    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Resultando el intento de notificación sin éxito al Sr. ENNING, HANS JURGEN en repetidas ocasiones, del Decreto de Alcaldía núm. 1433/2013 en cuanto a la incoación del expediente núm. 000069/2013-MEDAMBSANCIO.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y resultando lo que dispone el artículo 59 de la Ley 30/1992, de 26 de noviembre, Ley de régimen jurídico de las Administraciones Públicas y el Procedimiento Administrativo común. (LRJAP- PAC), se hace público su contenido por un plazo de 20 días a los efectos que la Ley establece.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Antoni Servera Servera , Alcalde Presidente del Ayuntamiento de Son Servera ( Islas Baleares).&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Dada la denuncia interpuesta por la Unidad de Medio Ambiente de la Policía Local de Son Servera en fecha 7 de octubre de 2013 contra el Sr. Hans Jurgen Enning, por no adoptar las medidas necesarias para que su perro Benni no pueda acceder libremente sin ser conducido a las vías y espacios libres públicos o propiedades privadas, o a las personas que circulan, hechos ocurridos en la Carretera Son Servera-Costa de los Pinos (MA- 4032), km. 2&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Visto el informe emitido por la técnica de Medio Ambiente, Juana A. Cardell Vich en fecha 7 de noviembre de 2013, el cual propone el inicio del expediente sancionador 000069/2013-MEDAMBSANCIO.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Y de conformidad con el Decreto 14/1994 de 10 de febrero, por el que se aprueba el Reglamento del Procedimiento a seguir en el ejercicio de la potestad sancionadora&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Resuelvo,&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Primero.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Iniciar el expediente sancionador contra el Sr. ENNING, HANS JURGEN con DNI EX- X1712923K, por no adoptar las medidas necesarias para que su perro Benni no pueda acceder libremente sin ser conducido a las vías y espacios libres públicos o propiedades privadas, o a las personas que circulan que tiene la consideración de infracción administrativa leve de acuerdo con el artículo 91.1.h del Decreto 56 /1994, de 13 de mayo, por el que se aprueba el reglamento para el desarrollo y aplicación de la Ley 1 /1992, de protección de los animales que viven en el entorno humano, correspondiéndole una sanción entre 60,10 € y&amp;nbsp; 300,50 €.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Segundo.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Percibir que se impondrá al Sr. ENNING HANS JURGEN, una sanción de 60,10 €, que es la cuantía mínima que establece el artículo 92.1 del mencionado Decreto .&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Tercero.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Conceder al interesado, de conformidad con el artículo 8.4 del Decreto 14 /1994, de 10 de febrero, mediante el cual se aprueba el reglamento para el ejercicio de la potestad sancionadora, un plazo de quince días para formular alegaciones, presentar documentos y presentar prueba, concretando los medios de que pretendan valerse.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Cuarto.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Advertir a los interesados que, de no efectuar alegaciones sobre el contenido del acuerdo de iniciación en el plazo previsto, la iniciación podrá ser considerada propuesta de resolución.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Quinto.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Indicar a los interesados que pueden reconocer voluntariamente su responsabilidad y, si procede, efectuar el pago de la sanción pecuniaria que corresponda en cualquier momento anterior a la resolución.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Sexto.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Designar como instructora del procedimiento a Juana A. Cardell Vich y como secretaria a Pilar Sánchez Barceló, técnica de Medio Ambiente y auxiliar administrativa del Ayuntamiento de Son Servera, respectivamente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Séptimo.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Comunicar el presente acuerdo de iniciación a la instructora y a la secretaria, con traslado de todas las actuaciones que existen sobre este expediente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;Octavo.&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Notificar el presente acuerdo al interesado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Antoni Servera Servera &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Antoni Gual Sureda&amp;quot;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra esta resolución que agota la vía administrativa se pueden interponer, alternativamente, los recursos siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a . - Directamente el recurso contencioso administrativo ante el Tribunal que resulte competente, en el plazo de dos meses, contados a partir del día siguiente de la notificación del presente decreto.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b . - El recurso de reposición potestativo ante el órgano que ha dictado esta resolución, en el plazo de un mes, contado a partir del día siguiente de la notificación de la presente resolución.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No obstante lo anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la ley 29/1998 de 13 de julio, reguladora de la jurisdicción y de la ley 4/1999 de 13 de enero, de modificación de la ley 30/1992, de 26 de noviembre, de régimen de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
