    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Acordado por este Ayuntamiento en Pleno, en sesión ordinaria celebrada el 1 de julio de 2013, se aprueba la modificación de la &lt;strong&gt;ORDENANZA &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;FISCAL REGULADORA DE LA TASA PARA LA PRESTACIÓN DE SERVICIOS Y UTILIZACIÓN DE LAS INSTALACIONES DEPORTIVAS MUNICIPALES&lt;/strong&gt;&lt;span style="color: black"&gt;. Y realizada la legal exposición al público sin haber presentado durante el tiempo de exposición ninguna reclamación, sugerencias, de conformidad con lo dispuesto en el artículo 17-3 del Real Decreto 2/2004 de 5 de marzo del Texto Refundido de la Ley Reguladora de las Haciendas Locales, se considera definitivamente aprobado, transcribiendo a continuación el texto completo de la ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra el presente acuerdo definitivo de modificación de la referida ordenanza fiscal, los interesados podrán interponer recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Islas Baleares, en el plazo de dos meses contados a partir del día siguiente al de la publicación del presente acuerdo en el B.O.I.B.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;TEXTO DE LA ORDENANZA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ORDENANZA &lt;/span&gt;FISCAL REGULADORA DE LA TASA PARA LA PRESTACIÓN DE SERVICIOS Y UTILIZACIÓN DE LAS INSTALACIONES DEPORTIVAS MUNICIPALES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 1. Fundamento y naturaleza&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De acuerdo con el previsto en los artículos 20.4- o) del Real Decreto Legislativo 2/2004 de 5 de marzo del Texto Refundido de la Ley Reguladora de las Haciendas Locales, de conformidad con lo que disponen los artículos 15 a 19 de dicho texto legal, este Ayuntamiento establece la tasa por la prestación de servicios en las instalaciones deportivas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 2. Hecho imponible&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El hecho imponible está determinado por la utilización de las distintas instalaciones o servicios existentes a los recintos deportivos de propiedad municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 3. Obligación de contribuir.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;. - La obligación de contribuir nace como consecuencia de la entrada de los usuarios en las instalaciones deportivas de propiedad municipal, así como por la utilización de sus diferentes servicios.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 4. Sujeto pasivo&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Están obligados al pago de esta tasa, las personas naturales usuarias de los distintos servicios, o que soliciten la entrada al recinto deportivo municipal.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 5. Responsables.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Serán responsables, solidarios o subsidiarios, de las obligaciones tributarias del sujeto pasivo, las personas físicas y jurídicas a que se refieren los artículos 38.1, 39 y 40 de la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 6. Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La cuantía de la tasa regulada en esta Ordenanza será la fijada en la tarifa contenida en el siguiente apartado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La tarifa de esta tasa será la siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Regidor Delegado de Deportes, tiene facultad para expedir carnés de abonados para el uso de las instalaciones, las cuales podrán tener carácter, individual y/o juvenil. La expedición de los mencionados documentos importará las siguientes cuotas anuales:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Tener el mencionado carné dará derecho a su titular para entrar libremente en todas las instalaciones, y al uso de los servicios que no estén expresamente ocupados. Los unideportivos darán derecho a realizar el deporte por el que se haya abonado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El carné de abono será personal e intransferible. A tal efecto el carné contendrá, los datos personales mínimos, el nombre y apellidos y una fotografía reciente del abonado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Por actividades extraordinarias, (como uso no deportivo de las instalaciones) la Alcaldía resolverá en cada caso, teniendo en cuenta sus especiales características.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A las tarifas de la presente ordenanza, se entiende el IVA incluido cuando legalmente proceda su aplicación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Las liquidaciones de la Tasa en las solicitudes de uso colectivo, formuladas por estos o por sus representantes podrán ser objeto de liquidación mediante concierto. Atendiendo por la determinación de las tarifas, a los plazos de tiempos y al periodo del año, al cual se interesen para el uso de las instalaciones&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 7.º Exenciones .&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Restan exentos, excepto los sábados y los domingos que abonarán el 50% de las tarifas. El Ayuntamiento se reserva el derecho de decidir en el supuesto de torneos:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;-&amp;nbsp; La Asociación de Tenistas de Valldemossa, previo acuerdo con la Regiduría de Deportes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- El resto de asociaciones deportivas inscritas en Valldemossa, previo acuerdo con la Regiduría de Deportes&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Restan exentos los disminuidos físicos y/o psíquicos, previo informe del Servicio de Acción Social, así como las personas recomendadas por dicho Servicio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 8.º Cobro de las tarifas&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El cobro se efectuará mediante talonarios numerados que serán entregados por la Tesorería, mediante el cargo pertinente a las personas encargadas de la vigilancia y custodia de las instalaciones. Dichas personas tendrán que efectuar el ingreso de las cuotas recaudadas quincenalmente o en un plazo de tiempo inferior, si así lo exige la Tesorería. El importe del abono se hará efectivo mediante el ingreso en la Tesorería de este Ayuntamiento, y con el resguardo de dicho ingreso se expedirá el carné de abonado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Artículo 9.º Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Las infracciones y sanciones en materia tributaria se regirán por lo dispuesto en la Ley General Tributaria, su normativa de desarrollo y la Ordenanza General de Gestión.”&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Disposición final&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta ordenanza entrará en vigor y empezará a aplicarse el día de su publicación en el BOIB, quedando en vigor hasta su modificación o derogación expresa.&lt;/span&gt;&lt;/p&gt;
