    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Por acuerdo plenario de fecha 6 de agosto de 2013, se aprobó inicialmente&lt;/span&gt;&lt;/span&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt; &lt;/span&gt;&lt;/b&gt;&lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;la &lt;/span&gt;&lt;/span&gt;ordenanza municipal reguladora &lt;span style="font-weight: normal"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;de los horarios de establecimientos y espectáculos públicos y actividades recreativas&lt;/span&gt;&lt;/span&gt;. Finalizado el período de exposición pública, y visto que no se ha presentado ninguna reclamación, objeción u observación, se entiende definitivamente aprobado el acuerdo provisional.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformidad con el que dispone el artículo 70.2 de la LBRL y el artículo 103 de la Ley 20/2006, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, se publica a continuación su texto íntegro:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;ORDENANZA REGULADORA DE LOS HORARIOS DE ESTABLECIMIENTOS Y ESPECTÁCULOS PÚBLICOS Y ACTIVIDADES RECREATIVAS.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;La regulación de los horarios de los establecimientos y espectáculos públicos y de las actividades recreativas constituye un elemento fundamental para asegurar la tranquilidad y la convivencia entre los vecinos y visitantes de cualquier municipio. Su ordenación y el control correspondiente incide directamente en las molestias que se pueden producir por ruidos molestos, y es evidente también su relación directa con aspectos relacionados con la seguridad ciudadana, el orden público, la limpieza viaria, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El hecho de que la vida cotidiana gire en torno a determinados horarios obliga a la adaptación a éstos con la finalidad de salvaguardar derechos constitucionales tales como la calidad de vida, el derecho a la salud y el derecho a un medio ambiente adecuado para las personas, al mismo tiempo que se facilita la adecuada utilización del ocio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El Ayuntamiento entiende que es posible compaginar ese interés con el ofrecer al residente la tranquilidad necesaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El Art. 19 de la Ley 9/1997, de 22 de diciembre, de diversas medidas tributarias y administrativas, establece que el horario general de los espectáculos y de las actividades recreativas será determinado reglamentariamente por el Gobierno de la Comunidad Autónoma de les Illes Balears. No obstante, mientras esta administración no regule este tema, corresponderá a los plenos de los Ayuntamientos aprobar mediante reglamento ampliaciones o reducciones de los horarios en materia de espectáculos públicos y de actividades recreativas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Haciendo uso de esta facultad prevista en el párrafo anterior, se procede a la fijación de los horarios de apertura y cierre de los establecimientos y espectáculos públicos y de las actividades recreativas en el Municipio de Sóller.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 1. Horario de apertura y cierre.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.1.- A los efectos de esta ordenanza se consideran los siguientes grupos de locales o actividades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;I : Restaurantes, Bares, Cafés, Cafeterías y análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;II : Bares Musicales ( bar con licencia de música tipo III según ordenanza de ruidos local) y análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;III : Bingos, Salones de Juego, Cines, Teatros, Cafés-Teatro y análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;IV : Discotecas, Salas Fiesta y de Baile, Cafés conciertos y análogos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;V : Salones Recreativos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.2.- El horario de apertura y cierre de los establecimientos públicos y actividades recreativas será el que se refleja en la siguiente tabla:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.3.- En los periodos comprendidos entre el 1 de octubre al 15 de abril (periodo considerada invierno) el horario de cierre se reducirá en media hora, excepto los viernes, sábados y vísperas de fiestas que se regirán por el horario establecido en el apartado 1.2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;La apertura se refiere al horario a partir del cual está permitido abrir e iniciar la actividad. El Cierre se refiere al horario a partir del cual la actividad del establecimiento debe haber cesado completamente. A partir de la hora de cierre establecida, cesará toda amenización musical, juego o actuación en el local y no se servirán más consumiciones. Tampoco se permitirá la entrada de más personas y se encenderán todas las luces del local para facilitar su desalojo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1.4.- Cuando en los establecimientos concurran más de una actividad de las descritas anteriormente&amp;nbsp; que no puedan separarse físicamente entre sí, cada una de ellas se considerará como independiente y se regirá por su propio horario, conforme a lo establecido en los artículos anteriores &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 2. Excepciones.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2.1.- Para los locales del Grupo I y excepcionalmente para aquellos establecimientos que habitualmente sirven desayunos, se permite el adelanto de 2 horas del horario de apertura, previa solicitud de los titulares de dichos establecimientos al Ayuntamiento, debiendo realizar este servicio sin ningún tipo de amenización musical.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2.2.- En los locales del Grupo IV, en el caso de organización de galas juveniles, se permitirá la realización de la actividad hasta las 24:00 horas en festivos y vísperas de festivos, con las limitaciones de admisión, consumo y servicio de bebidas establecidos para menores. En estos casos deberán transcurrir al menos 1 hora desde la conclusión de la gala juvenil al inicio normal de la actividad, dentro del horario permitido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 3. Terrazas.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Los locales que cuenten con terraza pública o privada (cualquiera que sea el Grupo de local o actividad) deberán cesar cualquier amenización musical a las 00:00 horas, paralizándose por completo la actividad en dicha terraza a las 01:00 horas, sin que pueda sobrepasar el horario establecido en la tabla contenida en el artículo 1.2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 4. Ejecución del cierre.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El establecimiento deberá quedar totalmente vacío de público como máximo media hora después del horario de cierre autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 5. Otros horarios.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El horario de apertura y de cierre o &lt;span lang="es-ES"&gt;finalización&lt;/span&gt; de los demás establecimientos, espectáculos públicos y actividades recreativas que, según la normativa vigente, requieran autorización administrativa, y no estén contemplados en la presente ordenanza, requerirá de autorización expresa y específica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 6. Restricciones.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;El Ayuntamiento podrá adelantar el horario de cierre, o retrasar el horario de apertura, de aquellos locales a los que, por infracción a la normativa de actividades o a la ordenanza municipal de ruidos, se les haya señalado la obligación de adoptar medidas correctoras. Dicha restricción de horarios, de funcionamiento se prolongará hasta que se hayan adaptado dichas medidas y obtenido informe favorable del órgano competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 7. Fiestas populares.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Sin perjuicio de lo dispuesto en el artículo 1, el Alcalde podrá autorizar horarios especiales durante la celebración de fiestas populares y en las de navidad y Semana Santa, con las limitaciones que se establezcan en la resolución administrativa correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 8. Infracciones&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; font-weight: normal"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Constituyen infracciones administrativas las acciones u omisiones que contravengan las disposiciones de la presente Ordenanza, sin perjuicio de las responsabilidades civiles, penales o de otro orden que pudieran derivar de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;&lt;span style="font-weight: normal"&gt;2. En los procedimientos sancionadores que se instruyan en aplicación de la presente Ordenanza, los hechos constatados por agentes de la autoridad tienen valor probatorio, de acuerdo con la normativa aplicable al efecto, sin perjuicio de otras pruebas que puedan aportar los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. A los expedientes sancionadores que se instruyan, y con los requisitos que correspondan de acuerdo con la legislación vigente, se podrán incorporar imágenes de los hechos denunciados, ya sea en fotografía, filmación digital u otros medios en la denuncia formulada de acuerdo con la normativa aplicable. En todo caso, la utilización de videocámaras requerirá, si procede, las autorizaciones previstas en la legislación aplicable, así como su uso de acuerdo con el principio de proporcionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. Las infracciones administrativas se clasifican en&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm; margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Leves&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) El retraso en el comienzo o terminación de los espectáculos, en un exceso de tiempo de hasta 30 minutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) El adelanto en la apertura o el retraso en el cierre de los establecimientos públicos, en un exceso de tiempo de hasta 30 minutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Cualquier infracción a las normas de la presente Ordenanza no calificada como falta grave o muy grave.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 1.25cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Graves&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) El retraso en el comienzo o terminación de los espectáculos, en un exceso de tiempo de más de 30 minutos y hasta una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) El adelanto en la apertura o el retraso en el cierre de los establecimientos públicos, en un exceso de tiempo de más de 30 minutos y hasta una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Las infracciones leves cuando, doce meses antes de cometerlas, el responsable de las mismas haya sido objeto de sanción mediante resolución definitiva, por infracción tipificada como leve.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 1.25cm; margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. Muy graves&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) El retraso en el comienzo o terminación de los espectáculos, en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) El adelanto en la apertura o el retraso en el cierre de los establecimientos públicos, en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Las infracciones graves cuando, doce meses antes de cometerlas, el responsable de las mismas haya sido objeto de sanción, mediante resolución definitiva, por infracción tipificada como grave.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. Las infracciones tipificadas en la presente Ordenanza como leves prescribirán en el plazo de 6 meses, las tipificadas como graves en el de 2 años y las tipificadas como muy graves en el de 3 años. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;6 Interrumpirá la prescripción, la iniciación, con conocimiento del interesado, del procedimiento sancionador, reanudándose el plazo de prescripción si el expediente sancionador estuviera paralizado durante más de un mes por causa no imputable al presunto responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;7. El procedimiento sancionador ordinario deberá ser resuelto y notificarse la resolución que proceda al interesado, en el plazo máximo de un año, desde su iniciación, produciéndose la caducidad del mismo en la forma y modo previstos en la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común. No obstante lo anterior, el instructor del expediente podrá acordar la suspensión del plazo máximo para resolver cuando concurra alguna de las circunstancias previstas y exigidas para ello en el artículo 42.5 de la citada ley, de acuerdo con la redacción establecida por la Ley 4/1999, de 13 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 9. Sanciones&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;1. Las infracciones podrán ser sancionadas por vía administrativa, de conformidad con las siguientes cuantías:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) Infracciones leves, con multa de hasta 750 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) Infracciones graves, con multa de hasta 1.500 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) Infracciones muy graves, con multa de hasta 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;2. Para la imposición de sanciones previstas en la presente Ordenanza se tendrán en cuenta, en todo caso, los criterios de graduación siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;a) La gravedad de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;b) La existencia de intencionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;c) La naturaleza de los perjuicios causados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;d) La reiteración. Se entiende que hay reiteración cuando, en el momento de la comisión de los hechos tipificados como infracción en la presente Ordenanza, el presunto responsable esté imputado en la instrucción de otros procedimientos sancionadores por infracciones a la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;3. En la fijación de las sanciones de multa se tendrá en cuenta que, en todo caso, el cumplimiento de la sanción no resulte más beneficiosa para la persona infractora que el cumplimiento de las normas infringidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;4. La desobediencia o la resistencia a la autoridad en los términos del los artículos 556 y 634 de la Ley Orgánica 10/1995 de 23 de Noviembre, del Código Penal dará lugar al hecho de que, por el órgano actuante, se pase el tanto de culpa al Juzgado de Instrucción para la determinación de las responsabilidades penales en las que se hubiese podido incurrir.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;5. Prescribirán a los seis meses las sanciones impuestas por infracciones leves en la presente Ordenanza; a los dos años las impuestas por infracciones graves y a los tres años las impuestas por infracciones muy graves. El plazo de prescripción de las sanciones comenzará a contarse desde el día siguiente a aquél en que se haya agotado la vía administrativa de la resolución por la que se impone la sanción. Interrumpirá la prescripción la iniciación, con conocimiento del interesado, del procedimiento de ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Artículo 10. Reconocimiento de la responsabilidad&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Las personas denunciadas pueden asumir su culpabilidad y conformidad mediante el pago de las sanciones de multa, con una reducción del 30% del importe máximo de la sanción si el pago se hace efectivo antes del inicio del procedimiento sancionador, o con una reducción del 20% del importe de la sanción que aparezca en la resolución de inicio o en la propuesta de resolución si el pago se hace efectivo antes de la resolución final.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;En todo caso, la cuantía resultante de aplicar dichas reducciones no podrá superar el límite inferior de las cuantía señaladas en el artículo 9.1 de la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;b&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Disposición Final.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;La presente Ordenanza entrará en vigor a los quince días hábiles de su publicación íntegra en el Boletín Oficial de las Islas Baleares de conformidad con lo establecido en el Art. 70.2 de la Ley 7/1985 de 2 abril, Reguladora de Bases de Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0cm"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="background: none repeat scroll 0% 0% transparent"&gt;Sóller, 23 de septiembre de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
