    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se hace público que el Consejo Ejecutivo del Consejo Insular de Menorca, en sesión ordinaria de día 4 de Noviembre de 2013, adoptó, entre otros, el siguiente acuerdo :&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span lang="es-ES"&gt;&lt;b&gt;PRIMERO.-&lt;/b&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt; Aprobar las bases que rigen la concesión de ayudas del CIM a las cooperativas agrarias de primer grado de Menorca para campañas de promoción y divulgación durante 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;&lt;span lang="es-ES"&gt;&lt;b&gt;SEGUNDO.- &lt;/b&gt;&lt;/span&gt;&lt;span lang="es-ES"&gt;Aprobar, simultáneamente, la convocatoria correspondiente al año 2013, que se regirá por las bases a que se ha hecho referencia en el punto anterior, de acuerdo con las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) Importe global máximo de las ayudas y crédito presupuestario. Las ayudas concedidas se atenderán con cargo a las partidas presupuestarias y con los importes máximos que se indican más abajo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El importe máximo que se destina a la convocatoria únicamente podrá ampliarse en el supuesto de aportaciones expresas de terceros para contribuir a la financiación del objeto de la convocatoria que se hayan concretado posteriormente a su aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) El plazo de presentación de solicitudes es de 7 días naturales contados a partir del día siguiente a la fecha en que esta convocatoria aparezca publicada en el Boletín Oficial de las Islas Baleares (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) El instructor de este expediente es el señor José María Mir Orfila, y el responsable de hacer el seguimiento del expediente es el señor Salvador Florit Orfila, técnicos del Departamento de Economía, Medio Ambiente y Caza del Consejo Insular de Menorca.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;BASES QUE RIGEN LA CONVOCATORIA DE LAS AYUDAS DEL CONSEJO INSULAR DE MENORCA A LAS COOPERATIVAS AGRARIAS DE PRIMER GRADO DE MENORCA PARA CAMPAÑAS DE PROMOCIÓN Y DIVULGACIÓN DE LOS PRODUCTOS AGROALIMENTARIOS 2013&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. OBJETO&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El objeto de esta ayuda es incrementar el conocimiento y mejorar la percepción de los productos agro-alimentarios comercializados por las cooperativas agrarias de primer grado de Menorca. Este objetivo se llevará a cabo mediante campañas de divulgación y valoración realizadas por las cooperativas agrarias desde día 1 de enero a 15 de noviembre de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Estas ayudas se concederán de acuerdo con el Reglamento comunitario número 1998/2006 de la Comisión, de 15 de diciembre, de aplicación de los artículos 87 y 88 del Tratado a las ayudas de minimis publicado en el Diario Oficial de la Unión Europea de 28 de Diciembre de 2006.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. FINALIDAD&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Con esta línea se pretende mejorar el conocimiento y la valoración de los productos agro-alimentarios comercializados por las cooperativas agrarias de primer grado de Menorca. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. FINANCIACIÓN E IMPORTE MÁXIMO&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Las ayudas que se otorguen en el marco de estas bases se harán con cargo a las partidas y por el importe máximo que se establezcan en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Cuando el importe total de las solicitudes con derecho a ayuda, después de aplicar los criterios del punto 8, supere el límite de la convocatoria, se reducirán las ayudas de manera proporcional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. ACTIVIDADES SUBVENCIONADAS Y REQUISITOS DE LA ACTIVIDAD &lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Son actividades subvencionables aquellas que mediante las cuales se incremente el conocimiento y se mejore la percepción de los productos agro-alimentarios comercializados por las cooperativas agrarias de primer grado de Menorca, y en particular las siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Organización y participación en ferias, congresos, seminarios, jornadas técnicas, eventos y actividades similares de relaciones públicas, de ámbito nacional e internacional.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) Rotulación de camiones, furgonetas o vehículos.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) Vallas publicitarias, opi o cualquier tipo de cartel en la vía pública.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) Creación de nuevas marcas, diseños y campañas de divulgación.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;e) Realización de campañas de promoción de productos comercializados por las cooperativas de Menorca (los gastos de las agencias de publicidad y otros proveedores de servicios que participan en la elaboración y en la aplicación de campañas de promoción, así como prensa, televisión y radio).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;f) La realización de degustaciones en comercios, tiendas y otros espacios para la mejora del conocimiento de los productos comercializados por las cooperativas de Menorca.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;g) La realización de degustaciones en supermercados, hipermercados y grandes superficies para la mejora del conocimiento de los productos comercializados por las cooperativas de Menorca.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;h) La realización de campañas de consumo o jornadas gastronómicas de productos comerciales en el sector de la restauración (bares y restaurantes)&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;i) La presencia en recintos feriales de carácter alimentario, tanto insular como nacional.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;j) La realización de campañas de promoción de productos agroalimentarios y degustaciones en mercados municipales de la isla de Menorca.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Cuando el importe del gasto subvencionable supere la cuantía de 12.000€, en caso de suministro de bienes de equipo o prestación de servicios por empresas de consultoría o asistencia técnica, el beneficiario deberá solicitar como mínimo tres ofertas de proveedores diferentes, con carácter previo a la contratación del compromiso para la prestación del servicio o la entrega del bien, salvo que por las especiales características de los gastos subvencionables no exista en el mercado un número suficiente de entidades que lo suministren o presten servicio, o que el gasto se hubiera realizado antes de solicitar la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;La elección entre las ofertas presentadas, que deberán aportarse en la justificación o, en su caso, en la solicitud de subvención, se realizará siguiendo criterios de eficiencia y economía, y se ha de justificar expresamente en una memoria cuando no recaiga en la propuesta económica más ventajosa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. RÉGIMEN DE CONTABILIDAD CON OTRAS AYUDAS&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Las ayudas que se otorguen de conformidad con estas bases son compatibles con la concesión de otras ayudas, sin perjuicio de la obligación de los beneficiarios de comunicarlo al Consejo Insular de Menorca de la forma establecida en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. El importe de las ayudas que se concedan no puede superar en ningún caso, de manera aislada o en concurrencia con otras ayudas, el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. Estas ayudas se pueden acumular a otras ayudas públicas por los mismos gastos subvencionables, siempre que esta acumulación no de lugar a una intensidad superior a la establecida por el Reglamento 1998/2006.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;6. REQUISITOS DE LOS BENEFICIARIOS&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Pueden ser beneficiarios las cooperativas agrarias de primer grado de Menorca reguladas por la Ley 1/2003 de 20 de marzo, de cooperativas de las Islas Baleares, modificada por la Ley 5/2011, de 31 de marzo y que hayan llevado a cabo campañas de divulgación, valoración, promoción y valor añadido de los productos agro-alimentarios desde día 1 de enero a 15 de noviembre de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Las cooperativas agrarias de primer grado de Menorca deben estar inscritas en el Registro de cooperativas de las Islas Baleares y desarrollar principalmente su actividad societaria en el territorio de la isla de Menorca. (Este documento se aportará de oficio).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. De acuerdo con el Reglamento comunitario número. 1998/2006 de la Comisión, de 15 de diciembre, de aplicación de los artículos 87 y 88 del Tratado a las ayudas de minimis, no pueden ser beneficiarias las empresas en crisis en el sentido de las directrices comunitarias sobre ayudas estatales de salvamento y de reestructuración de empresas en crisis (DOUE C 244, de 1.10.20004).Las solicitudes deben hacer constar esta circunstancia en su solicitud de ayuda, de conformidad con el modelo el anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. La ayuda no se puede repercutir total ni parcialmente sobre los productores primarios. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. En cualquier caso, no pueden ser beneficiarios las personas o entidades en las que concurra alguna de las prohibiciones establecidas en el art. 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, y el art. 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;7. PRESENTACIÓN DE LAS SOLICITUDES&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Las solicitudes se deben formalizar mediante el modelo normalizado que se adjunta como anexo I de estas bases, que se facilitará en la sede del Consejo Insular de Menorca, en Maó, en las oficinas administrativas de Ciutadella; en Sa Granja (Maó), y en Sa Roqueta (Ciutadella).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. En la solicitud se debe adjuntar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Documentación administrativa &lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) Original o copia compulsada de la escritura de constitución o modificación de la cooperativa y estatutos sociales, documentos debidamente inscritos en el Registro de Cooperativas de las Islas Baleares.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) Si fuera necesario de conformidad con sus estatutos, han de aportar certificado del acuerdo adoptado por el órgano de gobierno de la entidad pra solicitar la ayuda y designar representante (anexo V). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Copia compulsada del documento de identificación fiscal de la entidad solicitante (NIF).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;d) Acreditación de la representación y copia del NIF del representante. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;e) Declaración responsable firmada por el solicitante o por su representante legal de no estar sometido a ninguna de las circunstancias que determinan la imposibilidad de obtener la condición de beneficiario o entidad colaboradora de las subvenciones públicas recogidas en el art. 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;f) Declaración responsable firmada por el solicitante o por su representante legal relativa a las subvenciones o ayudas obtenidas y solicitadas de otras instituciones públicas o privadas para realizar la misma actividad (anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;g) Documento de designación de cuenta bancaria de la empresa o de su representante según modelo facilitado por el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;h) Certificado en el que conste que está al corriente de las obligaciones tributarias ante la Administración del Estado y de las obligaciones ante la Seguridad Social. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;i) Documentación acreditativa de la justificación de la subvención&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;Documentación específica&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;j. Memoria del programa de actuación que se llevará a cabo, que debe incluir: antecedentes, objetivos, presupuesto y fechas de inicio y finalización de las actuaciones para las que se solicita ayuda.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;k. Declaración sobre las otras ayudas de minimis recibidas por los mismos gastos subvencionables durante los dos ejercicios fiscales anteriores y durante el ejercicio fiscal en curso, haciendo constar que la ayuda global de minimis que ha recibido no supera los límites establecidos (anexo VI).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. Los beneficiarios podrán autorizar al Consejo Insular de comprobar el cumplimiento de sus obligaciones tributarias y con la Seguridad Social. Estas comprobaciones se llevarán a cabo en la medida en que el Consejo Insular de Menorca disponga de los convenios adecuados que se lo permitan (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;En cualquier caso, la acreditación del cumplimiento de estas obligaciones se pueden sustituir por una declaración responsable del representante legal de la entidad solicitante cuando se trate de subvenciones de cuantía igual o inferior a 3.000€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Exime de presentar la documentación a que hacen referencia las letras a, c, d y g en el caso de que ésta ya conste en los archivos del Consejo Insular. En este caso, se hará constar expresamente en la solicitud. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. Las solicitudes y toda la documentación transcrita en el apartado anterior se presentarán, dentro del plazo establecido en la convocatoria, en los puntos del Servicio de Atención al Ciudadano del Consejo Insular de Menorca que hay en la sede del CIM de Maó y en las oficinas administrativas de Ciutadella,en las dependencias de Sa Roqueta y Sa Granja o los ayuntamientos de Menorca que tengan suscrito convenio con el CIM para la presentación de este servicio. Así mismo se pueden presentar en cualquier otro punto de conformidad con lo establecido en el art. 38 de la Ley 30/92, de 26 de noviembre, de régimen jurídico de las administraciones públicas y procedimiento administrativo común..&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. Si la solicitud o la documentación fueron incorrectas o incompletas, el Consejo Insular de Menorca requerirá la rectificación o el complemento necesarios. Si en el plazo de diez días hábiles, contados desde el día siguiente de la fecha de recepción del requerimiento de subsanación de la solicitud, la persona interesada no hace la rectificación reclamada o no presenta la documentación requerida, se entenderá que ha desistido de su petición de conformidad con el artículo 71 de la Ley 30/1992, de 26 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;8. CRITERIOS QUE SE TENDRÁN EN CUENTA PARA LA CONCESIÓN DE AYUDAS Y DETERMINACIÓN DEL IMPORTE DE LA SUBVENCIÓN&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Si la actuación para la que se solicita la ayuda es idónea y adecuada a los requisitos de esta convocatoria, se aplicarán los criterios objetivos, si no es así la actuación quedará eliminada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2.Siempre que se cumplan los requisitos de la convocatoria se otorgarán las ayudas solicitadas con los límites fijados en la convocatoria y en estas bases, dentro del límite del crédito disponible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. La ayuda se repartirá proporcionalmente entre los solicitantes que cumplan los requisitos de acuerdo con el siguiente criterio:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;- Importe global de las acciones comerciales: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a. actuaciones con un coste igual o superior a 40.001 €: 5 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b. actuaciones con un coste de 40.000 € a 20.001€: 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c. actuaciones con un coste igual o inferior a 20.000 €: 1 punto&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Por 5 puntos: 40.000 €&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Por 3 puntos: 35.000 €&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Por 1 punto: 30.000 €&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;- El importe máximo que puede recibir cada solicitante es de 40.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. Si después de aplicar los criterios anteriores se supera el límite de la convocatoria, las ayudas se reducirán de manera proporcional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;9. CUANTÍA DE LAS AYUDAS&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. La cuantía de la subvención será como máximo del 80% del coste subvencionable de la acción, con un máximo de 40.000 € de ayuda por beneficiario en el marco de la presente convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. De conformidad con lo establecido en el Reglamento 1998/2006 de la Comisión, la cuantía total de ayudas de minimis no podrá exceder de 200.000€ por beneficiario en un periodo de tres ejercicios fiscales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. En ningún caso el importe de la ayuda podrá superar el coste de la actividad que vaya a realizar. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. Si, después de aplicar los criterios fijados en el punto 8, se supera el límite de la convocatoria, las ayudas se reducirán de forma proporcional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;10. COMISIÓN EVALUADORA DE LAS AYUDAS &lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La comisión evaluadora es el órgano colegiado al que corresponde examinar las solicitudes presentadas y emitir el informe que debe servir de base para elaborar la propuesta de resolución.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. La Comisión Evaluadora está integrada por los siguientes miembros:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;- Presidente: el consejero ejecutivo de Economía, Medio Ambiente y Caza &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;- Secretario/aria: un/a funcionario/aria del Departamento&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;- Vocales: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;. director insular de Economía, Medio Ambiente y Caza del CIM&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;. tres técnicos del Departamento de Economía y Medio Ambiente del CIM&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;11. PROCEDIMIENTO Y ÓRGANOS COMPETENTES PARA LA CONCESIÓN DE LAS AYUDAS &lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Las ayudas se concederán, de acuerdo con los principios de objetividad, transparencia, igualdad, no discriminación y publicidad, mediante el procedimiento de concurrencia no competitiva.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. El inicio del expediente se efectuará por medio de la aprobación de la convocatoria correspondiente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. La instrucción corresponderá a un funcionario del Departamento de Economía, Medio Ambiente y Caza, que debe realizar de oficio todas las actuaciones necesarias para la determinación, conocimiento y comprobación de los datos en virtud de los cuales debe dictar resolución sobre la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. Las solicitudes presentadas dentro del plazo establecido en la convocatoria se someterán al examen de la Comisión Evaluadora. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. Una vez examinadas las solicitudes por la Comisión Evaluadora, y después de que ésta haya emitido su informe, el consejero ejecutivo jefe del departamento elevará la correspondiente propuesta de resolución al órgano competente, que en este caso es el Consejo Ejecutivo del Consejo Insular de Menorca, que dictará resolución sobre la concesión o denegación de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;6. Cuando la cuantía de la ayuda que resulte del informe previo sea sustancialmente inferior al solicitado, se podrá instar al beneficiario a reformular su solicitud para ajustar los compromisos y condiciones de la subvención otorgable. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;7. La resolución del expediente de otorgamiento de las subvenciones debe ser expresa y motivada, y debe fijar, con carácter definitivo, la cuantía específica de cada una de las subvenciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;8. El plazo máximo para dictar y notificar la resolución expresa de concesión de subvención será de seis meses contados desde la fecha de finalización del plazo de presentación de solicitudes. No obstante lo anterior, este plazo se puede reducir si se establece expresamente en la convocatoria de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El silencio administrativo tiene carácter desestimatorio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;9. La resolución del expediente de concesión o denegación de las ayudas se publicará en el Boletín Oficial de las Islas Baleares, sin perjuicio de su notificación individual a los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La notificación de la resolución de concesión a la empresa subvencionada debe recoger el importe previsto de la ayuda y su carácter de minimis.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;10. La concesión de la ayuda se puede instrumentar mediante la formalización de un convenio de colaboración con la entidad beneficiaria en el que se determinen los derechos y las obligaciones de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;12. JUSTIFICACIÓN Y PAGO DE LAS AYUDAS&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. La justificación se debe presentar junto con la solicitud de la ayuda&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Para justificar la ayuda se debe presentar la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a. Cuenta justificativa simplificada: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;-Memoria justificativa del cumplimiento de las condiciones impuestas en la concesión de la subvención, con indicación de las actividades realizadas y los resultados obtenidos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;-Relación nominativa de los gastos realizados y los ingresos y subvenciones que hayan financiado la actividad (anexo IV), en aplicación del art. 75 del Reglamento general de subvenciones que regula la cuenta justificativa simplificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b. Una muestra de material informativo o promocional más significativo (fotografías, hojas informativas, recortes de prensa…).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. En relación con la justificación de la actuación definida en la base 4, apartado 1.e, se pueden presentar los gastos de las agencias de publicidad y otros proveedores de servicios que participan en la elaboración y en la aplicación de campañas de promoción, así como de prensa, televisión y radio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. Los gastos de personal no son gastos justificables. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. En el caso de recibir cualquier otra subvención pública, deben integrarse los justificantes de la subvención recibida y los conceptos por los que se ha recibido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;6. En la fase de comprobación del gasto, realizado se pedirá al beneficiario que presente los justificantes que se estimen oportunos para obtener una evidencia razonable sobre la adecuada aplicación de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;7. Si la documentación presentada es incompleta o incorrecta, el servicio responsable pedirá al beneficiario que haga la rectificación oportuna en el plazo improrrogable de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;8. Si el gasto justificado es inferior al importe del presupuesto solicitado y subvencionado se reducirá proporcionalmente la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;9. El Consejo Insular de Menorca podrá inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que puedan corresponder , por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;13. ABONO DE LAS AYUDAS&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Las subvenciones se harán efectivas en el plazo máximo de 60 días desde el momento que se compruebe que la justificación presentada se ajusta a los requisitos exigidos en las bases de la convocatoria y siempre que la disponibilidad de tesorería lo permita. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. No se podrá pagar la subvención en tanto el beneficiario no se encuentre al corriente en el cumplimiento de sus obligaciones tributarias y ante la Seguridad Social. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. El Consejo Insular de Menorca podrá inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;14. OBLIGACIONES DE LOS BENEFICIARIOS &lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Los beneficiarios deberán cumplir las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) Comunicar al CIM la aceptación de la subvención en los términos en que ésta se conceda. En cualquier caso la subvención se entenderá aceptada tácitamente una vez transcurridos quince días hábiles desde que el beneficiario haya recibido la notificación de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) Llevar a cabo las actividades que fundamentan la concesión de las ayudas y justificar su realización en los plazos y en las condiciones establecidas en estas bases y en la resolución de concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;c) Comunicar al Consejo Insular de Menorca la solicitud y la obtención de subvenciones y ayudas para la misma finalidad.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;d) Mantener la actividad durante un plazo mínimo de un año desde la presentación de la solicitud, en caso contrario, se les podrá exigir la devolución total o parcial de la subvención abonada, más los intereses e demora, sin perjuicio de la sanción que pueda corresponder por alteración de la finalidad para la que se les ha concedido la subvención.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;e) Acreditar, cuando el Consejo Insular lo solicite, que se encuentran al corriente de las obligaciones tributarias y con la Seguridad Social. La acreditación no será necesaria en el caso de que se haya autorizado expresamente al Consejo Insular a consultar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;f) Proporcionar la información sobre la actividad subvencionada que le requiera el Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;g) Someterse a las actuaciones de comprobación que efectúe el Consejo Insular de Menorca y el resto de organismos competentes para la fiscalización de las cuentas públicas.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;h) La ayuda no se puede repercutir total o parcialmente sobre los productores primarios (agricultores).&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;15. RENOVACIÓN Y REINTEGRO DE LAS AYUDAS. CRITERIOS DE GRADUACIÓN DE POSIBLES INCUMPLIMIENTOS&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En cuanto a la renovación y el reintegro de las subvenciones, se aplicará lo dispuesto en la Ley 38/2003, de 17 de noviembre, general de subvenciones, y el resto de normativa que sea aplicable. En caso de incumplimiento, se debe reintegrar la cuantía recibida mediante la aplicación de un porcentaje de minoración en función de la naturaleza del incumplimiento. Este porcentaje se fijará previo informe del instructor y se debe notificar al beneficiario. Las causas de reintegro y el procedimiento pra su exigencia se regirán por lo establecido en el artículo 44 del DLEG 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Se debe valorar, en todo caso, el grado de incumplimiento, si éste se ha producido a causa de actuaciones dolosas o negligentes y si ha habido buena o mala fe. La gradación del reintegro será mayor cuando el incumplimiento sea total o muy alto y hayan incurrido causas dolosas y mala fe, y en cambio será menor si el grado de cumplimiento del proyecto subvencionado es parcial y cuando haya sido causado por actuaciones negligentes y con buena fe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;También se podrá exigir el reintegro si se superan los límites que establece el art. 2 del Reglamento 1998/2006 de la Comisión, de 15 de diciembre, de aplicación de los artículos 87 y 88 del Tratado a las ayudas de minimis. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Cuando la causa del reintegro determine la invalidez de la resolución de concesión se debe revisar previamente esta resolución en los términos establecidos en el artículo 25 del DLEG 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones, y en el resto de disposiciones aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Si se han realizado pagos anticipados, la persona beneficiaria debe reintegrar las cantidades recibidas más el interés de demora a contar desde que se hizo efectivo el pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Las cantidades que se deben reintegrar tienen la consideración de ingresos de derecho público y les es aplicable la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p class="western"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La obligación de reintegro establecida en este artículo es independiente de las sanciones que, en su caso, sean exigibles.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;16. INFRACCIONES Y SANCIONES&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. El régimen de infracciones y sanciones administrativas aplicables será el establecido en el título V del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, y el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. El órgano competente para imponer las sanciones que se deriven de infracciones de lo establecido en estas bases y de la normativa aplicable en materia de subvenciones es la Presidencia del Consejo Insular de Menorca, de acuerdo con lo que establece el art. 9 de la Ley 8/2000, de 28 de octubre, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;17. OTRAS DISPOSICIONES&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Recursos administrativos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Los acuerdos del Consejo Ejecutivo por los cuales se aprueban las bases y las convocatorias y se conceden o deniegan las ayudas no agotan la vía administrativa y son susceptibles de interponer recurso de alzada ante la Comisión de Gobierno del Consejo Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Normativa general aplicable&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;En todo lo no previsto expresamente en estas bases regirán las disposiciones que sean aplicables al Consejo Insular de Menorca en materia de subvenciones, especialmente las contenidas en:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;-Ley 38/2003, de 17 de noviembre, general de subvenciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
