	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Resultando el intento de notificación sin éxito a la Sra. SARA MAHENA SCHONROGG en repetidas ocasiones, del Decreto de Alcaldía núm. 1049/2014 cuanto a la incoación del expediente núm. 000020/2014-VEHICLESRSU.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Y resultando lo dispuesto en el artículo 59 de la Ley 30/1992, de 26 de noviembre, Ley de régimen jurídico de las Administraciones Públicas y el Procedimiento Administrativo Común. (LRJAP-PAC), se hace público su contenido por un plazo de 20 días a los efectos que la Ley establece.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;Antoni Servera Servera, Alcalde Presidente del Ayuntamiento de Son Servera (Islas Baleares)&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Vista el acta de detección de presunto vehículo abandonado emitida en fecha 12 de septiembre de 2013 por el agente A510013 de la Policía Local de Son Servera, en la que se especifica que se trata de un vehículo con matrícula 7661CBD, marca FIAT , núm. de bastidor ZFA18300000003131, modelo Barcheta de color ROJO y que inicia el expediente para permanecer en el depósito municipal por un periodo superior a dos meses desde la retirada de la vía pública por la autoridad (Guardia Civil). Los desperfectos que se aprecian en el vehículo son los siguientes: ruedas desinfladas, no SOA y no ITV. Asimismo, se especifica que no se colocó la pegatinas de supuesto vehículo abandonado y que la titular del vehículo es Sra. Sara Mahena Schonrogg.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Vista el acta de comprobación de presunto vehículo abandonado emitida en fecha 16 de abril de 2014 por el agente A510021 de la Policía Local de Son Servera, en la que se especifica que el vehículo con matrícula 7661CBD, continúa en el mismo lugar con los mismos síntomas de abandono y que se realicen las gestiones pertinentes con la Guardia Civil de Artà informando que se puede informar al titular para que lo retire o que se trate como vehículo abandonado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Visto el artículo 86 del RDL 339/1990, de 2 de marzo, mediante el que se aprueba el texto articulado de la ley sobre tráfico, circulación de vehículos a motor y seguridad vial.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dado que el artículo 4.1 del RD 1383/2002 establece que todos los vehículos deberán descontaminarse al final de su vida útil, antes de ser sometidos a cualquier otro tratamiento. Y que a tal efecto, el titular de un vehículo que tenga que desprenderse del mismo queda obligado a entregarlo a un centro autorizado de tratamiento.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dado los artículos 46.2.c), 46.4.b) y 47.1.c) de la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Y de acuerdo con las atribuciones que me confiere la normativa vigente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;RESUELVO,&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1º. Iniciar el expediente por presunto vehículo abandonado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2º. Requerir a la Sra. Sara Mahena Schonrogg titular del vehículo con matrícula 7661CBD, para que en el plazo de un mes desde la recepción de la presente resolución proceda a la retirada del citado vehículo del depósito municipal.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3º. Advertir a la Sra. Sara Mahena Schonrogg que en caso de no retirarlo en el plazo establecido se procederá a trasladarlo a un centro autorizado de tratamiento de vehículos para su destrucción y descontaminación o bien se adjudicará el servicio de vigilancia y control del tráfico de este Ayuntamiento y se podrá proceder a iniciar el expediente sancionador por el abandono de un residuo peligroso en la vía pública, lo que puede ser sancionado con multa hasta 9.000 € de acuerdo con la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4º. Notificar la presente resolución a la persona interesada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Contra este requerimiento no puede interponer ningún recurso, si bien puede presentar alegaciones de acuerdo con lo dispuesto en el artículo 70 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo común.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
