EDICTO: NOTIFICACIÓN DE RESOLUCIONES DE EXPEDIENTES SANCIONADORES</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La regidora titular del Área de Función Pública y Gobierno Interior y el regidor titular del Área de Seguridad&nbsp; Ciudadana,&nbsp;&nbsp; de acuerdo con&nbsp; las competencias atribuidas por los&nbsp; Decretos de&nbsp; Alcaldía&nbsp;&nbsp; nº. 8436, de 13.5.2013 (BOIB nº 70, de 18.5.2013)&nbsp; y &nbsp;nº. 954, de 27.1. 2014 (BOIB núm. 21, d´11.2.2014), &nbsp;han dictado los acuerdos de resolución de los expedientes sancionadores que figuren en el anexo&nbsp; de este edicto.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Intentada su&nbsp; notificación, ésta no se ha podido realizar. En consecuencia se publica este edicto,&nbsp; de acuerdo con lo previsto en los artículos 59.5 y 61 de la Ley 30/92, de 26 de Noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común (BOE núm. 285, de 27-11-1992), modificada por la Ley 4/1999, de 13 de Enero (BOE núm. 12, de 14-1-1999). </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra el acuerdo de&nbsp; resolución del expediente sancionador, que agota la vía administrativa, se puede interponer recurso de reposición ante el mismo órgano que la ha dictado, de acuerdo con el artículo 108 de la Ley 7/85, de Régimen Local, modificado por el artículo 1.1 de la Ley 57/2003, de 16 de Diciembre (BOE núm. 301 de 17/12/2003). El plazo para interponerlo es de un mes contado a partir del día siguiente de la publicación de esta notificación. En este caso no podrá interponer recurso contencioso administrativo hasta que no se haya resuelto el de reposición.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El recurso de reposición potestativo debe presentarse en el Registro General de este&nbsp; Ayuntamiento o en las dependencias a que se refiere el artículo 38, 4 de dicha&nbsp; Ley 30/92,&nbsp; entendiéndose desestimado si no se ha resuelto y notificado en el plazo de un mes, a partir del&nbsp; día siguiente de su interposición,&nbsp; en cuyo caso queda expedita la vía contenciosa administrativa. Si no interpone el recurso de reposición, puede interponer directamente el recurso contencioso administrativo, según el artículo citado anteriormente y a los artículos 45 y&nbsp; siguientes de la Ley 29/98, de 13 de Julio, reguladora de la jurisdicción contenciosa administrativa, ante el Juzgado Contencioso Administrativo, en el plazo de dos meses a partir del día siguiente de la publicación del presente edicto, sin perjuicio de cualquier otro&nbsp; recurso o acción que considere pertinente.La interposición de recurso no paraliza la vía de apremio, salvo que se garantice el pago de la multa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">LUGAR DE PAGO DE LA SANCIÓN: EN LA RECAUDACIÓN MUNICIPAL, PLAZA DE SANTA EULALIA NÚM. 8, DE 9 A 13.30 HORAS, DE LUNES A VIERNES.
