&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El Pleno del Consejo Insular de Formentera, en sesión ordinaria celebrada el 28 de junio de 2013, aprobó definitivamente la modificación de la ordenanza reguladora del área de mercado payés y del área de artesania del centro Antoni Tur “Gabrielet”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Considerándose aprobada definitivamente de conformidad con el article 102.d) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, se publica texto integro refundido tal y como dispone el artículo 103.1) de la citada ley, a los efectos de su entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;ORDENANZA REGULADORA DEL ÁREA DEL MERCADO PAYÉS Y DEL ÁREA DE ARTESANIA DEL CENTRO ANTONI TUR “GABRIELET”.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El Consejo Insular de Formentera aprueba definitivamente la ORDENANZA REGULADORA DEL ÁREA DE MERCAT PAGÈS Y DEL ÁREA DE ARTESANIA DEL CENTRO ANTONI TUR ‘GABRIELET’, en sesión plenaria celebrada el pasado 28 de junio de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Considerándose aprobada definitivamente de conformidad con el articulo 102.d) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, se publica el texto íntegro refundido tal y como dispone el articulo 103.1) de la nombrada ley, a los efectos de su entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;‘ORDENANZA REGULADORA DEL ÁREA DEL MERCAT PAGÈS Y DEL ÁREA DE ARTESANIA DEL CENTRO ANTONI TUR ‘GABRIELET’’&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Exposición de motivos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El Estatuto de Autonomía de las Islas Balears, aprobado por la Ley orgánica 2/1983, de 25 de febrero y modificado por la Ley orgánica 1/2007, de 28 de febrero, en su articulo 10.13 establece la competencia exclusiva de la Comunidad Autónoma de les Islas Balears en materia de artesanía. En virtud de esta competencia se aprobó la Ley 4/1985, de 3 de mayo, de ordenación de la artesanía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Mediante la Ley 8/1999, de 12 de abril, se traspasaron las competencias de agricultura, ganadería, pesca y artesanía al Consejo Insular de Menorca y al de Ibiza y Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La asunción de competencias del Gobierno de las Islas Baleares en materia de actividad comercial ha quedado plasmada en la aprobación de la Ley 11/2001, de 15 de junio, modificada por la Ley 8/2009, de 16 de diciembre, de ordenación de la actividad comercial a las Islas Baleares por la transposición de la Directiva 2006/123/CE del Parlamento Europeo y del Consejo, de 12 de diciembre de 2006, relativa a los servicios del mercado interior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Esta ley 11/2001, de 15 de junio, exige que el dinamismo de las diversas modalidades de la venta ambulante quede reflejado en las ordenanzas municipales que regulen esta actividad, la cual cosa queda reflejada en el su título VII, en el apartado de ventas especiales, cosa que permite al Consejo Insular de Formentera (de ahora en adelante, CIF) pronunciarse sobre el modelo de ventas que considera que ha de completar la actividad comercial que se desarrolla en establecimientos permanentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La apertura del Centro Antoni Tur ‘Gabrielet’ ha supuesto una apuesta clara para fomentar la artesanía y los productos alimentarios elaborados siguiendo procedimientos tradicionales. La naturaleza de estas instalaciones, divididas en dos espacios claramente diferenciados como son el mercado payés y el área de artesanía, hace necesaria la existencia de una regulación específica de cada una de estas áreas, además del reglamento general que rige la totalidad del centro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;TÍTULO I&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;ÁREA DEL MERCADO PAYÉS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 1. Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Este apartado de la Ordenanza, desarrolla la venta ambulante del mercado payés del Centro Antoni Tur ‘Gabrielet’, ubicado en la avenida Porto-salè, Sant Francesc Xavier, Formentera, y tiene por objeto incorporar un valor añadido de la comercialización de los productos agrarios, de origen animal, pesqueros y de las salinas de Formentera que se venden, con la finalidad de mejorar la estructura agraria, ganadera y pesquera, así como el entorno natural existente en la isla, orientada a obtener una renta digna para el productor y precios justos para las personas consumidoras. De esta forma, se estabilizan las explotaciones tanto agrarias como ganaderas y pesqueras, viables y sostenibles, y se permite la permanencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 2. Definición de la venta ambulante&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Se considera como venta ambulante aquella que se efectúa por comerciantes fuera de un establecimiento comercial permanente, cualquiera que sea su periodicidad y el lugar donde se celebre, y que solo se podrá llevar a cabo en las condiciones que señala la Ley 11/2001, de 15 de junio, modificada por la Ley 8/2009, de 16 de diciembre, de reforma de la Ley 11/2001, de 15 de junio, de ordenación de la actividad comercial en las Illes Balears para la transposición de la Directiva 2006/123/CE del Parlamento Europeo y del Consell, de 12 de diciembre de 2006, relativa a los servicios del mercado interior, el Real decreto 199/2010, de 26 de febrero y esta ordenanza, sin perjuicio de lo que establece el resto de la normativa aplicable y en especial la reguladora de cada producto; resta prohibida toda venta que no se ajuste a las citadas normativas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 3. Horario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El mercado payés abrirá martes, jueves i sábados de 9 a 13 horas. Este horario podrá ser modificado según lo establecido en el articulo 7 del Reglamento de uso del Centro Antoni Tur ‘Gabrielet’.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 4. Instalaciones y mobiliario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Para la venta ambulante en el mercado payés se hará servir el mobiliario que se especifica a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Mesas de color blanco, que ocupen una superficie de 1,60m de larga por 0,80m de ancha, los cuales serán aportados por el propio Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las dimensiones de las paradas se tendrán que limitarse a las mesas. Los elementos y/o mercaderías colgadas no podrán sobresalirse mas allá del ancho del espació autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las cajas donde se expondrá la mercadería para la venta, serán monocolor-blanco, apilables y con unas dimensiones de 600x400x200mm y llevaran el escudo del Consejo Insular de Formentera. Estas, y los elementos de madera que las apuntala, serán aportadas por el propio Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 5. Acceso al mercado&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La entrada en el recinto del mercado payés se efectuara con suficiente antelación a la hora de la apertura, para que todas las paradas estén montadas antes de la llegada del público. El montaje y el desmontaje irá a cargo de los titulares o autorizados de las paradas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;No se permitirá el acceso al mercado payés de personas relacionadas con las paradas fuera de horarios de montaje i recogida previstos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 6. Organización&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Corresponde al área competente en materia de agricultura, ganadería y pesca, delimitar las paradas dentro de la zona señalada como mercado payés en el edificio del Centro Antoni Tur ‘Gabrielet’, suspender la organización del mercado para una fecha concreta cuando por razones de seguridad u orden público que justifique la medida, así como el establecimiento de los criterios de adjudicación de las paradas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;También corresponderá a la misma área, la elevación de la correspondiente propuesta al órgano competente para el otorgamiento de las autorizaciones para ocupar el lugar de vendedor en este mercado payés, siempre que no se haya constituido la Comisión de valoración y seguimiento, mencionado en el artículo 16 de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 7. Autorizaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;7.1 Autorizaciones anuales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Podrán ser autorizados para acceder a un puesto de venta en el mercado que se regula en esta Ordenanza, las personas físicas, jurídicas y cooperativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Las personas interesadas en la práctica de la venta ambulante en este mercado campesino, deberán presentar una solicitud (instancia), mediante un impreso normalizado y firmado por éstos, la que debe dirigirse al Registro General del Consejo Insular de Formentera, ubicado en la Oficina de Atención Ciudadana (OAC), o en cualquier otro lugar, de conformidad con lo establecido en el artículo 38 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y procedimiento administrativo común, entre el 1 de enero y el 30 de marzo de cada año natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Junto a esta instancia, la persona interesada deberá presentar una declaración jurada en la que se manifieste:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) El cumplimiento de los requisitos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) El mantenimiento de su cumplimiento durante todo el plazo de vigencia de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El contenido de esta declaración responsable comprenderá, además, la siguiente documentación, mediante la presentación de originales o fotocopias compulsadas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Datos de la persona interesada&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Dos fotografías tipo carnet&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Copia del DNI, NIE o pasaporte,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Justificante de estar dado de alta en el IAE y al corriente de pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Justificante de la Agencia Tributaria de estar al corriente de impuestos y justificante de la Seguridad Social de estar al corriente de cotizaciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Certificado de estar al corriente en el pago con el Consejo Insular de Formentera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- En el caso de extranjeros no miembros de la CEE, se deberá acreditar, además, el hecho de estar en posesión de los permisos de residencia y trabajo correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Los titulares que deseen tener un autorizado a la parada, deberán presentar los contratos de trabajo y los deberán tener de alta en el régimen general de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Figurar en el registro general de explotaciones agrarias de las Islas Baleares (RGEAIB), por productos agrarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Figurar en el registro general de explotaciones ganaderas de las Islas Baleares (REGA), por productos ganaderos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Memoria explicativa de los productos que se pretenden vender. Los solicitantes que hayan recibido licencia de venta en temporadas anteriores, y sigan venden el mismo tipo de productos, podrán sustituir la aportación de esta Memoria, manifestando en la misma declaración responsable que se sigue con la venta de la misma tipología de productos y estilo del año anterior. En caso contrario, se deberá aportar una nueva Memoria explicativa de los nuevos tipos de productos que se pretenden vender.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;7.2 Autorizaciones diarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Podrán ser autorizados para acceder a un puesto de venta en el mercado que se regula en esta Ordenanza, las personas físicas, jurídicas y cooperativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Las personas interesadas en la práctica de la venta ambulante en este mercado campesino, deberán presentar una solicitud (instancia), mediante un impreso normalizado y firmado por éstos, la que debe dirigirse a la Consejería de Agricultura, Ganadería y Pesca del Consejo Insular de Formentera, dos días antes del día que se pretende ir a vender.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Junto a esta instancia, la persona interesada deberá presentar una declaración jurada en la que se manifieste:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) El cumplimiento de los requisitos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El contenido de esta declaración responsable comprenderá, además, la siguiente documentación, mediante la presentación de originales o fotocopias compulsadas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Datos de la persona interesada&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Copia del DNI, NIE o pasaporte,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Justificante de la Agencia Tributaria de estar al corriente de impuestos y justificante de la Seguridad Social de estar al corriente de cotizaciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Certificado de estar al corriente en el pago con el Consejo Insular de Formentera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- En el caso de extranjeros no miembros de la CEE, se deberá acreditar, además, el hecho de estar en posesión de los permisos de residencia y trabajo correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Figurar en el registro general de explotaciones agrarias de las Islas Baleares (RGEAIB), por productos agrarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Figurar en el registro general de explotaciones ganaderas de las Islas Baleares (REGA), por productos ganaderos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Memoria explicativa de los productos que se pretenden vender. Los solicitantes que hayan recibido licencia de venta en temporadas anteriores, y sigan venden el mismo tipo de productos, podrán sustituir la aportación de esta Memoria, manifestando en la misma declaración responsable que se sigue con la venta de la misma tipología de productos y estilo del año anterior. &lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Artículo 8. Acreditaciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;8.1 Acreditaciones para autorizaciones anuales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Una vez concedida licencia de autorización, se entregará al vendedor un documento acreditativo de la misma, y carnets personales para los vendedores, cuya validez queda condicionada al pago de la tasa que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Las personas que estén a cargo de la venta deberán tener, en lugar bien visible, el carné que las acredite como autorizadas para vender por el CIF, con su fotografía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Los vendedores deben estar siempre presentes en su lugar. En caso de ausentarse, la autoridad competente podrá exigir la justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Será determinante para renovar la licencia estar al corriente de los débitos municipales para este concepto y no encontrarse incurso en expediente disciplinario en la materia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;8.2 Acreditaciones para autorizaciones diarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Una vez concedida licencia de autorización y el pago de la tasa, se entregará al vendedor un documento acreditativo de estar autorizado a vender al día indicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Las personas que estén a cargo de la venta deberán tener, en lugar bien visible, el documento acreditativo como autorizadas para vender por el CIF.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Los vendedores deben estar siempre presentes en su lugar. En caso de ausentarse, la autoridad competente podrá exigir la justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 9. Extinción de las licencias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1. Las licencias se extinguirán cuando se de alguno de los supuestos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;a) Jubilación del titular&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;b) Muerte del titular&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;c) Incapacidad permanente del titular&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;d) Renuncia&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;e) Revocación&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;g) Extinción del plazo de la licencia de venta&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;h) Darse de baja de IAE, en caso de autorizaciones anuales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;i) Abandono del lugar indefinidamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 10. Obligaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las personas autorizadas para vender en el mercado deberán de cumplir, además de las obligaciones que se deriven de los artículos anteriores, las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- Tener expuesto al público con bastante notoriedad los precios de venta de los productos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- Tener la pertinente autorización del Consell Insular de Formentera y satisfacer las tasas que establece al efecto la correspondiente ordenanza fiscal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- El vendedor ambulante está obligado a colocar un cartel bien visible, en el lugar de venta, en el cual deberá de constar la dirección donde se podrán atender las reclamaciones de los consumidores. También deberá de figurar en las facturas o comprobantes de venta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- Los titulares de paradas dejaran limpios de restos los lugares ocupados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- No se podrán situar en tierra artículos de ninguna manera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- No se podrán vender otros artículos que los que figuren en la autorización del CIF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- En ningún caso podrá utilizarse más de una instalación para licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- No se podrán utilizar equipos de megafonía y equipos de música.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- No se permitirá hacer propaganda o publicidad abusiva de ninguna manera, que atente a los otros, tanto escrita como auditiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;- No se permitirá la venta de productos después de la hora de finalización del mercado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 11. Inspección&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La autoridad competente que se determine llevara a cabo la vigilancia necesaria con el objetivo que los titulares/autorizados de las licencias observen las normas que regulan esta actividad de venta ambulante, tanto las de carácter general, especialmente las exigencias y condiciones higiénico-sanitarias, como las específicas que se recojan en esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 12. Órganos de representación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Los titulares de la licencia anual de autorización del mercado payés se podrán constituir en asociación de venta y podrán designar en consecuencia un representante que será el interlocutor valido delante del CIF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 13. Procedimiento de selección&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El procedimiento para el otorgamiento de la autorización para el ejercicio de la venta ambulante será el determinado por el Consejo Insular de Formentera, respetando, en todo caso, el régimen de concurrencia competitiva, así como las previsiones contenidas en los artículos 86 y siguientes de la Ley 33/2003, de 3 de noviembre, de patrimonio de las administraciones públicas, así como del capítulo II de la Ley 17/2009, de 23 de noviembre, sobre el libre acceso a las actividades de servicio y su ejercicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El procedimiento será público y su tramitación deberá desarrollarse conforme a criterios claros, sencillos, objetivos y predecibles. En la resolución del procedimiento se fijarán los requisitos de la autorización, que deberán ser necesarios, proporcionales y no discriminatorios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El Consejo priorizará las autorizaciones anuales sobre las diarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El procedimiento para seleccionar las autorizaciones diarias será por riguroso orden de entrega de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 14. Lista de espera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;En el caso de que haya lista de espera para autorizaciones anuales, las solicitudes se valorarán según los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Que consten inscritos en el Registro balear de operadores de Producción Integrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Que consten inscritos en el Registro del Consejo balear de la producción agraria ecológica (CBPAE).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;En el caso de que las solicitudes sean superiores a las plazas ofertadas, las autorizaciones se adjudicarán según riguroso orden de entrada en el Registro General del Consejo&amp;nbsp; Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;En el caso de las autorizaciones diarias, no existirá lista de espera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 15. Vacantes temporales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;En el caso de que surjan vacantes temporales en las paradas con autorizaciones anuales, el adjudicatario deberá comunicarlo previamente al Consejo Insular de Formentera, y se podrán cubrir durante el período de vacaciones para las personas que consten en la lista de espera mencionada en el artículo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 16. Comisión de seguimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En caso que se considere necesario, podrá constituirse una Comisión de valoración y seguimiento, con carácter consultivo, la función de la cual será, entre otras, elaborar la propuesta de adjudicación de las autorizaciones previstas en esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 17. Régimen sancionador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las infracciones previstas en la presente Ordenanza serán sancionadas en cada caso por el órgano competente de acuerdo con lo previsto en el Reglamento de uso del Centre Antoni Tur ‘Gabrielet’, en la ley 11/2001, de 15 de junio, y subsidiariamente en el Real Decreto 199/2010, de 26 de febrero, de regulación de la venta ambulante o no sedentaria, así como toda la otra normativa que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;TÍTULO II&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;ÁREA DE ARTESANIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 18. Normativa de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El Área de artesanía del Centro Antoni Tur ‘Gabrielet’ se regulará específicamente por las normas contenidas en esta Ordenanza, en el Reglamento de uso del mismo Centro, en el título X de la Ordenanza municipal de Policía y Buen Gobierno del Consejo Insular de Formentera (de ahora en adelante, CIF), así como por las disposiciones que, sobre la regulación de la venta ambulante, contiene la Ley autonómica 11/2001, de 15 de junio, de ordenación de la actividad comercial de las Islas Baleares, modificada por la Ley 8/2009, de 16 de diciembre, de ordenación de la actividad comercial en las Islas Baleares para la transposición de la Directiva 2006/123/CE del Parlamento Europeo y del Consell, de 12 de diciembre de 2006, relativa a los servicios del mercado interior, el Real decreto 199/2010, de 26 de febrero, que regula el ejercicio de la venta ambulante o no sedentaria, así como toda la otra normativa que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 19. Objeto y finalidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El Área de artesanía se define como un espacio para fomentar, exponer, investigar y difundir la artesanía desarrollada en Formentera, tanto la de tipo creativa como la tradicional, así como para ofrecer formación relacionada con la materia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Excepcionalmente, las personas usuarias a que se refiere el artículo 22 de esta ordenanza, podrán realizar venta de artículos elaborados artesanalmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 20. Instalaciones y mobiliario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El área de Artesanía dispone de una pila con agua corriente, de una chimenea y de un horno de cocción. Además, el mobiliario inicial está formado por tres mesas rectangulares y sillas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 21. Horario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;El horario de apertura al público será de lunes a viernes de 11 a 14 h y podrá ser modificado según lo que establece el artículo 7 del Reglamento de uso del Centro Antoni Tur ‘Gabrielet’.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 22. Requisitos de las persones usuarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Podrán ser persones usuarias del área de Artesanía:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1. Los artesanos con carta de artesano o de maestro artesano&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2. Los que acrediten la titulación de su ofició o equivalente, juntamente con material grafico sobre el producto manufacturado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3. Los artesanos de actividades tradicionales de Formentera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 23. Propuestas y calendario de actividades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Todas las propuestas de actividades promovidas por los usuarios se deberán de presentar mediante una instancia firmada por el interesado, el cual se ha de dirigir al Registro General del Consell Insular de Formentera, ubicado en la Oficina de Atención Ciudadana (OAC), o en cualquier otro lugar, de conformidad con lo establecido en el artículo 38 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Estas propuestas se formalizaran a través de la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1. Instancia de solicitud&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2. Memoria descriptiva de la actividad que se quiere llevar a cabo. En caso de exposiciones, se deberá de adjuntar un dossier fotográfico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3. Copia compulsada de la carta de artesano, maestro artesano o titulación del oficio. Quedaran exentos de estos requisitos los artesanos de actividades tradicionales de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Los intercambios de artesanos, exposiciones y propuestas promovidas desde el área de Artesanía del CIF se presentaran y se debatirán directamente en la Comisión Asesora de Artesanía para su posible inclusión dentro del calendario de actividades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las propuestas que impliquen venta de artículos se regularán de acuerdo con el artículo 25 de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;A fin de establecer una planificación anual adecuada, las propuestas se deberán de presentar antes del 31 de marzo de cada año. Excepcionalmente se podrán prevenir modificaciones de este plazo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 24. Criterios de selección y resolución de las propuestas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;La Comisión Asesora de Artesanía del CIF, como órgano consultivo en la materia, será la encargada de valorar las propuestas y informar sobre la conveniencia o no de llevarlas a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;A la hora de seleccionar las propuestas se tendrá en cuenta el orden riguroso de entrada de las solicitudes en el Registro General de Entrada del CIF y la diversidad de las actividades que se programen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Finalmente será el área competente del CIF quien les autorizará.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 25. Venta&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;De manera puntual, coincidiendo con festividades o celebraciones, se podrá permitir la venta de productos dentro del espació del área de artesanía. Se podrán autorizar, para acceder a un lugar de venta, persones físicas, jurídicas y asociaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Los interesados en la venta de productos artesanales deberán de presentar una solicitud (instancia), mediante un impreso normalizado y firmado por los mismos, la cual se tiene que dirigir al Registro General del CIF, ubicado en la Oficina de Atención Ciudadana (OAC) del mismo, o en cualquier otro lugar, de conformidad con lo establecido en el artículo 38 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y procedimiento administrativo común, entre el 1 de enero y el 30 de marzo de cada año natural.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Juntamente con esta solicitud, la persona interesada deberá de presentar una declaración jurada en la cual se manifieste:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1. El cumplimiento de los requisitos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2. Estar en posesión de la documentación que así lo acredite desde el inicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3. Mantener su cumplimento durante todo el plazo de vigencia de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En el anterior también se deberá de adjuntar la siguiente documentación, mediante la presentación de originales o fotocopias compulsadas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;1. Datos de la persona interesada&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;2. Dos fotografías tipo carnet&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;3. Copia del DNI, NIE o pasaporte,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;4. Justificante de estar dado de alta en la IAE y al corriente de pagos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;5. Justificante de la Agencia tributaria de estar al corriente de impuestos y justificante de la Seguridad Social de estar al corriente de cotizaciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;6. Certificado de estar al corriente en el pago con el Consejo Insular de Formentera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;7. En el caso de extranjeros no miembros de la CEE, se deberá de acreditar, además, el hecho de estar en posesión de los permisos de residencia y trabajo correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;8. Memoria explicativa y dossier fotográfico de los productos que pretenden vender.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 26. Control y seguimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Desde el área competente en materia de artesanía se velará por asegurar que las actividades que implican venta se lleven a cabo de acuerdo con lo que se establece en esta ordenanza. En caso que se presente alguna anomalía, esta se remitirá a la Comisión específica de trabajo del Centro Antoni Tur ‘Gabrielet’ para estudiar la presunta infracción y elevar una propuesta de actuación en el órgano competente para resolver.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;Artículo 27. Régimen sancionador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Las infracciones que puedan cometerse por los usuarios del área de Artesanía serán sancionadas por el órgano competente de acuerdo con el que prescribe el Reglamento de uso del Centro Antoni Tur ‘Gabrielet’, el título X de la Ordenanza de Policía y Buen Gobierno del CIF, la Ley 11/2001, de 15 de junio, de ordenación de la actividad comercial de las Illes Balears y del Real decreto 199/2010, de 26 de febrero, que regula el ejercicio de la venta ambulante o no sedentaria, así como por tota la otra normativa que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;DISPOSICIÓN TRANSITORIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;En relación al Título I de esta Ordenanza, referente al mercado payés y con carácter excepcional, solo por el año 2011, el plazo por presentar las solicitudes al Registro general del CIF, será de 30 días hábiles a contar desde el día siguiente a la entrada en vigor de esta Ordenanza, y no lo establecido en el artículo 7.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;DISPOSICION FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Para la entrada en vigor de esta Ordenanza, se aplicara en lo dispuesto en el artículo 103 en relación con el artículo 113, de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, y permanecerá vigente hasta que se modifique y/o derogue expresamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;Lo que se hace público para conocimiento general.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
