    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Pleno del Ayuntamiento de Ariany, en la sesión ordinaria de 8 de julio de 2013, aprobó inicialmente la aprobación de la ordenanza fiscal reguladora del “Precio público para la vigilancia/intervención policial y actuaciones de la brigada u otros empleados municipales o ajenos a requerimiento del ayuntamiento de Ariany “, y se publicó en el BOIB 102 de 23 de julio de 2013. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Finalizado el plazo de exposición pública, habiéndose dado audiencia a los posibles interesados, y teniendo en cuenta que no se ha presentado ninguna sugerencia, alegación o reclamación, se entiende definitivamente aprobada en los términos del art.102 de la Ley 20/2006 de 15 de diciembre, municipal y de régimen local de las islas Baleares, se procede a su publicación íntegra en el Boletín Oficial de la Islas Baleares, a los efectos de su entrada en vigor. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Ordenanza fiscal reguladora del precio público para la vigilancia / intervención policial y actuaciones de la brigada u otros empleados municipales o ajenos a requerimiento del ayuntamiento de Ariany.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 1.º&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Concepto&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;De conformidad con lo previsto en el artículo 57 en relación con el artículo 20 ambos del RDL 2/2004, Texto Refundido de la Ley Reguladora de las Haciendas Locales, este Ayuntamiento establece el precio público por la prestación del servicio de vigilancia especial de los establecimientos que lo soliciten, que se regirá por la presente ordenanza; igualmente se exigirá a las empresas o particulares que provoquen –aunque no lo soliciten - la actuación de la policía, la brigada municipal o servicios ajenos llamados de urgencia siempre que dicha actuación sea necesaria para el orden público y haya negligencia o voluntariedad en el hecho causante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 2.º&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Obligados al pago&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Están obligados al pago del precio público regulado en esta ordenanza los que se benefician de los servicios prestados por este Ayuntamiento, a que se refiere el artículo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 3.º&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cuantía&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. La cuantía del precio público regulado en esta ordenanza será la fijada en la Tarifa contenida en el apartado siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. La Tarifa de este precio público será la siguiente:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por la prestación del servicio de vigilancia/intervención, por el primer periodo de hasta dos horas y por cada hora/fracción posterior:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;9.- Otro personal y medios ajenos la tarifa irá según el coste efectivo soportado por el Ayuntamiento, incrementado en un 10% en concepto de gastos generales.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. La cuantía resultante de la aplicación de la Tarifa anterior se incrementará en un 25 por ciento cuando la prestación del servicio tenga lugar entre las 20 y las 24 horas del día y en un 50 por ciento si se prestara de las 0 horas a las 8 de la mañana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. Los tiempos de prestación efectiva del servicio se computará considerando como momento inicial, el de salida de los efectivos de sus respectivos acuartelamientos o parques y como finalización el de entrada de los mismos, una vez concluido el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 4r.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Obligación de pago&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La obligación de pago del precio público regulado en esta ordenanza nace desde el momento que se preste el servicio especificado en el apartado segundo del artículo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El pago de dicho precio público se efectuará en el momento de presentación al obligado a abonarlo, de la correspondiente factura o liquidación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Artículo 5.º&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Gestión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las personas físicas o jurídicas interesadas en la prestación del servicio a que se refiere esta ordenanza presentarán en este Ayuntamiento solicitud detallada sobre el servicio interesado, lugar y fecha donde se tiene que llevar a cabo y demás detalles necesarios para determinar el servicio a prestar. Las otras actuaciones se harán por orden de la Alcaldía, Jefatura de la Policía Local o jefe de Brigada, señalando la persona o personas responsables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Disposición final.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente ordenanza entrará en vigor el día de su publicación íntegra en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares y empezará a aplicarse a partir de los 15 días posteriores a su publicación y permanecerá en vigor hasta su modificación o derogación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las tarifas se actualizarán anualmente con respecto a la subida experimentada por el IPC en este periodo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
