    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Que en este JDO. DE LO SOCIAL N. 4 se tramita &amp;nbsp;EJECUCION 0000253 /2009, a instancia de DAVID VAZQUEZ GORDILLO, contra JOSE ANTONIO LOPEZ BERMUDEZ(76.331.913L), en el que por resolución de esta fecha se ha acordado sacar a pública subasta, &amp;nbsp;que más abajo se dirán, señalándose para que tenga lugar en &amp;nbsp;el próximo día &lt;b&gt;DIEZ DE DICIEMBRE DE 2013 &amp;nbsp;a las 10:00&lt;/b&gt; , con las condiciones siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;PRIMERO.- &lt;/b&gt;Que los licitadores, a excepción del ejecutante, para tomar parte en la subasta, deberán presentar resguardo acreditativo de haber depositado en la cuenta de depósitos y consignaciones de este tribunal, o de haber prestado aval bancario, por el 20 por 100 del valor de tasación de los bienes objeto de la subasta, haciendo constar, en su caso, si se hace en nombre de tercero. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: left"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;SEGUNDO.- &lt;/b&gt;Que podrán hacerse posturas por escrito en sobre cerrado, desde el anuncio de la subasta hasta su celebración haciéndose el depósito al que se ha hecho mención anteriormente. &lt;/span&gt;&lt;/span&gt;&lt;br /&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;TERCERO.- &lt;/b&gt;Que podrá hacerse posturas superiores al 50 por 100 del avalúo, pero ofreciendo pagar a plazos con garantías suficientes, bancarias o hipotecarias, del precio del remate. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;CUARTO.- &lt;/b&gt;Que no se podrá proceder a la inmediata aprobación del remate si la cantidad ofrecida no superare el 50 por 100 del valor de tasación, o siendo inferior, no cubriere, al menos la cantidad por la que se ha despachado ejecución, incluyendo la previsión para intereses y costas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;QUINTO.- &lt;/b&gt;Que únicamente el ejecutante o de los responsables legales solidarios o subsidiarios podrán concurrir reservándose la facultad de ceder el remate a un tercero, pudiendo tomar parte en la subasta, sólo cuando existan licitadores, mejorando las posturas que se hicieren. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;SEXTO.- &lt;/b&gt;En caso de que la subasta quede desierta, sólo el ejecutante o en su defecto, los responsables legales solidarios o subsidiarios, el derecho a adjudicarse el bien por el 30 por ciento del avalúo del bien&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;SÉPTIMO.&lt;/b&gt;-&lt;b&gt; &lt;/b&gt;Para el supuesto en que la notificación del señalamiento al ejecutado resultare negativa por encontrarse en ignorado paradero, sirva el presente de notificación edictal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;b&gt;BIENES QUE SE SACAN A SUBASTA Y VALOR: &amp;nbsp;50% DEL &amp;nbsp;VEHÍCULO MARCA VOLKSWAGEN, MODELO PASSAT – MATRÍCULA 4844FFC) . &lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El valor del vehículo es 2.990€ y al sacarse únicamente el &lt;b&gt;50%&lt;/b&gt; del mismo el &lt;b&gt;valor resultante a efectos de subasta es el importe de 1.495€. &lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
