&lt;h2 style="text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;SENTENCIA&amp;nbsp;&amp;nbsp; nº&amp;nbsp; 78/2013&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/h2&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En Palma de Mallorca, a 21 de mayo de 2.013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Vistos por mí, Dª. Mª Isabel Frade Hevia, Magistrada-Juez del Juzgado de Primera Instancia número cuatro de Palma de Mallorca y su partido, los presentes autos de juicio ordinario seguidos ante este Juzgado bajo el número 1.155/2.012, a instancia de &lt;strong&gt;REAL CLUB NÁUTICO DE PALMA&lt;/strong&gt; representado por el Procurador/a Sr./a MUÑOZ GARCÍA y defendida por el/a Letrado/a Sr./a ORDÓÑEZ MARTÍNEZ contra &lt;strong&gt;D ANDREA MARIO LODOLO&lt;/strong&gt;, en situación de rebeldía procesal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;h4 style="text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;FALLO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/h4&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Que estimo íntegramente la demanda presentada por REAL CLUB NÁUTICO DE PALMA contra D ANDREA MARIO LODOLO, y, en consecuencia&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1.- Declaro resuelto el contrato suscrito entre las partes por incumplimiento del demandado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2.- Condeno al demandado a desalojar el pantalán flotante amarre nº 025 en que se encuentra la embarcación de su propiedad denominada AQUARIUS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3.- Condeno al demandado a abonar a al actor la cantidad de 42.645,88 €uros, más los intereses legales desde la fecha de interposición de la demanda hasta su completo pago y más las cuotas pactadas que se devenguen desde la fecha de la presente resolución hasta el efectivo desalojo del pantalán.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;4.- Se imponen las costas al demandado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Modo de impugnación: &lt;/strong&gt;mediante recurso de &lt;strong&gt;APELACIÓN &lt;/strong&gt;que se interpondrá por medio de escrito presentado ante este juzgado en el plazo de VEINTE DIAS hábiles, contados desde el siguiente al de la notificación de la presente resolución. Es requisito para su admisibilidad la constitución de un único depósito de 50 euros, tal y como exige la Disposición Adicional Decimoquinta de la LOPJ (BOE 04/11/09), que deberá ingresarse en la cuenta de depósito y consignaciones de este Juzgado indicando que se hace concepto de “recurso”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Así lo pronuncio, mando y firmo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;PUBLICACIÓN&lt;/strong&gt;.- Leída y publicada ha sido la anterior resolución por la Sra. Magistrada-Juez que la suscribe, estando celebrando audiencia pública en el día de la fecha. Doy fe.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Que en virtud de lo acordado en los autos de referencia, y de conformidad con lo dispuesto en los artículos 156.4 y 164 de la LEC por el presente se NOTIFICA a ANDREA MARIO LODOLO.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En PALMA DE MALLORCA, a diez de Septiembre de dos mil trece.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
