    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Comisión Insular de Ordenación del Territorio y Urbanismo en sesión celebrada el día 29 de noviembre de 2013, adoptó, entre otros, el siguiente acuerdo:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;“Visto el expediente relativo al Catálogo de protección del patrimonio histórico del término municipal de Consell, y de acuerdo con el dictamen de la Ponencia Técnica de Ordenación del Territorio y Urbanismo, en el trámite previsto en el artículo 132.3 del Real decreto 2159/1978, de 23 de junio, por el cual se aprueba el Reglamento de Planeamiento Urbanístico, esta Comisión Insular acuerda aprobar definitivamente el citado instrumento con sujeción a las prescripciones:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los elementos incluidos en las fichas U-47-B y SR-7 pasan a tener el grado de protección B.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El tramo de acera de Can Fred, en el número 23 de la calle Muntanya, queda incluido en la Ficha U-72 con el mismo grado de protección que el inmueble con el que linda.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Asimismo se hacen públicas las normas urbanísticas&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 1. Niveles de protección del Catálogo.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los niveles de protección del Catálogo se han regulado de acuerdo a lo siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los niveles de protección del Catálogo se han regulado de acuerdo a lo siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1-Nivel de protección integral A&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se refiere a aquellos edificios, partes de edificios, construcciones, monumentos o esculturas, yacimientos arqueológicos, elementos etnológicos o obras de ingeniería y bienes de interés paisajístico o ambiental calificables de singulares por sus valores históricos, arquitectónicos, estéticos, tipológicos, paisajísticos o ambientales, así como a los elementos o edificios incoados o declarados Bien de Interés Cultural (BIC). La preservación de los elementos objeto de esta protección debe ser integral o total.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2-Nivel de protección parcial B&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se refiere a aquellos edificios, partes de edificios, construcciones, monumentos o esculturas, elementos etnológicos o obras de ingeniería y bienes de interés paisajístico o ambiental que presentan valores históricos, arquitectónicos, estéticos, tipológicos, paisajísticos o ambientales singulares pero considerados de menor grado respecto a los de la categoría anterior. Su conservación admitirá posibles obras de intervención compatibles con la protección específica de las características básicas o esenciales volumétricas, estructurales, tipológicas, estéticas, paisajísticas y ambientales.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3-Nivel de protección ambiental C&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se refiere a aquellos edificios, partes de edificios, construcciones, elementos etnológicos o obras de ingeniería y bienes de interés paisajístico o ambiental y demás elementos que sin presentar singularidades históricas, arquitectónicas o estéticas merecen su preservación, fundamentalmente, por su valor tipológico, paisajístico y ambiental. Su conservación admitirá intervenciones de mayor alcance que las del grado de protección anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Concretamente quedan englobadas en este nivel las remodelaciones que afectan a la totalidad del espacio interior de las edificaciones, manteniendo las protecciones de fachada y la volumetría existente en la crujía correspondiente a ésta, a fin de que su protección sea realmente efectiva, todo de acuerdo a la propuesta de cada ficha individualizada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En los casos expresamente indicados en cada una de las fichas individualizadas la protección ambiental C se extiende a las fachadas o a la volumetría correspondiente a la segunda crujía de las edificaciones, a las edificaciones auxiliares, a otros elementos como cisternas o hornos y / o a los espacios exteriores tales como espacios empedrados, jardines o muros de cierre.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 2. Tipo de obras e intervenciones.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A los efectos de este Catálogo, sus elementos y su aplicación, los tipos de obras se dividirán en las siguientes categorías:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1 Conservación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Son obras para el mantenimiento de todos los elementos de los edificios, construcciones, esculturas o monumentos y elementos etnológicos u obras de ingeniería en perfecto estado con el fin de prolongar la vida de los bienes con todos sus valores, asegurando la estabilidad del bien y de sus partes integrantes, mediante la conservación preventiva, evitando el deterioro, o frenar este mediante trabajos de estabilización. Se consideran dentro de esta categoría:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Las reparaciones de todos los elementos e instalaciones constituyentes de los edificios que se encuentren en mal estado (cubiertas, cornisas, canales y bajantes, instalaciones sanitarias, pavimentos, acabados, pinturas, etc.).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Las actuaciones relacionadas con el desbroce de la vegetación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los bienes de interés cultural, bienes catalogados y yacimientos arqueológicos las obras de conservación estarán a lo dispuesto en la Ley 12/1998, de 21 de diciembre, del Patrimonio Histórico de las Illes Balears y, si procede, a lo dispuesto en el Decreto 14/2011, de 25 de febrero, por el que se aprueba el Reglamento de intervenciones arqueológicas y paleontológicas de las Islas Baleares o normativa que los sustituya.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los bienes de interés ambiental y paisajístico las obras de conservación son aquellas que tienen por objeto el mantenimiento de las condiciones originales tanto de los elementos constitutivos del bien como de sus interrelaciones de manera que no se produzca una degradación de los valores que han motivado su protección.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2 Restauración.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Son aquellas cuya finalidad es la de volver al edificio -total o parcialmente-, una escultura o monumento, a un elemento etnológico u obra de ingeniería, sus características originales, tanto en sus estructuras, como en sus acabados y decoración, de tal manera que el proceso sea reconocible y no admitiendo su en el proceso nuevas aportaciones de nuevo diseño. Comporta la utilización, en la medida que sea compatible con la normativa actual, de los sistemas constructivos y materiales originales. Este tipo de obras incluye la eliminación de añadidos de edificaciones o elementos constructivos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los bienes de interés cultural, bienes catalogados y yacimientos arqueológicos o paleontológicos las obras de restauración estarán a lo dispuesto en la Ley 12/1998, de 21 de diciembre, del Patrimonio Histórico de las Illes Balears y, si procede, a lo dispuesto&amp;nbsp; en el Decreto 14 / 2011, de 25 de febrero, por el que se aprueba el Reglamento de intervenciones arqueológicas y paleontológicas de las Islas Baleares o normativa que los sustituya.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los bienes de interés ambiental y paisajístico las obras de restauración son aquellas que tienen por objeto la reparación o la sustitución de aquellos elementos constitutivos del bien, que ya sea por desuso o por la realización de intervenciones con resultado discordante, supongan una degradación de los valores del conjunto en el que se integran.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3 Consolidación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Son las encaminadas a mantener las condiciones de resistencia y estabilidad de los elementos o de sus estructuras mediante su reforzamiento, reparación o sustitución parcial. A los efectos de los materiales, también se entiende que son encaminadas a volver a dar la cohesión y consistencia de éstos. Las intervenciones no implicarán, en ningún caso, la alteración del aspecto estético.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los bienes de interés cultural, bienes catalogados y yacimientos arqueológicos o paleontológicos las obras de consolidación estarán a lo dispuesto en la Ley 12/1998, de 21 de diciembre, del Patrimonio Histórico de las Illes Balears y, si procede, a lo dispuesto en el Decreto 14 / 2011, de 25 de febrero, por el que se aprueba el Reglamento de intervenciones arqueológicas y paleontológicas de las Islas Baleares o normativa que los sustituya.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4 Rehabilitación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tienen como objetivo la adecuación, la mejora de condiciones de habitabilidad, o la redistribución del espacio interior, manteniendo las características estructurales del edificio y los aspectos fundamentales de su tipología. Este tipo de obras podrá suponer la adecuación de los usos de los porches bajo cubiertas actuales, modificación de los patios interiores o de las aberturas que no sean de fachada, y la apertura de patios interiores y huecos de escaleras que no afecten a la estructura portante de los elementos. No podrá aumentarse la volumetría del edificio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los elementos etnológicos u obras de ingeniería las obras de rehabilitación también pueden tener como objetivo la recuperación de la funcionalidad de estos elementos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los bienes de interés ambiental y paisajístico las obras de rehabilitación son aquellas que tienen por objeto la mejora de los elementos constitutivos del bien o de sus interrelaciones de manera que aumenten los valores del conjunto en el que se integran. Son ejemplos de estas obras las actuaciones de repoblación o la construcción de paredes secas y bancales en los espacios naturales o la eliminación del cableado extendido a las fachadas de los conjuntos urbanos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5 Reestructuración.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Son las obras que tienen como objetivo la transformación del espacio interior del edificio, incluyendo la posibilidad de demolición o de sustitución parcial de los elementos estructurales manteniendo las fachadas, donde únicamente se podrán introducir nuevos huecos siempre que sigan los ritmos compositivos y la tipología de las aberturas existentes. La calificación urbanística del entorno será subsidiaria y se permitirán obras de ampliación de acuerdo con sus parámetros siempre que no se escondan o enmascaren con ellas los cuerpos de edificación protegidos y no se adosen a sus fachadas representativas y , en todo caso, siempre que se ajusten a la sistemática tipológica. El caso extremo de este tipo de obra será el vaciado del edificio, entendiendo por tal, la demolición interior generalizada con el mantenimiento de la fachada o fachadas exteriores y sus remates y la cubierta que en caso de sustitución será exactamente en las mismas condiciones que el original.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso concreto de los elementos etnológicos u obras de ingeniería se entienden como obras de reestructuración las que tienen como resultado el cambio de ubicación del elemento. Un ejemplo es la reconstrucción de los muros que limitan con carretera o camino, la cual deberá realizarse con los materiales y técnicas originales, en la medida en que sea posible. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6 Ampliación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Son obras de incremento de la superficie edificada o del volumen o altura existentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7 Demolición.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tienen por objetivo la supresión total o parcial de un edificio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 3. Intervenciones permitidas según categoría de protección.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1 Nivel de Protección Integral A&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se permitirán obras de conservación, restauración y consolidación.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2 Nivel de Protección Parcial B&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se permitirán obras de conservación, restauración, consolidación, y rehabilitación.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3 Nivel de Protección Ambiental C&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se permitirán obras de conservación, restauración, consolidación, rehabilitación, reestructuración y ampliación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 4. Régimen especial para obras de demolición.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1 En el ámbito de cualquier elemento del Catálogo no se concederán licencias para realizar exclusivamente obras de demolición.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2 En todo caso la licencia de obras o la orden de ejecución contemplará tanto las operaciones de demolición como las de otra naturaleza y el resultado final de la actuación sobre el inmueble o parcela. La licencia de este conjunto de operaciones se concederá en una unidad de acto.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3 Los edificios, elementos, instalaciones o conjuntos catalogados no podrán ser demolidos, salvo aquellas partes de su estructura o elementos que sea permitido, según los grados y categoría de catalogación del edificio, y siempre que dichas obras resulten imprescindibles para su máxima garantía de estabilidad y seguridad. La demolición requerirá la elaboración de un informe que argumente su necesidad.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4 La demolición no autorizada o la provocación de ruina por abandono o negligencia de un edificio catalogado, comportará la obligación de su reconstrucción en las condiciones señaladas en la Ley 12/1998, del Patrimonio Histórico de las Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 5. Intervenciones preferentes y admisibles.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1 En cada ficha particularizada de los elementos catalogados se establecen, en su caso, las intervenciones preferentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2 Se consideran intervenciones admisibles todas las permitidas según la categoría de protección.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3 Las intervenciones admisibles que afecten con carácter global o en su mayor parte del elemento catalogado deberán comportar simultáneamente la ejecución de las intervenciones preferentes establecidas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 6. Zona de protección.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1 Para algunos elementos catalogados se determina una zona de protección, ya sea dirigida a la preservación de visuales o de la propia integridad del elemento catalogado. Cada ficha particularizada determinará detalladamente las limitaciones que en el ámbito de la zona de protección se establecen en la construcción de edificaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2 Para obtener licencia para la construcción de cualquier edificación en este ámbito se deberá aportar un estudio justificativo del cumplimiento de las determinaciones establecidas en la ficha de catálogo correspondiente.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3 Serán objeto de preservación los elementos de interés patrimonial localizados dentro de la zona de protección, tales como&amp;nbsp; pozos, espacios empedrados, muros, etc.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 7. Documentos complementarios para la solicitud de las licencias en elementos catalogados.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Para realizar obras en elementos situados en los ámbitos catalogados, además de la documentación genérica prevista para los proyectos de obras, se deberán aportar los siguientes documentos:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Justificación de la integración en el entorno con el plano de fachadas de los edificios contiguos, a escala 1:100.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Documentación fotográfica exhaustiva del tramo de calle o del conjunto en el que se pueda enmarcar la actuación, debiéndose sustituir dicha documentación fotográfica por un levantamiento planimétrico del estado actual de las fachadas del tramo de la calle o del conjunto en que se enmarque, en los casos en que su anchura imposibilite una visión completa y verídica de las edificaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) Descripción de los materiales utilizados, señalando su idoneidad respecto al entorno urbano.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) Documentación gráfica conteniendo las tomas de los servicios con sus dimensiones y situación exacta.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;e) En caso de que se trate de obras parciales de reforma, croquis de detalle de los elementos singulares, tales como balcones, patios interiores, ventanas, pavimentación, etc., indicando en todos ellos los materiales utilizados. Tanto la documentación del estado inicial como la del estado final serán las suficientes para la definición del proyecto.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;f) Cuando haya obras de demolición deberá quedar patente y claro su alcance y la zona afectada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 8. Yacimientos arqueológicos.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Cualquier actuación a realizar dentro de un área catalogada como yacimiento arqueológico o de su zona de protección deberá contar con un estudio específico elaborado por técnico competente que asegure la no afectación del yacimiento así como la preservación de las principales visuales sobre el mismo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Este estudio identificará los efectos de la actuación sobre el yacimiento arqueológico, incorporará las medidas protectoras o correctoras y establecerá el programa de vigilancia de la ejecución de la actuación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Cualquier actuación en el interior de un área catalogada como yacimiento arqueológico o de su zona de protección deberá contar con la autorización del órgano competente en materia de patrimonio histórico, previo al otorgamiento de la licencia municipal de edificación y uso del suelo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. El Ayuntamiento deberá elaborar un plan especial de protección o un instrumento urbanístico de protección, o adecuar uno vigente, para los ámbitos afectados por la declaración de bien de interés cultural con la categoría de zona arqueológica.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 9. Zona de protección de la iglesia parroquial&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Se establece una zona de protección de la iglesia parroquial de Nuestra Señora de la Visitación que incluye el ámbito formado por los tramos de calle que rodean el edificio, correspondientes a la Plaza Mayor, la calle Vila de Sureda y la calle Joan Bestard.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Las intervenciones que se realicen en esta zona deberan integrarse en el conjunto ambiental formado por la iglesia, la rectoría i Ca sa Metgessa. El volumen, la tipología, la morfología y el cromatismo de las intervenciones no podrán alterar el carácter arquitectónico y paisajístico del área ni perturbar la visualización del conjunto.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 10. Obligaciones de conservación genérica de las edificaciones.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. En cumplimiento de la legislación vigente no se entenderán adquiridos los derechos urbanísticos en tanto no se cumplan los deberes correspondientes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Los propietarios de toda clase de terrenos y construcciones deberán destinarlos efectivamente al uso en cada caso establecido por el planeamiento urbanístico y mantenerlos en condiciones de seguridad, salubridad y ornato público. Quedarán sujetos igualmente al cumplimiento de las normas sobre protección del medio ambiente y del patrimonio histórico y sobre rehabilitación urbana, en cumplimiento de lo establecido en la legislación vigente, referido a los deberes de conservación y rehabilitación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. En cumplimiento de lo dispuesto en la legislación urbanística vigente, el ayuntamiento ordenará, de oficio o a instancia de cualquier interesado, la ejecución de las obras necesarias para conservar aquellas condiciones, con indicación del plazo de realización.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. El Ayuntamiento podrá también ordenar, por motivos de interés turístico, estético o cultural, la ejecución de obras de conservación y de reforma en fachadas o espacios visibles desde la vía pública, sin que estén previamente incluidas en ningún plan de ordenación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Las obras se ejecutarán a costa de los propietarios, si se contuvieran en el límite del deber de conservación que les corresponde, y con cargo a fondos de la administración ordenante cuando lo exceda para obtener mejoras de interés general.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. Se entenderán como obras contenidas dentro del límite del deber de conservación que corresponde a los propietarios y a su costa todas las incluidas en las presentes normas de protección del patrimonio histórico, sin perjuicio de lo indicado en la legislación del suelo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. En virtud de la legislación urbanística vigente en relación a los deberes de conservación y rehabilitación, el Ayuntamiento podrá utilizar la ejecución forzosa cuando los propietarios incumplan dichos deberes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 11. Obligaciones de conservación específica del patrimonio catalogado.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La conservación, protección y custodia de los elementos incluidos en el presente Catálogo se declara de utilidad pública. Corresponde el deber de su conservación a sus respectivos propietarios o poseedores, de acuerdo a la regulación vigente en materia de patrimonio histórico.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. En caso de que los propietarios de los elementos incluidos en el presente Catálogo no realizaran las obras de conservación requeridas por las presentes normas de protección del patrimonio histórico, se podrá realizar por parte del ayuntamiento la ejecución subsidiaria o se podrá expropiar total o parcialmente el edificio o sólo su fachada, de acuerdo a la regulación vigente en materia de patrimonio histórico.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Los elementos incluidos en el presente Catálogo, cuando el propietario hiciese uso indebido de ellos, estuvieran en peligro de destrucción o deterioro y no estuviesen debidamente atendidos, se podrán expropiar con carácter sancionador y por razón de utilidad pública, de acuerdo a la regulación vigente en materia de patrimonio histórico.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. La obligación de conservar los elementos catalogados, así como la de realizar las intervenciones de acuerdo con las determinaciones específicas que se indiquen no supone en ningún caso una situación de vinculación singular, ni que la ejecución de las obras supere el límite del deber de conservación del propietario.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. En ningún caso el uso de los bienes catalogados podrá alterar ni desmerecer las características fundamentales que motivaron la protección del elemento, perjudicar su conservación o entrañar riesgo de degradación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 12. Higiene y habilidad.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En las actuaciones en los edificios incluidos en el Catálogo no es de obligado cumplimiento la ordenanza general de higiene y composición interior, en cuanto a superficies de iluminación, dimensiones y ventilación de las escaleras, etc., si las obras tienen por objeto respetar la tipología del edificio, siempre que queden aseguradas las condiciones mínimas de salubridad e higiene, reguladas en el Decreto 145/1997, de 21 de noviembre, de condiciones de dimensionamiento, de higiene y de instalaciones para el diseño habitabilidad de viviendas, así como la expedición de cédulas de habitabilidad (BOCAIB núm. 151, de 06.12.1997) o norma que lo sustituya o modifique, y las obras supongan una mejora de las condiciones actuales de higiene y composición interior del edificio a intervenir.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Norma 13. Modificaciones del catálogo.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. El Catálogo será susceptible de ser modificado por inclusiones o exclusiones de bienes catalogados, por alteración del nivel de protección, o por modificaciones del contenido de las fichas individualizadas, de acuerdo con lo dispuesto en la legislación vigente.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Las modificaciones del Catálogo, por inclusiones o exclusiones de elementos, se incoarán de oficio o a instancia de parte, en expediente que se tramitará al efecto de acuerdo con el procedimiento establecido para el patrimonio catalogado.&lt;/span&gt;&lt;/p&gt;

Ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa&lt;/span&gt;&lt;/p&gt;
