    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Intentados sin efecto las notificaciones por correo certificado con acuse de recibo, y dado que no han podido practicarse por ignorarse el domicilio o no haber sido localizadas las personas interesadas que se relacionan, se procede, en cumplimiento de lo que establece el artículo 59.5 de la Ley 30/1992 de 26 de noviembre, de Régimen Jurídico de las Administraciones Publicas y del procedimiento Administrativo Común – BOE de 27 de Noviembre-, a la publicación en el Boletín Oficial de las Islas Baleares del siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“&lt;span&gt;&lt;strong&gt;DECRETO:&lt;/strong&gt;&lt;/span&gt;&lt;span&gt; Dado que los vehículos que se relacionan a continuación, fueron retirados de la vía publica y han estado durante más de dos meses en el depósito municipal de vehículos de la policía local, sin que hayan sido subsanadas las deficiencias que motivaron su depósito, o sin que por parte de su titular se haya realizado gestión alguna para su retirada&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Dado que, de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990 de 2 de marzo (texto articular de la Ley sobre Tráfico, Circulación de Vehículos a moto y Seguridad Vial), que ha introducido la Ley 18/2009, de 23 de noviembre, la Administración competente en materia de gestión de tráfico podrá ordenar el traslado del vehículo a un centro autorizado de tratamiento de vehículos para su posterior destrucción y descontaminación en los siguientes casos: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;a) Cuando hayan transcurrido más de dos meses desde que el vehículo fuera inmovilizado o retirado de la vía pública y depositado por la Administración y su titular no haya formulado alegaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;b) Cuando esté estacionado por un período superior a un mes en el mismo lugar y presente desperfectos que hagan imposible el desplazamiento por sus propios medios o le falten las placas de matrícula. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;c) Cuando, recogido un vehículo como consecuencia de avería o accidente, en un recinto privado, su titular no la haya retirado en el plazo de dos meses. &amp;quot; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Dado que, según establece el artículo 3 º B de la Ley 10/1998 de 21 de abril, de Residuos, los vehículos abandonados se entiende que son residuos urbanos, y que el artículo 4.3 de la misma Ley otorga competencias a las entidades locales para la gestión de estos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Por todo ello, a la vista de los antecedentes mencionados, por el presente y en virtud de las facultades que me confiere la legislación vigente, RESUELVO: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;1. Requerir a las personas titulares de los vehículos, con anterioridad a la orden de traslado al Centro Autorizado de Tratamiento de vehículos, a fin de que procedan a la retirada del vehículo en el plazo de un mes, de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990, de 2 de marzo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Si en plazo de un mes no se procede a la retirada del vehículo o no se reciben noticias de la persona titular, se procederá a su tratamiento como residuo sólido urbano, con las siguientes consecuencias: el traslado a un Centro autorizado de tratamiento para su posterior destrucción y descontaminación, la baja de oficio del vehículo en el Registro de la Dirección General de Tráfico y la incoación del oportuno expediente sancionador, en base al artículo 34.3b de la Ley 10/1198, de 21 de abril, de residuos, con una sanción de entre 601,01 euros y 30.050,60 euros. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;2. Notificar este decreto a las personas titulares de los vehículos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Se informa que se procede a la renuncia expresa de la titularidad del vehículo a favor del Ayuntamiento no se incoará el correspondiente expediente sancionador y se entenderá la participación del poseedor según dispone el artículo 11 de la Ley 10/98 de residuos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span&gt;Se podrá formular la renuncia del vehículo, previo pago de los gastos ocasionados en el Depósito municipal (Avda. Portmany, 17, 07820 Sant Antoni de Portmany. Tel. 971340830, fax 971347526), o bien presentar escrito de alegaciones en el Registro General del Ayuntamiento de Sant Antoni de Portmany, con indicación de los datos personales, número de expediente y matrícula del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
