&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el procedimiento de referencia se ha dictado la resolución cuyo encabezamiento y fallo son del tenor literal siguiente:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SENTENCIA N°316&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ILMOS. SRES. Presidente: D. MATEO RAMON HOMAR.- Magistrados: D. SANTIAGO OLIVER BARCELO. Dña. COVADONGA SOLA RUIZ.- En Palma de Mallorca, a tres de julio de dos mil doce. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;VISTO en grado de apelación ante esta Sección Quinta, de la Audiencia Provincial de PALMA DE MALLORCA, los Autos de PROCEDIMIENTO ORDINARIO 1038 /2008, procedentes del JDO. PRIMERA INSTANCIA N.4 de IBIZA/EIVISSA, a los que ha correspondido el Rollo RECURSO DE APELACION 171 /2012, en los que aparece como parte apelante, AKOSKINFINE ART SLU, y SANTIAGO SALVADOR AKOSKIN ABANTO, representados por el Procurador de los tribunales, Sr. JOSE LUIS MARI ABELLAN, asistidos por el Letrado D. MIGUEL ANGEL GONZALEZ CONDE, y como parte apelada, CAIXABANK, S.A., representada por la Procuradora de los tribunales, Sra. CATALINA CELESTE SALOM SANTANA, asistida por el Letrado D. ALEXANDRE SALAS MARTIN. ES PONENTE el Ilmo. Sr. Magistrado D. Santiago Oliver Barceló. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FALLAMOS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;1°)&lt;/strong&gt; &lt;strong&gt;Desestimar el recurso&lt;/strong&gt; de Apelación interpuesto por el Procurador de los Tribunales D. José Mari Abellan, en representación de D. Santiago Akoskin Abanto, contra&amp;nbsp; la Sentencia de fecha 18-febrero-2011, dictada por el Juzgado de Primera Instancia n° 4 de Ibiza, en los autos de Juicio Ordinario n° 1.038/2008, de que dimana el presente Rollo de Sala; y en su virtud,&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2&lt;/strong&gt;°) Confirmar los pronunciamientos que la resolución impugnada contiene.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;3°) Se imponen&lt;/strong&gt; a la parte apelante-interviniente las costas procesales devengadas en esta alzada. Así por esta nuestra Sentencia, lo pronunciamos, mandamos y firmamos. Siguen firmas y publicación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y como consecuencia del ignorado paradero de la entidad AKOSKIN FINE ART, S.L. se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/p&gt;
