font-size: 12px">Dado que de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990, de 2 de marzo (texto articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial) que ha introducido la Ley 18/2009, de 23 de noviembre, la Administración competente en materia de gestión de trafico podrá ordenar el traslado del vehículo a un Centro Autorizado de Tratamiento de Vehículos para su posterior destrucción y descontaminación en los casos siguientes:</span></p> <ol style="list-style-type: lower-alpha"> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Cuando hayan transcurrido más de dos meses desde que el vehículo fuera inmovilizado o retirado de la vía pública y depositado por la Administración y su titular no hubiera formulado alegaciones.</span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Cuando permanezca estacionado por un período superior a un mes en el mismo lugar y presente desperfectos que hagan imposible su desplazamiento por sus propios medios&nbsp; o le falten las placas de matrícula.&nbsp; </span></li> <li> <span style="font-family: times new roman, times, serif; font-size: 12px">Cuando recogido un vehículo como consecuencia de una avería o accidente del mismo en un recinto privado su titular no lo hubiese retirado en el plazo de dos meses.</span></li> </ol> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Dado que según lo que establece el artículo 3º b) de la Ley 22/2011, de 28 de julio, de Residuosm y Suelos Contaminados, se entiende que los vehículos abandonados son residuos domèsticos, y que el artículo 12.5 c) de la misma ley otorga competencias a las entidades locales para la gestión de éstos.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">A la vista de los antecedentes mencionados, por el presente y en virtud de las atribuciones que me han delegado mediante decreto de fecha 27 de junio de 2011 (BOIB nùm. 114, de 28/07/11),</span></p> <p style="text-align: center"> <span style="font-family: times new roman, times, serif; font-size: 12px"><strong>RESUELVO:</strong></span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">1º.- Requerir a las personas titulares de los vehículos, con anterioridad a la orden de traslado al Centro Autorizado de Tratamiento de Vehículos, a fin de que procedan a la retirada del vehículo en el plazo de un mes, de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990, de 2 de marzo. </span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Si en el plazo de un mes la persona titular del vehiculo no procede a su retirada, no presenta la declaración de renuncia voluntaria del vehiculo o bien se reciben noticias suyas,se procederá al tratamiento del vehiculo como residuo domèstico, con las siguientes consecuencias: el traslado a un Centro Autorizado de Tratamiento de Vehículos para su posterior destrucción y descontaminación o bien la adjudicacion del vehiculo a los servicios de vigilancia y control del trafico (art. 86.3 RDL 339/1990), la baja de oficio del vehículo en el Registro de la Dirección General de Tráfico, y la incoación del oportuno expediente sancionador en base al artículo 46.3 c) de la Ley 22/2011, de 28 de julio, de Residuos y Suelos Contaminados, con multa de 901 euros hasta&nbsp; 45.000 euros.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">2º.- Notificar a las personas titulares de los vehículos el presente decreto. </span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Les informamos que si se procede a la renuncia expresa de la titularidad del vehículo a favor del Ayuntamiento no se incoará el expediente sancionador y se entenderá la participación del poseedor según dispone el artículo 17 de la Ley 22/2011, de 28 de julio, de Residuos y Suelos Contaminados.</span></p> <p> <span style="font-family: times new roman, times, serif; font-size: 12px">Se podrá formular la renuncia del vehículo, previo pago de los gastos ocasionados en el Depósito Municipal (C/ Voluntariado nº 5-7 de Ibiza-07800, teléfono 971-19.97.99, fax 971-19.44.16), o bien presentar escrito de alegaciones en el plazo de quince dias habiles en el Registro General del Ayuntamiento (C/.
