    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Ayuntamiento ha intentado notificar por correo certificado a los interesados que se relacionan&amp;nbsp; en esta resolución, notificación en la cual consta que no se ha podido llevar a cabo la misma porque en unos casos se ignoraba la dirección de los interesados y en otros no se han encontrado en los mismos a los interesados.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Publicamos, por tanto esta resolución en el Boletín Oficial de las islas Baleares, así como en el tablón de anuncios del Ayuntamiento de Calvià y demás correspondientes, de conformidad con lo que estipulan los artículos 59.4 y 61 de la Ley 30/1992 de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común –BOE de 27 de noviembre-.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DECRETO DE ALCADÍA&amp;nbsp; &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SUPUESTO A:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ABANDONADOS VIA PÚBLICA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Hechos: &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los vehículos que se relacionan más abajo han sido denunciados por agentes de la policía local o por ciudadanos presuntamente por permanecer estacionado por un período superior a un mes en el mismo lugar y presentar desperfectos que han hecho imposible su desplazamiento por sus propios medios o le faltan las placas de matrícula.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de Derecho: &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;1) &lt;/strong&gt;El artículo 86.1 del Real Decreto Legislativo 339/1990 de 2 de marzo, de la Ley de Tráfico, circulación de vehículos a motor y seguridad viaria, modificado por Ley 18/2009 de 23 de noviembre, la Administración competente en materia de gestión del tráfico podrá ordenar el traslado del vehículo a un Centro Autorizado de Tratamiento de Vehículos para su posterior destrucción y descontaminación en los casos siguientes: a) cuando hayan transcurrido más de dos meses desde que el vehículo fuera inmovilizado o retirado de la vía pública y depositado por la Administración y su titular no hubiera formulado alegaciones; b) cuando permanezca estacionado por un período superior a un mes en el mismo lugar y presente desperfectos que hagan imposible su desplazamiento por sus propios medios o le falten las placas de matrícula; c) cuando recogido un vehículo como consecuencia de avería o accidente del mismo en un recinto privado su titular no lo hubiese retirado en el plazo de dos meses.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2)&amp;nbsp; &lt;/strong&gt;El artículo 3ºb) de la Ley 22/2011, de 28 de julio de Residuos y suelos contaminados, se entiende que el vehículo abandonado es un residuo sólido urbano, otorgando el artículo 12 de la misma ley competencia a las entidades locales para la gestión de éstos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Considerando:&lt;/strong&gt; que estos se encuentran en el supuesto anteriormente citado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta Alcaldía, a la vista de los antecedentes mencionados y en uso de las atribuciones que le confiere la legislación vigente, &lt;strong&gt;RESUELVE: &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1º. Requerir a los titulares de los vehículos con anterioridad a la orden de traslado al Centro Autorizado de tratamiento de Vehículos, a fin de que procedan a la retirada del vehículo en el plazo de un mes, de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990, de 2 de marzo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si en el plazo de un mes no se procede a la retirada del vehículo o no presentare alegaciones, se procederá a su tratamiento como residuo sólido urbano, con las siguientes consecuencias: traslado a un Centro autorizado de tratamiento para su posterior destrucción y descontaminación, la baja de oficio del vehículo en el Registro de la Dirección General de Tráfico y la incoación del oportuno expediente sancionador, de acuerdo con lo establecido en la Ley 11/99 de 21 de abril, de modificación de la Ley Reguladora de Bases de Régimen Local, y&amp;nbsp; otras medidas para el desarrollo del Gobierno Local, en materia de tráfico, circulación de vehículos a motor y seguridad vial, en su artículo 2º, en base al artículo 47,b).1º de la Ley 22/2011 de 28 de julio, de Residuos y suelos contaminados, con sanción entre 901 euros y 45.000 euros.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2º. Notificar la presente resolución al interesado, otorgando un plazo de quince días a contar desde el día siguiente al de la notificación o publicación,&amp;nbsp; para presentar alegaciones y/o los documentos que estime convenientes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Todo ello sin perjuicio de los débitos que se hayan contraído con la Hacienda Municipal u otros organismos oficiales a los que deberá hacer frente el titular del vehículo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;VEHICULOS EN DEPOSITO MUNICIPAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Hechos:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Visto que en el depósito municipal de la Policía Local de Calvià se encuentran los vehículos que a continuación se relacionan, que han sido retirados de la vía pública, inmovilizados o depositados por diferentes motivos, y han permanecido durante más de dos meses sin que la persona titular haya realizado ninguna gestión para la retirada o haya formulado alegaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Fundamentos de Derecho:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;1) &lt;/strong&gt;El artículo 86.1 del Real Decreto Legislativo 339/1990 de 2 de marzo, de la Ley de Tráfico, circulación de vehículos a motor y seguridad viaria, modificado por Ley 18/2009 de 23 de noviembre, la Administración competente en materia de gestión del tráfico podrá ordenar el traslado del vehículo a un Centro Autorizado de Tratamiento de Vehículos para su posterior destrucción y descontaminación en los casos siguientes: a) cuando hayan transcurrido más de dos meses desde que el vehículo fuera inmovilizado o retirado de la vía pública y depositado por la Administración y su titular no hubiera formulado alegaciones; b) cuando permanezca estacionado por un período superior a un mes en el mismo lugar y presente desperfectos que hagan imposible su desplazamiento por sus propios medios o le falten las placas de matrícula; c) cuando recogido un vehículo como consecuencia de avería o accidente del mismo en un recinto privado su titular no lo hubiese retirado en el plazo de dos meses.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;2) &lt;/strong&gt;El artículo 3ºb) de Ley 22/2011, de 28 de julio de Residuos y suelos contaminados, se entiende que el vehículo abandonado es un residuo sólido urbano, otorgando el artículo 12 de la misma ley competencia a las entidades locales para la gestión de éstos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Considerando:&lt;/strong&gt; que estos se encuentran en el supuesto anteriormente citado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta Alcaldía, a la vista de los antecedentes mencionados y en uso de las atribuciones que le confiere la legislación vigente, &lt;strong&gt;RESUELVE: &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1º. Requerir a los titulares de los vehículos con anterioridad a la orden de traslado al Centro Autorizado de tratamiento de Vehículos, a fin de que procedan a la retirada del vehículo en el plazo de un mes, de acuerdo con el artículo 86.1 del Real Decreto Legislativo 339/1990, de 2 de marzo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Si en el plazo de un mes no se procede a la retirada del vehículo o no se tienen noticias de su titular, se procederá a su tratamiento como residuo sólido urbano, con las siguientes consecuencias: traslado a un Centro autorizado de tratamiento para su posterior destrucción y descontaminación, la baja de oficio del vehículo en el Registro de la Dirección General de Tráfico y la incoación del oportuno expediente sancionador, de acuerdo con lo establecido en la Ley 11/99 de 21 de abril, de modificación de la Ley Reguladora de Bases de Régimen Local, y&amp;nbsp; otras medidas para el desarrollo del Gobierno Local, en materia de tráfico, circulación de vehículos a motor y seguridad vial, en su artículo 2º, en base al artículo 47,b).1º de la Ley 22/2011 de 28 de julio, de Residuos y suelos contaminados, con sanción entre 901 euros y 45.000 euros.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2º. Notificar la presente resolución al interesado, otorgando un plazo de quince días a contar desde el día siguiente al de la notificación o publicación,&amp;nbsp; para presentar alegaciones y/o los documentos que estime convenientes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformidad con lo anteriormente expuesto, informarle que si procede a la renuncia expresa de la titularidad a favor del Ayuntamiento no se incoará el expediente sancionador, y se entenderá la participación del poseedor en base a lo que dispone el artículo 11 de la citada ley. La renuncia debe presentarse en el Registro General del Ayuntamiento o en el registro auxiliar de la Policía Local, dirigidos a la Alcaldía e indicando sus datos personales, domicilio, fecha, número de decreto y matrícula del vehículo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Todo ello sin perjuicio de los débitos que se hayan contraído con la Hacienda Municipal u otros organismos oficiales a los que deberá hacer frente el titular del vehículo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Interposición de Recursos: &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la presente resolución que pone fin a la vía administrativa, cabe interponer, con carácter potestativo, recurso de reposición ante esta Alcaldía, de acuerdo con lo dispuesto en el Art. 116 de la ley 30/92, de 26 de noviembre, de régimen jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, según la redacción dada al mismo por la ley 4/99, de 13 de enero. El plazo para interponerlo es de UN MES a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto el de reposición.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El recurso de reposición potestativo deberá presentarlo en Registro General de este Ayuntamiento o en las dependencias a que se refiere el Art. 38.4º de la Ley 30/92, de 26 de noviembre, antes citada, y se entenderá desestimado cuando no se haya resuelto y notificada la Resolución en el término de UN MES, a contar del día siguiente a su interposición, quedando en este caso expedita la vía contencioso-administrativa.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De no utilizar el Recurso Potestativo de Reposición, cabe interponer directamente Recurso Contencioso-Administrativo, conforme a lo establecido en el artículo anteriormente citado, y a los artículos 45 y siguientes de la Ley 29/98, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa ante el Juzgado de lo Contencioso-Administrativo de las Islas Baleares, en el plazo de DOS MESES, a contar desde el día siguiente al de la recepción de la presente notificación.&lt;/span&gt;&lt;/p&gt;
