    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En relación con el asunto de referencia, y de acuerdo con la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se comunica que el Pleno de la CMAIB, en sesión de 4 de junio de 2013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;CONSIDERANDO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Que UTE GIREF S.A. ha solicitado la renovación de la AAI del vertedero de Ca Na Putxa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Que, para el otorgamiento de esta autorización se tiene que seguir la tramitación prevista en el artículo 25 de la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación y el artículo 7 del RD 509/2007, de 20 de abril, por el cual se aprueba el Reglamento para el desarrollo y ejecución de la Ley 16/2002.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Que en todos aquellos aspectos no regulados en la Ley 16/2002, de 1 de julio (art. 14) el procedimiento se ajustará a la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y Procedimiento Administrativo Común y la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, así como en el resto de disposiciones que le sean de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Que de acuerdo con el artículo 7 del RD 509/2007, de 20 de abril, por el cual se aprueba el Reglamento para el desarrollo y ejecución de la Ley 16/2002, la documentación ha sido sometida a información pública durante el plazo de treinta días con publicación en el BOIB núm. 20, de fecha 9 de febrero de 2013, no habiéndose presentado alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.Que en fecha 21 de marzo de 2013, se solicitó informe técnico al Ayuntamiento de Sta. Eulària des Riu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.Que la Sección de Contaminación Atmosférica emite de oficio informe de modificación de los condicionantes atmosféricos de la autorización ambiental integrada del vertedero de Ca Na Putxa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;ACUERDA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;informar favorablemente la renovación de la Autorización Ambiental Integrada del vertedero de Ca Na Putxa, con las condiciones de explotación, capacidad y procesos indicados en el proyecto técnico que acompaña la solicitud y con sujeción a las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Objeto: La presente AAI se concede a la empresa UTE GIREF S.A., única y exclusivamente para la realización de la actividad de vertedero de residuos no peligrosos, en las instalaciones del Consell Insular de Ibiza y Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Plazo: La Autorización se concede por un periodo de 8 años, transcurridos los cuales, a solicitud del interesado, podrá ser renovada y en su caso actualizada para periodos sucesivos. En cualquier caso el límite máximo de vigencia de la Autorización queda condicionado a la capacidad del vertedero con las condiciones recogidas en el expediente y en la presente resolución. Agotada la vida del vertedero, la continuidad de la actividad en el resto de instalaciones requerirá de la tramitación de la correspondiente autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.Desarrollo de la actividad: La instalación se ejecutará y la actividad se desarrollará según los documentos que obran en el expediente y lo establecido en la presente resolución, y en la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Modificaciones de la actividad: Cualquier modificación que se produzca en el desarrollo de la actividad tendrá que ser comunicada al órgano ambiental competente, el cual valorará el carácter de la modificación y si hace falta modificará la AAI para que se incluya la modificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Y en tal sentido se hacen las siguientes precisiones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Este vertedero tiene la consideració de vertedero de residus no peligrosos a los efectos del Real Decreto 1481/2001, de 27 de septiembre, en el cual se regula la eliminación de residuos mediante depósito en vertedero. &lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1 Estas cantidades se entienden como limitadoras teniéndose que considerar como una modificación sustancial a afectos de la Ley 16/2002 cuando exista una variación de más del 25% en uno de los tres grandes grupos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cada año, en función de la capacidad restante del vertedero y del histórico de vertidos, el promotor evaluará la vida útil restante del vertedero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A causa de que no hay datos de las cantidades reales de residuos sanitarios y animales, las cifras serán actualizadas en todo caso, con la remisión de información anual que exige el RD 1481/2001. Las cantidades que se reducen en el apartado anterior, se estima que serán aplicables al apartado de residuos urbanos mezclados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.3 Residuos peligrosos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los residuos peligrosos se gestionarán mediante gestor autorizado, priorizando alternativas como reutilización, reciclaje o valoración frente a la eliminación del residuo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El tiempo máximo de almacenamiento de los residuos peligrosos en la instalación antes de su entrega a un gestor será de seis meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el resto de aspectos referentes a la gestión de residuos: envasado, etiquetado, registro de las operaciones de gestión, notificaciones de traslado, documento de control y seguimiento, etc.., se cumplirá lo que establece la Ley 22/2011 de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el caso de desaparición, pérdida o escape de residuos peligrosos, la empresa tomará las medidas que correspondan para corregirlo e informará inmediatamente al servicio competente en materia de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.4 Control topográfico&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Durante la fase de explotación del vertedero, al levantamiento topográfico anual de la zona de relleno, se tiene que añadir:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Superficie afectada por residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Volumen de residuos depositados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Volumen de capas de tierra de cubierta intermedia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Estos estarán situados en 3 secciones: 2 en la sección inferior, 3 en la intermedia y 5 en la superior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se instalarán puntos de identificación externos de inestabilidad o rotura de las capas de sellado, la frecuencia de los cuales será la que aparece en la siguiente tabla:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En las instalaciones únicamente se admitirán los residuos que figuren en el condicionante 5.1, con los límites de cantidad expresados en el mismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para mejorar el control de entradas y el seguimiento de la trazabilidad de los residuos, se establecerá un documento de aceptación, con el objetivo de establecer previamente el volumen y el tipo de residuos que serán admitidos en las instalaciones. Todo el transporte de residuos que descargue en las instalaciones tendrá que tener el documento de control y seguimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La caracterización y pruebas de los residuos tendrá que basarse en la jerarquía de los tres niveles, establecida en el Real Decreto 1481/2001, de 27 de diciembre, por el cual se regula la eliminación de residuos mediante el depósito al vertido, y en la Decisión del Consejo, de fecha 19 de diciembre de 2002, por la cual se establecen los criterios y procedimientos de admisión de residuos a los vertidos según el artículo 16 y al Anexo II de la directiva 1999/31/CEE.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se tendrá que presentar la documentación sobre cada entrega admitida en el vertedero (art. 12.c). Si no se admiten se tiene que comunicar al servicio competente en materia de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.5.1 Residuos prohibidos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No se podrán admitir en el vertedero los siguientes residuos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Residuos ligeros susceptibles de verse movilizados por el viento, que se presenten sueltos, sin prensar y sin atar o adoptar otras medidas que evitan su movilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Residuos líquidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Residuos de carácter explosivos, corrosivos, oxidantes o inflamables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Residuos sanitarios (excepto grupo II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Cualquier otro no peligroso que no cumpla los requerimientos de admisión que se establece en el anexo II del RD 1481/2001.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Sólo podrán verterse los residuos que hayan sido objeto de cualquier tratamiento previo según lo que establece el art. 6.1 del RD 1481/2001.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.6 Programa Detallado de la Explotación&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Como medidas de explotación, además de las exigidas por la normativa sectorial, se contemplarán los siguientes aspectos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Medidas para evitar la movilización al vertedero de los elementos ligeros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Procedencia, tratamiento y manejo de las tierras de cubrimiento y sellado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Fase de explotación del vertido, así como las medidas de sellado y desgasificación después del agotamiento de cada una de las fases. El tratamiento de los gases generados en el vertedero se adaptará a la producción previsible en cada una de las fases, en función del balance de materia orgánica prevista.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El análisis geotécnico de estabilidad previo y la programación de estos análisis durante y después de la explotación del vertedero, así como las medidas de diseño en la explotación para garantizar la estabilidad y controlar los procesos erosivos a corto, medio y largo plazo, compatibles con la restauración y los usos del espacio detrás del sellado del vertido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El explotador tendrá que ejecutar un programa de control y vigilancia con un contenido mínimo durante la fase de explotación y comunicará cualquier incidencia a la autoridad competente (art. 13 a y b y art. 14.2 del RD 1481/2001) al Ayuntamiento de Sta. Eulària del Riu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.7 Registro&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El gestor de las instalaciones tendrá que disponer de un registro de entradas y salidas de los residuos donde como mínimo se indicarán los siguientes parámetros: fecha de entrada/salida, peso, origen/destino, nº de transportista autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El gestor tendrá que conservar durante un periodo no inferior a cinco años los documentos de aceptación de residuos, los documentos de control y seguimiento y el libro de registro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.8 Clausuras parciales&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La empresa comunicará el sellado de las celdas al órgano ambiental competente de esta Comunidad Autónoma con una antelación mínima de seis meses a la fecha prevista, adjuntando a dicha comunicación el Plan de Sellado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se tendrá que asegurar el mantenimiento post clausura de las celdas por un plazo no inferior a 30 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.9 Fianza del vertedero&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En cumplimiento del Real decreto de 1481/2001, de 27 de diciembre, que regula la eliminación de residuos mediante depósito en vertedero, en el plazo de seis meses a partir de la entrada en vigor del AAI, se tendrá que constituir una fianza para responder del cumplimiento de todas las obligaciones frente a la Administración que se deriven de su actividad, de una parte el sellado del vertedero y de la otra por el mantenimiento postclausura. Se podrá liberar una parte cuando se clausure y se haga la restauración ambiental, mientras que la de mantenimiento postclausura será liberada cuando hayan transcurrido 30 años desde la clausura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La siguiente tabla indica el cálculo de estas fianzas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En caso de detectar un valor inusual de alguno de los parámetros de control se tomará otra muestra, con réplica, en el mismo punto. La muestra se analizará en el laboratorio que hizo la primera analítica, la réplica en otro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se comunicará a la Dirección General de Recursos Hídricos en el plazo de 48 horas desde la recepción de los primeros resultados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Los técnicos de la Dirección General de Recursos Hídricos junto con el gestor de las instalaciones, diseñará un plan temporal de control para establecer la causa del valor y las posibles actuaciones que deben llevarse a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se consideran valores inusuales los que presenten una desviación de la media superior al 20%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Estas medidas se someterán a la aprobación del Órgano Ambiental Competente que, además, establecerá si la actividad puede funcionar y con qué condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.7 Vertidos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En cuanto al vertido de las aguas semi-limpias al cauce público, se hará un control trimestral para asegurar el cumplimiento del Real decreto 378/2001, BOE nº 96 de 21 de abril de 2001, del Plan Hidrológico de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7. Condicionantes de atmósfera&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.1 Prescripciones de carácter general&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La instalación tendrá que cumplir con lo que se establece en la Ley 34/2007, de 15 de noviembre, de calidad del aire y protección de la atmósfera, en el Real decreto 100/2011, de 28 de enero, por el cual se actualiza el catálogo de actividades potencialmente contaminadores de la atmósfera y se establecen las disposiciones básicas para su aplicación, así como toda la normativa de desarrollo que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.2 Identificación de focos emisores&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Según el anexo del Real decreto 100/2011, de 28 de enero, por el cual se actualiza el catálogo de actividades potencialmente contaminadoras de la atmósfera y se establecen las disposiciones básicas para su aplicación, la actividad está clasificada como Actividad Potencialmente Contaminadora de la Atmósfera del grupo B, código 09 04 01 02 “Vertederos de residuos industriales o no peligrosos, de residuos biodegradables así como vertederos no incluidos en el epígrafe anterior”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las emisiones a la atmósfera que se generan en la instalación son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.1 Control y límites de emisión&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente autorización se concede con los límites y condiciones técnicas que se establecen a continuación, a no ser que reglamentariamente se establezcan límites inferiores. Cualquier modificación de los límites y condiciones, tendrá que ser autorizada previamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.1.1 Control de emisiones no canalizadas&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Semestralmente se harán campañas de medida del biogas difundido a través de la capa de tierras del cubrimiento provisional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cada tres años se tiene que realizar una comprobación, por parte de un Organismo de Control Autorizado, de las medidas correctoras instaladas, de su eficacia y de su buen estado de funcionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Emisiones de partículas (polvo)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Con objeto de evitar la emisión difusa de polvo, se llevarán a cabo las medidas preventivas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Pavimentar y/o asfaltar la zona de acceso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Compactar la superficie de los viales del vertedero con grava o tierra apisonada y revisarla periódicamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Regar los viales con agua con la periodicidad necesaria para minimizar las posibles nubes de polvo, sobre todo durante el periodo comprendido entre los meses de mayo y septiembre en las zonas no pavimentadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Limpiar con la periodicidad necesaria los accesos, explanadas, acopios temporales, viales y umbrales tanto de material particulado como de materiales ligeros susceptibles de ser transportados por el viento y se llevará un registro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Cubrir o bañar con agua las cargas de material pulverulento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Limitar la velocidad de circulación de los vehículos por el interior de la planta a 20 Km/h.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Evitar realizar operaciones de carga y descarga y movimientos de materiales en momentos de viento fuerte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Establecer medidas correctoras para reducir las emisiones de elementos volátiles (bolsas, plásticos, papeles, etc.) y de partículas durante la trituración de los residuos voluminosos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Minimizar la altura de la descarga de los residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Realizar una compactación del vertido inmediatamente después de su depósito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Emisiones de olores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los focos de emisión de olores más relevantes son las emisiones fugitivas de biogas que se genera por la fermentación de los residuos orgánicos a través de la superficie del depósito y la gestión de los lixiviats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para prevenir la emisión de olores se llevarán a cabo, si procede, las medidas preventivas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Cubrir y compactar los residuos depositados de forma que la superficie expuesta a la atmósfera sea la mínima posible. Cubrir diariamente los residuos que se hayan depositado con una capa de tierra compactada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Extraer eficazmente el biogas generado en el vertedero a medida que se genere.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En cuanto a las balsas de lixiviados, éstas dispondrán de los elementos necesarios para garantizar una oxigenación suficiente y evitar la existencia de zonas anaeróbicas o estancadas generadoras de malos olores. En su defecto, y si existen molestias asociadas habrá que cubrir la balsa y conducir los gases hacia un sistema depurador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En caso de quejas por malos olores, se anotará la fecha y hora en un registro de conformidad en su punto 1.3.3 de este informe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se harán medidas cada tres años o cuando el órgano competente lo considere necesario, de las emisiones de olores según la norma UNE-EN 13725, por parte de un Organismo de control autorizado. A partir de las medidas de emisiones en las fuentes generadoras de olores, se simulará la dispersión de las unidades de olor aplicando modelos matemáticos de simulación de la dispersión. Las medidas se procurarán hacer entre los meses de mayo y septiembre. En función de los resultados y en caso necesario, se aplicarán medidas preventivas y correctoras adicionales para el control de olores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.1.2 Control de emisiones canalizadas&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a.Antorcha sin valorización energética de biogas (FC1)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La medida y evaluación de las emisiones se tiene que hacer según lo que dispone el Real decreto 1481/2001, de 27 de diciembre, por el que se regula la eliminación de residuos mediante depósito a vertedero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las medidas se tienen que realizar en condiciones representativas del sistema de extracción del biogas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por lo tanto, se tienen que realizar los controles periódicos de gases durante la fase de explotación y durante la fase de mantenimiento posterior a la clausura según la tabla siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3 Los focos emisores FC2 y FC3, no asignados a ningún grupo, si bien no están sujetos a controles periódicos, tienen que cumplir los valores límite de emisión indicados en la tabla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c.Condiciones generales en los focos canalizados:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los accesos y plataformas de trabajo en los puntos de muestreo tendrán que cumplir con la normativa vigente por la cual se establecen las condiciones mínimas de seguridad y salud en los puestos de trabajo. Los puntos de muestreo tienen que ser accesibles en cualquier momento para poder realizar las medidas e inspecciones pertinentes y se tiene que disponer de sistemas automáticos para la subida de equipos de análisis y material auxiliar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El método de medida para cada contaminante será preferiblemente el UNE-EN; en caso de que no se pueda aplicar se tendrá que justificar la utilización de otros métodos, que serán, por este orden: EN, UNE-ISO y otros métodos internacionales. Siempre que se publiquen nuevas normas que sustituyan las indicadas, se aplicarán las más recientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.1.1 Registro&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la instalación tendrá que mantener actualizado un registro con datos de las emisiones, paradas, tareas de mantenimiento, incidencias, controles, inspecciones y cualquier otro tipos de operación diferente del funcionamiento normal, para cada foco emisor, de acuerdo con lo dispuesto en el artículo 8 del Real decreto 100/2011. La información documental (informes, medidas, mantenimiento...) se tiene que conservar un periodo mínimo de 10 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.2 Inmisiones o calidad del aire&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se tienen que realizar campañas semestrales de partículas PM10 en 3 puntos en los alrededores de la zona del vertedero, con un mínimo de 3 muestras válidas de cada punto (9 mínimas por campaña) . El plan de campaña tiene que disponer de la aprobación del departamento competente en materia de contaminación atmosférica, que podrá establecer la medida de H2S, COV y/o CH4 de acuerdo con los datos de los registros de emisiones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.5 Normativa municipal&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se cumplirán los siguientes artículos de las Normas Particulares del Ayuntamiento de Santa Eulària del Riu, relativas a la protección de la atmósfera ante la contaminación por formas de la materia y normas particulares relativas a la protección de la atmósfera ante la contaminación por formas de energía:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Arts. 8-11 del Título II.- Normas Particulares relativas a la protección de la atmósfera ante la contaminación por formas de la materia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Arts. 98-104 del Título III.- Normas Particulares relativas a la protección de la atmósfera ante la contaminación por formas de energía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8. Seguridad industrial&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.1 Plan de autoprotección&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad tendrá que disponer del preceptivo plan de autoprotección registrado en la Dirección general competente en materia de Emergencias e implantado en la totalidad de las instalaciones y procesos que conforman la actividad, indicadas en el punto 1 de la presente Autorización. El Plan de autoprotección estará redactado y firmado por un técnico competente, en conformidad con lo que determina el artículo 13 del decreto 8/2004, y se ajuste al índice de contenidos que dispone el Decreto 8/2004, de 23 de enero, por el que se desarrollan determinados aspectos de la Ley de Ordenación de Emergencias en las Illes Balears (BOIB núm. 18 de 5 de febrero de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.2 Seguridad industrial&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad tendrá que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Inscribir las instalaciones correspondientes de la Dirección general de Industria, según las normativas vigentes de seguridad industrial, minera, etc… Las instalaciones previstas o existentes tienen que cumplir con la legislación vigente en materia de industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Revisar la inscripción en el Registro Industrial, y obtener el Documento de Calificación Empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Dar cumplimiento al Reglamento por la supresión de las barreras arquitectónicas (Decreto 20/2003) en todo lo que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Prevenir los riesgos laborales y velar por la salud y seguridad de los trabajadores, y éstos el deber de cumplir las medidas de prevención que se adopten, según lo establecido en la ley estatal 31/95 de prevención de los riesgos laborales. Las condiciones de trabajo se tendrán que ajustar a lo establecido en las disposiciones específicas y reglamentarias en materia de seguridad laboral. Teniendo que poner especial atención en el cumplimiento del RD 374/2001 sobre protección de los trabajadores contra los riesgos relacionados con los agentes químicos durante el trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Hacer cumplir en los edificios de carácter industrial las prescripciones de protección contra incendios indicadas en el Real decreto 2267/2004, de 3 de diciembre, por el que se aprueba el Reglamento de Seguridad contra incendios en los establecimientos industriales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por otro lado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Las instalaciones de protección contra incendios y su mantenimiento se tendrán que ajustar a lo dispuesto en el Reglamento de instalaciones de protección contra incendios (RD1942/1993) y normas UNE correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El almacenamiento de productos químicos se tendrá que adaptar al RD 379/2001, de 6 de abril, por el cual se aprueba el Reglamento de almacenamiento de productos químicos, y sus instrucciones técnicas complementarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El almacenamiento de productos petrolíferos se tendrá que adaptar a lo que dispone el RD 2085/1994 por el que se desarrolla el Reglamento de instalaciones de productos petrolíferos, así como sus posteriores modificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.3 Contaminación acústica&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se efectuará una campaña anual de caracterización real de los niveles de ruido emitidos al exterior durante las diversas fases típicas de la operación en horario nocturno y diurno, para la comprobación del cumplimiento de los límites establecidos en la normativa vigente en esta materia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.4 Contaminación lumínica&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se cumplirá con lo que establece la Ley 3/2005 de 20 de abril, de protección del medio nocturno de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.5 Control de vectores&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Hay que acreditar un sistema de control de la gaviota común (Larus michahellis) para evitar la proliferación de su presencia en la zona del vertedero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En cuanto al control de otros vectores (insectos, ratas, gatos, .), en el caso de la utilización de productos tóxicos (veneno), se tendrán que adoptar y acreditar las medidas adecuadas para evitar cualquier afección sobre el resto de especies silvestres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9. Controles periódicos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.1 Control periódico de las instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En cualquier momento, la Consejería de Agricultura, Medio Ambiente y Territorio podrá realizar visita de comprobación y certificar la idoneidad de las instalaciones y el mantenimiento de las condiciones iniciales que han dado lugar al AAI, así como el cumplimiento de las prescripciones técnicas aplicables en virtud de la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Periódicamente se realizarán visitas de comprobación a las instalaciones por parte de los técnicos de la Consejería de Agricultura, Medio Ambiente y Territorio, para comprobar el cumplimiento de los requisitos del AAI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.2 Inventario de emisiones en el Registro PRTR&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular tendrá que enviar los datos sobre cantidades de contaminantes emitidos, anualmente, en aplicación de lo dispuesto en el Reglamento 166/2006 (PRTR), de 18 de enero, del Parlamento Europeo, que establece un registro europeo de emisiones y transferencia de contaminantes, y por el RD 508/2007. Estas emisiones serán enviadas, para su evaluación previa, a la Consejería de Agricultura, Medio Ambiente y Territorio adjuntando una memoria explicativa de la metodología empleada para la determinación de los datos notificados antes de ser incorporadas en el registro informático PRTR-España. Las cantidades de contaminantes serán medidas, calculadas o estimadas, preferentemente por este orden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estos datos tienen que comprender las emisiones del vertedero actual y su ampliación (al menos CH4 y CO2), así como las emisiones producidas por el tráfico de vehículos y vertido del material (gases de combustión y partículas PM10).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.3 Control documental&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.3.1 Control documental periódico&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estos son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informes semestrales de emisión de contaminantes en la atmósfera de la antorcha de biogas y del biogas difuso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informes semestrales de las campañas de inmisiones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informe cada tres años sobre control de medidas correctoras para minimizar emisiones difusas de partículas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informes de olores, mínimo cada tres años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los informes realizados por un Organismo de control autorizado (OCA), de acuerdo con lo dispuesto en el Decreto 104/2010, de 10 de septiembre, y en el Real decreto 100/2011, de 29 de enero, serán enviados por parte de la OCA al departamento competente en materia de contaminación atmosférica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.3.2 Informe anual&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad enviará, antes del 1 de marzo, al órgano ambiental encargado de tramitar el AAI un informe del periodo precedente en el que se incluirá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Residuos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La declaración anual de residuos de acuerdo con lo que dispone el artículo 41.1 de la Ley 22/2011 y el artículo 18 del RD 833/1988. Esta memoria tiene que contener, al menos, referencias suficientes de las cantidades y características de los residuos gestionados, su procedencia y destino, la relación de aquellos que se encuentran almacenados así como las incidencias relevantes que hayan tenido lugar el año anterior, la capacidad restante del vertedero y el cálculo de la vida útil del mismo. La entidad explotadora tiene que conservar, en el lugar donde realiza la actividad, copia de la memoria anual durante cinco años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Declaración anual de residuos peligrosos, en la que se indique para cada residuo la cantidad almacenada a comienzo y final de año, así como la cantidad producida y gestionada al año al que corresponda la declaración anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Control topográfico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Plan de relleno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Emisiones e inmisiones atmosféricas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Un mapa detallado señalando las áreas de explotación, las cubiertas, las captaciones de biogas y las cañerías instaladas, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Un resumen de los resultados de todos los controles internos o autocontroles realizados durante el año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Información sobre los valores del caudal de biogas enviado a la antorcha y el tiempo de funcionamiento de la antorcha, del caudal total generado así como de las quejas por olores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Memoria explicativa de la metodología utilizada para la determinación de los datos notificados antes de ser incorporadas en el registro informático PRTR-España.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Emisiones e inmisiones en el medio hídrico: se remitirá un informe sobre actividad con los datos elaborados y que como mínimo contemple lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Datos meteorológicos diarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Mediciones del volumen de lixiviados generados en cada área del complejo y volumen total diario llevado a depuradora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Mediciones del nivel de los piezómetros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Análisis de la composición de aguas y lixiviados realizados durante el periodo anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+ Ruidos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Informe anual en el que se remitirán los controles de emisiones de ruidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Con carácter general&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Otros controles realizados durante el año y medidas adoptadas para minimizar impactos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Análisis y justificación de las instalaciones en relación a las mejores técnicas disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Todo lo realizado anualmente dentro del programa de control y seguimiento del programa de explotación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Actualización del estudio económico (mínimo cada 4 años)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Los datos exigidos por el RD 508/2007 y Reglamento (CE) 166/2006, de 18 de enero, se tendrán que comunicar telemáticamente al Registro informático PRTR-España, dentro de los plazos que correspondan, de forma anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El órgano ambiental encargado de tramitar las AAI enviará a cada Dirección general o administración competente la documentación de la que tenga competencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Toda la información que sea susceptible de tratamiento informático se aportará en papel y en formato informático estándar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;10. Obligaciones del titular&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad estará obligado a cumplir con las obligaciones establecidas en el artículo 5 de la Ley 16/2002, de 1 de julio, y en especial:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Asumirá todos los condicionantes recogidos en la presente Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Mantendrá el correcto funcionamiento de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Comunicará al órgano ambiental competente cualquier incidencia que afecte a la actividad con repercusión ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por otro lado, el titular queda sometido al cumplimiento de la Ley 26/2007, de 23 de octubre, de responsabilidad ambiental, y a sus desarrollos reglamentarios, para prevenir, evitar y reparar los daños medioambientales provocados por su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;11. Carácter de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Esta Autorización Ambiental Integrada se otorga sin perjuicio de terceros y sin perjuicio de las demás autorizaciones y licencias que sean exigibles por el ordenamiento jurídico vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;12. Causas de extinción.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Son causas de extinción de la AAI:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La extinción de la personalidad jurídica de la empresa UTE GIREF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La declaración de quiebra de la empresa UTE GIREF cuando la misma determine su disolución expresa como consecuencia de la resolución judicial que la declare.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La inactividad de gestión de residuos, durante un periodo superior a un año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-La no concesión de prórroga de la Autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;13. Modificación de las condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El órgano ambiental competente, en conformidad con el artículo 26 de la Ley 16/2002, podrá modificar las condiciones de control ambiental de la explotación señaladas a la presente Resolución, o determinar medidas complementarias que se consideren convenientes para la adecuación o mejora de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
