&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;NOTIFICACIÓN DECRETO EJECUCIÓN SUBSIDIARIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Mediante la presente se le notifica la resolución de Alcaldía firmada en fecha de hoy, aprobatoria sobre orden de ejecución número Órdenes de Ejecución 2013/9 , del tenor literal siguiente :&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;DECRETO DE EJECUCIÓN SUBSIDIARIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Expediente 9/2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Visto el informe del Celador Municipal emitido por el mismo en fecha 04/09/2013 que confirma el incumplimiento por parte del Sr. / Sra . CGG con DNI X-8311418T de la realización de las obras consistentes en REALIZAR LA LIMPIEZA DE 988 M2 Y EL CERRAMIENTO DE 66 M2 de los solares situados en la calle CR PERU de SON SERRA con RC 8988808-8988807-8988814 .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Examinada toda la documentación presentada y vistos los informes que han sido presentados , en virtud de la competencia atribuida por el artículo 21.1.r ) de la Ley 7/1985 , de 2 de abril, reguladora de las bases de régimen local ,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;PRIMERO. ACORDAR la ejecución subsidiaria por el Ayuntamiento de las obras consistentes en REALIZAR LA LIMPIEZA DE 988 M2 Y EL CERRAMIENTO DE 66 M2 de los solares situados en la calle CR PERU de SON SERRA con RC 8988808-8988807-8988814, corriendo los gastos que se deriven a cargo del Sr. / Sra . CGG con DNI X-8311418T. Las obras se ejecutarán por la ley de contratos de las administraciones públicas y previa solicitud de entrada en domicilio al Juzgado Contencioso Administrativo.&lt;br /&gt; &lt;br /&gt; SEGUNDO. LIQUIDAR provisionalmente de forma cautelar al Sr. / Sra . CGG con DNI X-8311418T &amp;nbsp;la cantidad de&amp;nbsp; 17.712,97 €, cantidad en que se presupuestan las obras (se adjunta informe técnico ) , sin perjuicio de posterior liquidación definitiva , que podrá ingresar a cualquiera de las cuentas que a continuación se especifican en el plazo de 15 días contados a partir de la notificación de la presente liquidación , advirtiéndole de que de no realizarse en el plazo señalado se iniciarán los trámites para la recaudación de dicha cantidad por la vía de apremio .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;A) Las notificadas entre los días 1 y 15 de cada mes, ambos incluidos, sin recargo hasta el día 20 del mes siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;B) Las notificadas entre los días 16 y último de cada mes, ambos incluidos, sin recargo hasta el día 5 del segundo mes posterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Cuando los plazos terminen en día inhábil, quedan ampliados al día hábil inmediato posterior. Una vez transcurridos los plazos de ingreso en período voluntario, sin que se haya efectuado, procederá la vía ejecutiva. El recargo aplicable será del 5 % cuando se satisfaga la totalidad de la deuda tributaria no ingresada en periodo voluntario antes de la notificación de la providencia de apremio del 10% cuando se satisfaga la totalidad de la deuda no ingresada en periodo voluntario y el propio recargo antes de la finalización del plazo de pago en periodo ejecutivo y del 20 % en los restantes supuestos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;TERCERO. Dar cuenta al Departamento de Tesorería de la presente liquidación a efectos de su cumplimiento y porque en cumplimiento de los artículos 100 y 106 del Reglamento General de Recaudación, los artículos 161 a 167 de la Ley 58 /2003 de 17 de diciembre, General Tributaria y de el artículo 5.3 c ) del Real Decreto 1174/1987 se dicte por parte de la Tesorera Municipal providencia de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;CUARTO. Solicitar al Juzgado contencioso- administrativo de Palma autorización para poder entrar en los solares situados en la calle CR PERU de SON SERRA con RC 8988808-8988807-8988814 propiedad del Sr. / Sra . CGG con DNI X-8311418T&amp;nbsp; &amp;nbsp;al objeto de realizar las obras consistentes en REALIZAR LA LIMPIEZA DE 988 M2 Y EL CERRAMIENTO DE 66 M2 de los solares antes descritos .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;QUINTO. - Notificar al interesado esta resolución de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(34, 34, 34)"&gt;Contra la presente resolución , que pone fin a la vía administrativa, puede interponerse , alternativamente , recurso de reposición potestativo , en el plazo de un mes a contar desde el día siguiente a la recepción de esta notificación, ante el Alcalde de este Ayuntamiento de conformidad con los artículos 116 y 117 de Ley 30/1992 , de 26 de noviembre , de régimen jurídico de las administraciones públicas y del procedimiento administrativo común , o bien recurso contencioso - administrativo , ante el Juzgado de lo contencioso- administrativo de Palma , en el plazo de dos meses a contar desde el día siguiente a la recepción de la presente notificación, de conformidad con el artículo 46 de la Ley 29/1998 , de 13 de julio , de la jurisdicción contencioso- administrativa . Si se optara por interponer el recurso de reposición potestativo, no se podrá interponer recurso contencioso- administrativo hasta que aquel sea resuelto expresamente o se haya producido su desestimación por silencio. Todo ello, sin perjuicio de que pueda ejercitar cualquier otro recurso que estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
