marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, este Ayuntamiento establece el precio público por la prestación del servicio de utilización de elementos de mobiliario municipal. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Artículo 2. Objeto. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Constituye el objeto de este precio público la utilización, previa solicitud (modelo del cual se adjunta como ANEXO I) por parte de los interesados, de los siguientes elementos de mobiliario municipal:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Artículo 3. Obligados al pago. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Vendrán obligados al pago del precio público las personas, físicas o jurídicas, que se beneficien, disfruten o aprovechen los elementos de mobiliario municipal, para la utilización de los cuales se ha establecido el presente precio público. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;En cuanto a los sujetos responsables se estará a lo que establece la LGT en sus artículos 41 a 43.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Artículo 4. Nacimiento de la obligación de pago. Forma&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;1. La obligación de pagar el precio público nace desde que se inicia la prestación del servicio de utilización del mobiliario. No obstante, el importe total del precio público y, si procede, de la fianza, tendrá que ser depositado una vez obtenida autorización municipal para su utilización y antes de que tenga lugar la recogida del material.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Cuando por causas no imputables a la persona obligada al pago del precio el servicio no se preste, procederá la devolución del importe correspondiente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;2. El pago del precio público y el ingreso del depósito se efectuará en el Ayuntamiento de Santa Margalida en el número de cuenta corriendo que se indique al efecto. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Artículo 5. Cuantía. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;La cuantía a abonar, IVA incluido, por la utilización de los elementos de mobiliario municipal será la siguiente: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;1. Están exentos del pago de las tarifas las asociaciones y entidades que desarrollen sus actividades en el término de Santa Margalida.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;2. La exención del pago de la tarifa, se extenderá también al depósito.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;3. La aplicación de la exención requerirá la petición expresa de la persona solicitante.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Artículo 7. Normas de gestión.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;1. La utilización de los elementos de mobiliario municipal está sujeta a autorización previa de alcaldía o de la concejalía en quien delegue, que podrá denegarla en función de la disponibilidad del mobiliario y de las necesidades y programación del Ayuntamiento de Santa Margalida.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;2. La solicitud para utilizar los elementos de mobiliario municipal se tiene que realizar con una antelación mínima de 10 días hábiles antes de aquel en que se tengan que utilizar. A efectos de este cómputo, no se tendrá en cuenta ni el día en que se presenta la solicitud ni el día que se tengan que utilizar. Las solicitudes realizadas sin respetar la antelación mínima de 10 días habilidosos podrán ser denegadas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;3. En el plazo máximo de 7 días hábiles desde la presentación de la solicitud, el Alcalde o la concejalía en quien delegue dictará resolución otorgando o denegando la autorización solicitada, entendiéndose denegada la solicitud si dentro del indicado plazo de 7 días no se ha dictado resolución expresa.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;La autorización indicará el importe del precio público y de la fianza a satisfacer, el lugar de pago y el lugar o datos de contacto para proceder a la recogida del material y será notificada, si se posible, electrónicamente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;4. El pago del precio público, que será irreducible, y de la fianza se realizará una vez obtenida autorización y antes de que tenga lugar la recogida del material.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Notificada la autorización, la persona interesada recogerá la liquidación para proceder al pago del precio y de la fianza.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;5. Será obligatorio constituir una fianza por importe de 30.-€, en garantía de la devolución y correcta utilización de los elementos de mobiliario.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Devuelto el mobiliario por parte de la persona autorizada, la persona responsable municipal comprobará que se han devuelto todos los elementos y que los mismos se encuentran en el mismo estado de conservación y limpieza en que se entregaron, emitiendo un informe de conformidad al efecto, que constituirá documento suficiente para proceder a su devolución.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;6. La recogida del material sólo se realizará previa presentación de la autorización otorgada y justificando del pago del precio público.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;7. La persona autorizada será la responsable y encargada de recoger y entregar el mobiliario, excepto cuando se trate de entidades y asociaciones que desarrollen sus actividades en el término de Santa Margalida y respecto de solicitudes formuladas para la realización de actos culturales, festivos u otros donde el Ayuntamiento participe o colabore. En este último caso, el Ayuntamiento será quien se encargará de hacer lo entrega y recogida del material.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;El material la utilización del cual se ha autorizado será devuelto en el plazo máximo de 2 días naturales siguientes a aquel en que tenía que ser empleado. La devolución se realizará al mismo lugar donde fue recogido.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Transcurrido este plazo sin que se haya devuelto el material, será incautada la garantía depositada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;8. Las deudas por el precio público regulado en la presente Ordenanza se podrán exigir por el procedimiento administrativo de constreñimiento.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;DISPOSICIÓN FINAL&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;El acuerdo de establecimiento de este precio público fue adoptado y su Ordenanza fue aprobada por el Ayuntamiento Pleno, en sesión celebrada el día ____________ y empezará a regir a partir del día de su publicación y continuará en vigor hasta que se acuerde su derogación o modificación expresa por parte del Ayuntamiento.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;SEGUNDO.- Dar al expediente la tramitación y publicidad preceptiva, mediante exposición del mismo en el tablón de anuncios del Ayuntamiento y en el Boletín Oficial de la Comunitat Autónoma de las Illes Balears por un plazo de 30 días, dentro de los cuales los interesados podrán examinarlo y plantear las reclamaciones que estimen oportunas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;TERCERO.- Considerar definitivamente adoptado el Acuerdo, en el supuesto de que no se presenten reclamaciones al expediente en el plazo anteriormente indicado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;CUARTO.- Facultar al Alcalde para que adopte cuántas disposiciones y resoluciones estime oportunas para el buen funcionamiento y correcto desarrollo del Ordenanza, respetando, en todo caso, las competencias atribuidas a los otros órganos”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra este Acuerdo, los interesados podrán interponer recurso contencioso administrativo, en el plazo de dos meses contados a partir del día siguiente de la publicación de este anuncio al Boletín Oficial de las Islas Baleares, ante el Tribunal Superior de Justicia de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;
