&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;Que en el procedimiento DESPIDO/CESES EN GENERAL Y CANTIDAD 615/2013 de este Juzgado de lo Social, seguido a instancia de Dª SVETLANA BORISOVA MUCHANOVA contra la empresa&amp;nbsp; PISPOLA, SLU sobre DESPIDO/CESES EN GENERAL Y CANTIDAD se ha dictado la siguiente resolución, cuya parte dispositiva se adjunta:&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;h2&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;SENTENCIA N° 397/2013&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/h2&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;En Palma de Mallorca a 31 de octubre de 2013&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;DOÑA CECILIA FERNÁNDEZ PRIETO, Juez de Refuerzo del &lt;u&gt;Juzgado de lo Social nº 3 de Palma de Mallorca&lt;/u&gt;, ha visto los presentes autos de &lt;strong&gt;PROCEDIMIENTO Nº 615/2013&lt;/strong&gt;, seguido entre partes, de una como actora &lt;strong&gt;DOÑA SVETLANA BORISOVA MUCHANOVA &lt;/strong&gt;asistida del Letrado Don Rafael Ramis y de otra como demandada &lt;strong&gt;LA PISTOLA 2012 S.L. &lt;/strong&gt;sobre&lt;strong&gt; RESOLUCIÓN CONTRACTUAL.&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 141.6pt"&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;u&gt;FALLO&lt;/u&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;u&gt;Que debo desestimar y desestimo&lt;/u&gt;&lt;/strong&gt; la acción de resolución contractual ejercitada por DOÑA SVETLANA BORISOVA MUCHANOVA frente a LA PISTOLA 2012 S.L., por carencia sobrevenida de acción.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;Que &lt;strong&gt;&lt;u&gt;estimando&lt;/u&gt;&lt;/strong&gt;&lt;u&gt; &lt;strong&gt;la demanda de reclamación de cantidad &lt;/strong&gt;&lt;/u&gt;interpuesta por DOÑA SVETLANA BORISOVA MUCHANOVA frente a la empresa LA PISTOLA 2012 S.L. &lt;strong&gt;debo condenar y condeno &lt;/strong&gt;a la empresa LA PISTOLA 2012 S.L. a abonar a la parte actora la cantidad de &lt;strong&gt;CUATRO MIL NOVECIENTOS NOVENTA Y NUEVE EUROS CON CUARENTA Y SEIS CÉNTIMOS DE EURO&lt;/strong&gt; &lt;strong&gt;(4.999,46 euros)&lt;/strong&gt; en concepto de salarios dejados de percibir, &lt;strong&gt;cantidad ésta que se incrementará en &lt;/strong&gt;&lt;strong&gt;1.493,63 euros&lt;/strong&gt;&lt;strong&gt; de indemnización por mora, &lt;/strong&gt;con imposición de las &lt;u&gt;costas &lt;/u&gt;devengadas en esta instancia a la parte demandada, en la forma establecida en el fundamento jurídico cuarto.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;Notifíquese esta&amp;nbsp; resolución&amp;nbsp; a las partes en la forma que previene la Ley, haciéndoles saber que contra la misma cabe interponer &lt;strong&gt;Recurso de Suplicación&lt;/strong&gt; ante &lt;strong&gt;la Sala de lo Social del Tribunal Superior de Justicia de las Islas Baleares, &lt;/strong&gt;anunciándolo ante este Juzgado por comparecencia o por escrito en el plazo de los &lt;strong&gt;cinco días hábiles siguientes a la notificación del presente fallo,&lt;/strong&gt; siendo indispensable que al tiempo de anunciarlo acredite la parte que no ostente el carácter de trabajador y no goce del beneficio de justicia gratuita, haber consignado el importe íntegro de la condena en el banco BANESTO, en la cuenta de este Juzgado o presentar aval solidario de Entidad Financiera por el mismo importe. Así mismo deberá constituir otro depósito por importe de 300 € en el referido banco, presentando el resguardo correspondiente a éste último depósito en la Secretaria del Juzgado al tiempo de interponer el Recurso y&amp;nbsp; el del primer depósito al momento de anunciarlo, sin cuyos&amp;nbsp; requisitos no podrá ser admitido.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;De no anunciarse el recurso contra la presente, firme que sea, procédase al archivo de las actuaciones, previa baja en el libro correspondiente.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;Así, por ésta mi sentencia, definitivamente juzgada en primera instancia lo pronuncio, mando y firmo.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&lt;strong&gt;DILIGENCIA DE PUBLICACIÓN Y DEPÓSITO.-&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;La anterior fue hecho pública por la Ilma. Sra. Juez que la suscribe, en el día de la fecha durante las horas de audiencia mediante depósito en esta Secretaría a mi cargo, emitiendo, seguidamente, certificación de la misma para su unión a los Autos, y archivando el original de la sentencia en el libro correspondiente. Doy fe.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;Y para que sirva de notificación en legal forma a la entidad demandada LA PISPOLA, SLU, en ignorado paradero, expido la presente para su inserción en el Boletín Oficial de la Provincia de ILLES BALEARS.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;Se advierte al destinatario que las siguientes comunicaciones se harán fijando copia de la resolución o de la cédula en el tablón de anuncios de la Oficina judicial, salvo el supuesto de la comunicación de las resoluciones que deban revestir forma de auto o sentencia, o cuando se trate de emplazamiento.&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
