    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&amp;nbsp;&lt;span style="color: black"&gt;En relación con el asunto de referencia, y de acuerdo con el Anexo I de la ley 11/2006, de 14 de septiembre de evaluaciones de impacto ambiental y evaluaciones ambientales estratégicas en las Illes Balears, se comunica que el Pleno de la CMAIB, en sesión de 4 de junio de 2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;CONSIDERANDO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;1. Que el proyecto se inserta en el anexo I de la Ley 11/2006 de 14 de septiembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;2. Que el proyecto consiste en la construcción de una edificación en suelo rústico para instalar una bodega para producir vino de alta calidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;3. Que el proyecto se desarrolla en suelo rústico general en zona de vulnerabilidad de acuíferos moderada, afectado en parte por APR de erosión y por APR de incendios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;4. Que el Servicio de Aguas Superficiales de la DG de Recursos Hídricos informó en fecha 13 de marzo de 2013 desfavorablemente el proyecto por el hecho de que afectaba una vaguada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;5. Que el Subcomité de Evaluaciones de Impacto Ambiental acordó en fecha de 20 de marzo de 2013, no emitir informe del proyecto hasta que se aportara nueva documentación, la cual tenía que incluir alternativas de ubicación para evitar la afección a la vaguada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;6. Que el promotor solicitar la retirada del proyecto de la orden del día del Pleno y, posteriormente ha tenido entrada en la CMAIB nueva documentación para enmendar las carencias recogidas en el Acuerdo del Subcomité.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;7. Que en la nueva documentación presentada en fecha 30 de abril de 2013 se ha modificado el acceso a las instalaciones de la bodega, a requerimiento del Servicio de Aguas Superficiales de la DG de Recursos Hídricos, para evitar la afección a la vaguada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;8. Que en la mencionada documentación se indica que se emplearán los dos viales perimetrales existentes en la parcela para el acceso a la bodega.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;9. Que el Servicio de Aguas Superficiales de la DG de Recursos Hídricos ha emitido informe complementario favorable al respecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;10. Que la modificación de los accesos implica que éstos quedan afectados por APR de erosión y APR de incendios, mientras que el acceso previsto inicialmente por el curso de la vaguada no implicaba afección a estos APR.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;11. Que el Ayuntamiento de Manacor ha informado favorablemente con condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;12. Que la nueva documentación presentada da respuesta a los requerimientos del Subcomité técnico de 20 de marzo de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;13. Que la actividad pondrá en el mercado productos envasados y por lo tanto se tendrá que dar cumplimiento al art. 6 de Ley 11/1997 de 24 de abril de envases y residuos de envases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;14. Que la bodega tendrá una capacidad de producción de unas 315.000 botellas, y por lo tanto la actividad se encuentra catalogada como APCA puesto que se supera el umbral que establece el RD 100/2011, de 28 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;15. Que el proyecto supera el millón de euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;ACUERDA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;informar favorablemente el proyecto “Bodega en la finca es Fangar”, T.M. Manacor con las medidas correctoras y protectoras del estudio de impacto ambiental y las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Se tendrá que contratar un auditor ambiental de acuerdo con el artículo 54 de la Ley 11/2006 de 14 de septiembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;1. De acuerdo con el informe del Servicio de Estudios y Planificación de la D.G. de Recursos Hídricos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;I. Para evitar la pérdida de suelo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;a. Se tendrán que respetar siempre que sea posible las paredes secas existentes, así como mantenerlas en buen estado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;b. Los trabajos de construcción tendrán que suponer la deforestación mínima de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;c. En el caso de que la obra suponga dejar algún talud de tierra vegetal a descubierto, éste se tendrá que revegetar protegido por una estructura de pared seca o similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;II. El sistema de tratamiento de aguas residuales tendrá que cumplir los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;a. Tendrá que asegurar el siguiente rendimiento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;b. La concentración de nitratos del efluente de la depuradora tendrá que ser inferior a 50 mg/l.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;c. El efluente líquido tiene que ser utilizado para riego gota a gota o riego subsuperficial de forma que no se produzcan embalses ni infiltración hacia el acuífero. El sistema de riego estará dimensionado según los requerimientos hídricos de la superficie sembrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;d. En ningún caso se permitirá abocar el efluente líquido a un pozo de infiltración, zanja filtrante o directamente en el terreno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;e. Los contenidos en sales disueltas del efluente tendrán que ser inferiores a los del agua del acuífero. En cualquier caso nunca se podrán superar los 250 mg/l de ión cloruro y los 250 mg/l de ión sulfato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;3. De acuerdo con el informe del Servicio de Gestión Forestal y Protección del Suelo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;I. Se tendrán que cumplir las medidas de prevención durante la época de peligro de incendios forestales establecidas en el art. 8.2.c. del Decreto 125/2007, referentes a utilizar maquinaria y equipos, en terreno forestal y áreas contiguas de prevención, el funcionamiento de los cuales genere deflagración, chispas o descargas eléctricas susceptibles de provocar incendios forestales. Las obras se realizarán preferentemente fuera de la época de riesgo de incendios, es decir, por norma general entre el 16 de octubre y el 30 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;II. Se tendrá que disponer de un Plan de Autoprotección, según establece el Decreto 41/2005 (Infobal), aprobado por la Dirección General de Emergencias. Todos los trabajadores participantes en las actividades, tendrán que conocer el Plan de Autoprotección y serán instruidos en la existencia de riesgo de incendio forestal, en las medidas de prevención a adoptar, en las actuaciones inmediatas a efectuar ante un conato de incendio y conocerán el número telefónico de comunicación en caso de incendio forestal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;III. Se tendrá que instalar señalización de prevención de incendios forestales en la zona de estacionamiento y en las rutas de visitas que limite o esté en zona forestal, para recordar a los visitantes el riesgo de incendios existente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Se recuerda que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;1. En el caso que se realice ampliación o acondicionamiento de los caminos perimetrales, antes del otorgamiento de la Declaración de interés general se tendrá que contar con informe del Servicio de Gestión Forestal y Protección del Suelo de la D.G. de Medio Natural, Educación Ambiental y Cambio Climático, relativo al APR de incendios, y del Servicio de Estudios y Planificación de la D.G de Recursos Hídricos, relativo al APR de erosión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;2. De acuerdo con el art. 6 de la Ley 11/1997 de 24 de abril, de envases y residuos de envases la industria se tendrá que adherir a un sistema de depósito, devolución y retorno (SDDR) o a un sistema integrado de gestión (SIG) de residuos de envases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;3. De acuerdo con el art. 54 del PHIB, para la valorización de la materia orgánica en la finca será necesaria la autorización de la DG de Recursos Hídricos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;4. Se tendrá que solicitar a la Sección de Atmósfera del Departamento de Cambio Climático y Educación Ambiental la inscripción en el registro como APCA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;5. De acuerdo con el informe del Área de Medio Ambiente del ayuntamiento de Manacor:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-Se tendrá que dar cumplimiento a la Ordenanza reguladora de la limpieza viaria, recogida de residuos sólidos urbanos y gestión de los parques verdes de Manacor (BOIB núm. 25, 15/02/2007).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-Los residuos peligrosos generados por la actividad y durante la fase de construcción tendrán que gestionarse a través de un gestor autorizado y en ningún caso se podrán llevar al ECOPARC de Manacor o al Parque Verde de Porto Cristo, destinados a particulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-En cuanto a la gestión de los residuos objeto de recogida selectiva:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;a. Dado que es previsible que la actividad genere grandes cantidades de este residuo, el promotor tendrá que solicitar en el Ayuntamiento la inclusión en el listado de grandes generadores singulares cualificados, de acuerdo con el art. 53 y 54 de la Ordenanza reguladora de la limpieza viaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;En cualquier caso, la actividad tendrá que disponer en sus instalaciones de contenedores específicos para el almacenamiento de los residuos de vidrio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;b. Los residuos de papel y cartón podrán ser depositados en la compactadora de cartón del ECOPARC de Manacor. En caso de que la cantidad de residuos de cartón sea muy importante el promotor podrá solicitar al Ayuntamiento la inclusión en el listado de grandes generadores singulares cualificados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;c. En cuanto a los residuos de envases, siempre que por tipología y cantidades éstos sean asimilables a envases de origen doméstico, se podrán depositar en los contenedores de acera destinados a este residuo (color amarillo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Este acuerdo se emite sin perjuicio de las competencias urbanísticas, territoriales, etc, otras administraciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
