&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En el procedimiento de referencia se ha dictado la resolución del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;JDO. PRIMERA INSTANCIA N. 21 &lt;/strong&gt;&lt;strong&gt;PALMA DE MALLORCA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;SENTENCIA: 00119/2013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;SENTENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En Palma de Mallorca, a 15 de octubre de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Vistos por mí, Dª CRISTINA ESCRIBANO GONZÁLEZ, Magistrado-Juez del Juzgado de Primera Instancia nº 21 de los de Palma de Mallorca, los presentes autos de &lt;strong&gt;Juicio Ordinario nº 177/2012&lt;/strong&gt;, en materia de división de cosa común instados por Dª VANESA BENEJAM CEREZUELA, cuya representación se ejerce por el Procurador de los Tribunales, D. Juan Miguel Perelló Oliver, y su defensa por el Letrado, D. Andrés Buades, contra Dª CRISTINA BENEJAM CEREZUELA, en situación de rebeldía procesal, ha recaído sobre los mismos la presente resolución judicial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;FALLO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; ESTIMO íntegramente &lt;/strong&gt;la demanda formulada por el Procurador de los Tribunales, D. Juan Miguel Perelló Oliver, &amp;nbsp;en nombre y representación de Dª VANESA BENEJAM CEREZUELA, contra Dª CRISTINA BENEJAM CEREZUELA y en consecuencia, en consecuencia:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1) &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&lt;strong&gt;Debo DECLARAR Y DECLARO el cese de la situación de condominio&lt;/strong&gt; existente entre las partes sobre las fincas registrales, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;a. &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&lt;strong&gt; Nº &lt;/strong&gt;39.322 inscrita en el tomo 942 Libro 645 Folio 90 del Registro de la Propiedad nº 7 de Palma&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;b. &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; nº 35307 inscrita al tomo 3712, Libro 542 folio 142 del Registro de la Propiedad nº 2 de Palma l solar, inscrito en el Registro de la Propiedad de Calviá 1, al Tomo &amp;nbsp;2121, libro 665 folio 38 finca registral 23218.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2) &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;Y decreto la división de la cosa común y para ello &lt;strong&gt;que se proceda a la venta de dicha vivienda en pública subasta&lt;/strong&gt;, en ejecución de sentencia, con intervención de licitadores extraños y consiguiente reparto del precio obtenido entre los copropietarios, en proporción a sus cuotas., dado el carácter indivisible del objeto común, para el caso de que las partes no lleguen a un acuerdo en cuanto a su adjudicación a una de ellas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Todo ello con expresa imposición de las costas a la parte demandada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Líbrese testimonio de la presente resolución para unirlo a las actuaciones, incorporando el original al Libro de Sentencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; Notifíquese la presente resolución a las partes, haciéndoles sabe que contra la misma, cabe interponer Recurso de Apelación, ante este Juzgado, en el plazo máximo e improrrogable de VEINTE DÍAS días, en la forma que determina el artículo 458 de la Ley de Enjuiciamiento Civil. Hágase saber a las partes que &lt;strong&gt;no se admitirá a trámite&lt;/strong&gt; el recurso si la parte al tiempo de interponerlo, no acredita DOCUMENTALMENTE haber constituido el oportuno &lt;em&gt;&lt;u&gt;depósito para recurrir&lt;/u&gt;&lt;/em&gt; (D.A 15ª LOPJ), mediante la &lt;strong&gt;consignación del importe de&lt;/strong&gt; &lt;strong&gt;50 euros&lt;/strong&gt; en la cuenta de Depósitos y Consignaciones de este Juzgado haciendo constar dicho concepto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Así por esta mi sentencia, lo pronuncio mando y firmo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;PUBLICACIÓN.- La anterior Sentencia fue leída y publicada por la Sra. Magistrado Juez que la suscribe, estando celebrando Audiencia Pública, el día de la fecha; doy fe.”&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Y como consecuencia del ignorado paradero de CRISTINA BENEJAM CEREZUELA, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
