&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En el procedimiento de referencia se ha dictado la resolución del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;SENTENCIA nº 152/13&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En Palma de Mallorca, a 21 de noviembre de 2.013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Vistos por Dª. Mª Isabel Frade Hevia, Magistrada-Juez del Juzgado de Primera Instancia número cuatro de Palma de Mallorca y su partido, los presentes autos de juicio ordinario seguidos ante este Juzgado bajo el número 272/2.013, a instancia de &lt;strong&gt;BANCO BILBAO VIZCAYA ARGENTARIA, S.A&lt;/strong&gt;. representada por el Procurador/a Sr./a SEGURA SEGUÍ y defendida por el/a Letrado/a Sr./a VILLALONGA TRUJILLO contra &lt;strong&gt;D.&lt;/strong&gt; &lt;strong&gt;ALLEN DAVID COOPER&lt;/strong&gt; y &lt;strong&gt;Dª LEANNE MARIE COOPER&lt;/strong&gt;, quienes han sido declarados en situación de rebeldía procesal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;FALLO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Estimo parcialmente la demanda presentada por &lt;strong&gt;BANCO BILBAO VIZCAYA ARGENTARIA, S.A&lt;/strong&gt;. contra &lt;strong&gt;D.&lt;/strong&gt; &lt;strong&gt;ALLEN DAVID COOPER&lt;/strong&gt; y &lt;strong&gt;Dª LEANNE MARIE COOPER&lt;/strong&gt;, condenando a éstos a que abonen a la actora la cantidad de &lt;strong&gt;4.762,02 €uros&lt;/strong&gt;, más el interés legal de dicha cantidad desde la fecha de interposición de la demanda&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Se declara nula por abusiva la cláusula relativa a los intereses moratorios al tipo del 29% anual contenida en el contrato de préstamo objeto de este contrato.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Sin imposición de costas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Modo de impugnación: &lt;/strong&gt;mediante recurso de &lt;strong&gt;APELACIÓN &lt;/strong&gt;que se interpondrá por medio de escrito presentado ante este juzgado en el plazo de VEINTE DIAS hábiles, contados desde el siguiente al de la notificación de la presente resolución. Es requisito para su admisibilidad la constitución de un único depósito de 50 euros, tal y como exige la Disposición Adicional Decimoquinta de la LOPJ (BOE 04/11/09), que deberá ingresarse en la cuenta de depósito y consignaciones de este Juzgado indicando que se hace concepto de “recurso”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Así lo pronuncio, mando y firmo.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Y como consecuencia del ignorado paradero de ALLEN DAVID COPER Y LEANNE MARIE COOPER, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;PALMA DE MALLORCA a veintiuno de Noviembre de dos mil trece.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
