    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Acordado por este Ayuntamiento en Pleno, en sesión ordinaria celebrada el 10 de diciembre de 2012, se aprueba la modificación de la &lt;strong&gt;ORDENANZA MUNICIPAL SOBRE LAS INSTALACIONES Y LOS USOS COMERCIALES EN LAS VÍAS Y ESPACIOS PÚBLICOS DE VALLDEMOSSA&lt;/strong&gt;. Y realizada la legal exposición al público sin haber presentado durante el tiempo de exposición ninguna reclamación, sugerencias, de conformidad con lo dispuesto en el artículo 17-3 del Real Decreto 2/2004 de 5 de marzo del Texto Refundido de la Ley Reguladora de las Haciendas Locales, se considera definitivamente aprobado, transcribiendo a continuación el texto completo de la ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra el presente acuerdo definitivo de modificación de la referida ordenanza fiscal, los interesados podrán interponer recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Islas Baleares, en el plazo de dos meses contados a partir del día siguiente al de la publicación del presente acuerdo en el B.O.I.B.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;TEXTO DE LA ORDENANZA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ORDENANZA MUNICIPAL SOBRE LAS INSTALACIONES Y LOS USOS COMERCIALES EN LAS VÍAS Y ESPACIOS PÚBLICOS DE VALLDEMOSSA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 1.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El objeto de la presente ordenanza es la regulación de las instalaciones y usos comerciales que se llevan a cabo en las vías y a los espacios de carácter público de titularidad municipal, con el fin de compatibilizarla con el uso común general de los ciudadanos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 2.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Para cualquier instalación u ocupación de la vía pública que suponga un uso especial o privativo, se requerirá la previa licencia o concesión municipal, que se concederá, en cada caso concreto, en relación con las medidas de tránsito y/o molestias que puedan crear a los ciudadanos. Estas licencias se tendrán que renovar anualmente entre el 1 de Noviembre y el 30 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sin embargo, habrá que atenerse a lo que prevé la normativa en materia de ruidos y horarios de locales destinados a bar, restaurantes, etc. cuando el uso de espacios públicos se lleve a cabo por alguna de estas actividades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- Los interesados en obtener la correspondiente licencia o autorización para llevar a cabo alguna de las modalidades de ocupación de vía pública previstas en la presente ordenanza tendrán que solicitarla mediante la presentación de la correspondiente instancia en el Registro General de Entrada del Ayuntamiento, acompañada del ingreso previo, si es preceptivo, así como de los documentos que en cada caso concreto se requieran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 3.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A las solicitudes para la instalación de mesas, sillas y/o mobiliario urbano, los interesados tendrán que presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Licencia de instalación y apertura o justificante que se está tramitando.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- Fotografía de la fachada del local y de la zona donde se pretenden instalar las mesas, sillas y/o mobiliario urbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.- Plano a escala 1/50 de la ubicación de los elementos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.- Plano de emplazamiento del local que indique los metros lineales de la fachada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.- Certificación de ausencia de débitos con la hacienda municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.- Memoria descriptiva de materiales y modelos de mesas y sillas y, en el caso de mobiliario urbano, memoria descriptiva del elemento en la cual tendrá que constar el diseño, el color y el tipo de material y número de mesas, sillas y/o elementos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.- Se tendrá que acreditar la tenencia de un seguro de responsabilidad civil por las responsabilidades que se puedan incurrir por el ejercicio de la actividad en la vía pública y a su mobiliario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 4.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los servicios técnicos municipales y la Policía Local, previo el correspondiente estudio de la documentación antes referida, emitirán informe sobre la adecuación de autorizar la instalación y la Junta de Gobierno decidirá la aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 5. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las actividades o los usos a que se refiere la presente ordenanza que se lleven a cabo en las inmediaciones de los monumentos histórico-artísticos, en los lugares de afluencia masiva de peatones y de vehículos y en los lugares que puedan suponer algún riesgo o peligro peatonal y para el tránsito en general, se autorizarán o se denegarán ateniéndose, en cada caso, a las circunstancias constatadas en los informes de los servicios técnicos municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CAPÍTULO I. NORMAS RELATIVAS A LA INSTALACIÓN DE MESAS Y SILLAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 6.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Como regla general, las autorizaciones que se otorguen para la ocupación de la vía pública se limitarán en la zona que confronte con las fachadas de los locales de qué sean titulares los solicitantes, si otras circunstancias no lo impiden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las mesas y las sillas se colocaran, como norma general, frente la fachada del establecimiento y adosadas al bordillo, que quedará libre de obstáculos, para permitir el tránsito de peatones y otros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para las mesas y sillas que se tengan que colocar en jardines públicos o en las inmediaciones de los monumentos históricos, se solicitará el previo informe del Servicio Técnico correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 7.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La superficie de ocupación por mesas y sillas a autorizar se determinará por los Servicios Técnicos en cada caso concreto, y se tendrán en cuenta las dimensiones de la fachada del local en cuestión, así como el lugar de emplazamiento (plazas, zona para peatones, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cuando una plaza o vía pública pueda ser utilizada por más de un establecimiento, la superficie total susceptible se repartirá en forma directamente proporcional a la longitud de la fachada que el local del peticionario presente hacia la vía pública. Si el titular de uno de estos locales solicitara ocupar la zona de influencia de otro local, se dará audiencia al titular de este último en el expediente que se tramite. No se podrán instalar las mesas y sillas fuera de la fachada del establecimiento a no ser que los propietarios colindantes dieran su autorización expresa, que tendría que aportarse por el interesado en el expediente que se tramite al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 8.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los propietarios de los establecimientos a los cuales se autorice la ocupación de parte de la vía pública están obligados, especialmente, a cumplir el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Dejar expedido el acceso a la entrada de los edificios y locales comerciales, así como a los accesos adaptados en los bordillos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- Ajustarse estrictamente a la zona autorizada sin excederse bajo ningún concepto, evitando que sus clientes lo hagan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.- Colocar en lugar visible, mediante un marco adecuado o funda de plástico, el permiso correspondiente para que pueda ser visto y consultado por la Policía Local sin necesidad de exigir su exhibición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.- Las mesas y las sillas a instalar serán de los materiales que regulan las normas de estética vigentes de acuerdo con el entorno. En todo caso, el Ayuntamiento podrá exigir los cambios que considere oportunos para mejorar las condiciones estéticas del mobiliario urbano que se proponga en la zona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.- Si, a cualquier hora del día, un vehículo autorizado o de urgencias tuviera necesidad de circular por la zona y las mesas y/o sillas se lo impidieran o dificultaran, el titular de estas tendría que proceder con toda rapidez a su retirada para facilitar la maniobra del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.- Mantener en perfectas condiciones de limpieza y salubridad la superficie autorizada. Cada establecimiento tendrá que recoger la basura causada para su limpieza y, si se hace uso de aparatos que causen ruido, se tendrán que ajustar a la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 9.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En todo el casco urbano de Valldemossa la utilización y la instalación de la vía pública se regirán por las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sólo se permitirá la utilización de materiales nobles como la madera, el hierro forjado, las lonas y el mimbre. La utilización otros materiales estará sujeto a la autorización expresa de los servicios municipales. Quedan prohibidos los colores vivos y policromados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 10 &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento podrá denegar la autorización cuando, por una determinada circunstancia, no se considere aconsejable la instalación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 11. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los días de fiestas, el Ayuntamiento se reserva el derecho de limitar o ampliar la autorización para la instalación de mesas y sillas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los Servicios Técnicos municipales determinarán qué superficie podrá ocuparse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CAPÍTULO II. NORMAS RELATIVAS A LA OCUPACIÓN DE LA VÍA PÚBLICA CON ELEMENTOS DE MOBILIARIO URBANO POR COMERCIOS DE VENTA DE RECUERDOS, ALIMENTACIÓN Y OTRAS.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 12.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La superficie a ocupar en la vía pública será la siguiente: por cada metro lineal de fachada se permite la ocupación con un elemento expositor de 0’25 m2 de base y una altura máxima de 1,70 m., con un máximo de cinco. Los elementos expositores se colocarán, como norma general, ante la fachada del establecimiento y adosados al bordillo, que quedará libre de obstáculos, para permitir el tránsito de peatones y otros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CAPÍTULO III. NORMAS RELATIVAS A LA INSTALACIÓN DE TOLDOS, MARQUESINAS, ESTUFAS, PARASOLES Y PUBLICIDAD&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 13. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los toldos, las marquesinas y los parasoles tendrán que ser de lona y se tendrán que ajustar a los colores del punto 2 del presente artículo de forma que se integren al entorno, y sólo podrán llevar escrito el nombre del establecimiento. En ningún caso, podrán llevar escrito ningún tipo de publicidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Para unificar el color de los toldos y de las marquesinas, se da de plazo hasta el 31 de diciembre de 2013, para que los establecimientos que los tengan de color diferente al autorizado procedan a su cambio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2 –Los colores autorizados serán la gama del color que va del beige al marrón, los verde oscuro y los grana&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3- Los establecimientos que tengan toldos o marquesinas y parasoles las tendrán que tener del mismo color&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 14. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se autorizará la instalación de parasoles siempre que no afecten a la circulación de peatones y vehículos, por lo tanto, quedará prohibida su instalación si sobresalen de la línea vertical del límite de la zona de ocupación autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- En caso de instalarse parasoles, estos se sujetarán mediante una base de suficiente peso y de forma que no produzcan ningún deterioro al pavimento y que no supongan peligro para los usuarios y peatones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- Si la superficie a ocupar ya está cubierta por un toldo, no se permitirá la instalación simultánea de parasol.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 15. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No se permitirá la instalación de estufas a gas que tengan los quemadores y la zona de fuego sin la debida protección. Sólo se permitirá la utilización de dispositivos que mantengan la llama dentro de vidrio y tengan protección para evitar quemaduras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 16. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Queda prohibida la exhibición de publicidad comercial a la vía pública. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- No se permite el uso de los árboles, farolas, señales de tránsito u otros tipos de mobiliario urbano para colocar ningún tipo de objeto ni publicidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.- Se permitirá la colocación de un único soporte publicitario por local o establecimiento que únicamente puede informar de los servicios de este. Las medidas máximas de este apoyo serán de 80x120 cm y, obligatoriamente, irá enmarcado en madera o hierro forjado y se podrá colocar en la fachada o dentro de los límites autorizados para la instalación de las mesas y sillas. También se permitirá un único atril de madera, para colocar un libro informativo (carta de comidas, precios, etc.). Estos apoyos se tienen que retirar de la vía pública o de la fachada cuando el establecimiento esté cerrado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.- En el caso de comercios de venta de recuerdos, el soporte publicitario de 80x120 se podrá sustituir por una vitrina de madera de 80 cm de ancho por 120 cm de altura y 10 cm de profundidad, que se colocará en la fachada, podrá estar cerrada por vidrios para contener y exhibir los productos que se venden en el comercio. Esta vitrina se tiene que retirar cuando el establecimiento esté cerrado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.- En la fachada, sólo se podrá poner el nombre comercial del establecimiento y los soportes publicitarios antes mencionados, de acuerdo con las normativas urbanísticas y de normalización lingüística vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.- Queda prohibida la instalación de terrazas cerradas alrededor del perímetro del local mediante estructuras fijas o móviles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.- En todo caso, el Ayuntamiento podrá exigir los cambios que considere oportunos para mejorar las condiciones estéticas de acuerdo con el entorno. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CAPÍTULO IV. DISPOSICIONES GENERALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 17. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Todas las actividades contempladas a la presente ordenanza quedan sometidas al pago de la correspondiente tasa o precio público de ocupación de la vía pública, de acuerdo con las ordenanzas fiscales vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 18. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cualquier instalación de las contempladas en la presente ordenanza tendrá que hacerse en puntos que no molesten el paso de peatones, ni impidan la visibilidad de las señales de tránsito. Tampoco se podrá hacer cerca de las salidas normales, ni en paradas de transportes públicos ni en vados, aunque el ancho máximo de la acera lo permita.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 19. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Es obligación de los titulares de la licencia o autorización mantener en perfecto estado de salubridad e higiene la zona autorizada, así como reponer el pavimento y los desperfectos ocasionados en la fracción de vía ocupada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 20.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Todos los elementos de mobiliario urbano que no estén expresamente regulados a la presente normativa (jardineras, vitrinas, expositores de venta, cierres...) estarán sometidos a la autorización municipal y tendrán que corresponder a tipo homologados por el Ayuntamiento, de acuerdo con el procedimiento que esta ordenanza establece, requisito sin el cual no será posible su instalación. Las autorizaciones podrán ser anuales o de temporada. Se entenderá por autorización de temporada desde el 1 de marzo al 30 de octubre, ambos incluidos, y por anual del 1 de enero al 31 de diciembre, habiendo, en cualquier caso, solicitar su renovación por parte del interesado entre el 1 de noviembre y el 30 de diciembre. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- El mobiliario urbano tendrá que armonizar con el ambiente y con el carácter del entorno en que se pretende instalarlo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En todo el casco urbano de Valldemossa la utilización y la instalación de la vía pública se regirán por las siguientes condiciones: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sólo se permitirá la utilización de materiales nobles como la madera, el hierro forjado, las lonas y el mimbre. La utilización otros materiales estará sujeto a la autorización expresa del servicios municipales. Quedan prohibidos los colores vivos y policromados. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.- El Ayuntamiento podrá aprobar diseños específicos para cada una de las zonas en qué pueda ser ocupada la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 21.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- Cuando se trate de mobiliario urbano (cierres, jardineras, expositores…) de temporada, serán desmontados totalmente, incluida su sujeción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- En el supuesto de que sean anuales, una vez acabada la jornada laboral, los distintos elementos quedarán recogidos de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 22. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si el establecimiento tiene que permanecer cerrado por más de dos días consecutivos, será obligatoria la retirada del mobiliario urbano de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 23. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la concesión del uso del espacio público será el responsable de los daños que puedan ocasionar cualquier de los elementos que tenga colocados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 24. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No se permitirá ninguna otra actividad o uso comercial del espacio público sin la autorización expresa del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 25. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las actividades autorizadas, mientras no se indique lo contrario, serán realizadas por el titular de la licencia o por personal dependiente de él. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 26. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el supuesto de que la Policía Local lo requiera, por causa justificada, se podrá suspender temporalmente el uso de las licencias. La policía local podrá ordenar la retirada o la modificación de la situación de los elementos que ocupen la vía pública en cualquier momento y de forma inmediata, cuando se den circunstancias que afecten la seguridad de las personas o de los bienes, dificulten el libre tránsito de los peatones o rodado, interfieran actos oficiales o de interés público, o por cualquier otra causa suficientemente justificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 27. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por causa motivada, el Ayuntamiento podrá autorizar la colocación de expositores en zonas adecuadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 28. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Queda prohibido ocupar la vía pública de la parte frontal del establecimiento con macetas u otros elementos para impedir el estacionamiento de vehículos. La Policía Local es la encargada del control de las zonas delimitadas por las distintas ocupaciones y del control de los estacionamientos de vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 29. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si existen problemas en relación a la autorización por quejas razonadas de los vecinos o por otras circunstancias de interés general (cómo puedan ser la ordenación del tránsito, etc.), el Ayuntamiento se reserva el derecho de anular dicha autorización sin derecho a ningún tipo de indemnización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 30.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por decreto de alcaldía, se podrán ordenar cuántas revisiones o actos se consideren necesarias para llevar a cabo el buen cumplimiento de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CAPÍTULO V. PROCEDIMIENTO SANCIONADOR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 31.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Infracciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las infracciones a la presente ordenanza se calificarán de leves, graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se considerarán infracciones leves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Causar daños en las vías públicas o en las instalaciones y al mobiliario urbano, modificarlos o utilizarlos contra el destino que les es propio. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No prevenir o no informar sobre actos que impliquen ensuciar los espacios públicos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El incumplimiento del deber de los particulares de limpiar los espacios públicos cuando tengan autorizado un uso especial o privativo del dominio público. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Realizar en la vía pública trabajos propios de oficios o profesiones sin autorización municipal cuando ésta sea necesaria. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Llevar a cabo otras actividades que se correspondan con el uso común especial o el uso privativo sin la correspondiente licencia o concesión. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ocupar los espacios públicos o usarlos más allá del que permite la licencia o concesión. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No comunicar al Ayuntamiento la celebración de actos o reuniones que supongan limitaciones a los usos generales o especiales de los espacios públicos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El incumplimiento del espacio mínimo para el paso de peatones cuando esté autorizada la ocupación o el uso especial o privativo de los espacios públicos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;y) La venta por persona no autorizada de helados, golosinas y otros productos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Exceder el número de mobiliario o elementos autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se considerarán infracciones graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Perturbar la utilización libre de los espacios, mobiliario urbano e instalaciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Causar daños en las vías públicas o en las instalaciones y al mobiliario, modificarlos o utilizarlos contra el destino que los es propio y causar perjuicios económicos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ocupar la vía pública con objetos de cualquier tipo sin la preceptiva licencia o concesión municipal. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Llevar a cabo cualquier actividad no amparada a la licencia o concesión. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Incumplir las condiciones o las obligaciones que se establecen en la ordenanza, así como en la licencia o concesión, en relación con los usos especiales o usos privativos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Demorar el fin de la actividad en la vía pública más de 15 minutos después del horario autorizado. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La reincidencia de infracciones leves en un periodo de seis meses. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se considerarán infracciones muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Realizar, o permitir que se realicen, actos que puedan alterar la convivencia pacífica o ser causa de riesgo leve para los usuarios o peatones. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Desatender u omitir las órdenes que, sobre el funcionamiento de la actividad, se pudieran recibir por parte de las autoridades competentes o de sus agentes. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La reincidencia de infracciones graves en un periodo de seis meses. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 32.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sanciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Las infracciones leves se sancionarán con una multa de hasta 750 euros. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Las infracciones graves se sancionarán con una multa comprendida entre 751 euros y 1.500 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Las infracciones muy graves se sancionarán con una multa comprendida entre 1.501 euros y 3.000 euros. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 33.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Procedimiento:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;No se podrá imponer ninguna sanción sin la previa tramitación del expediente al efecto, el cual será iniciado de oficio por la misma administración municipal, en virtud de la función inspectora y de la comprobación propia de su competencia, o a instancia de parte mediante la correspondiente denuncia por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para la imposición de las sanciones previstas en esta ordenanza se seguirá el procedimiento previsto a todos los efectos en el Decreto autonómico 14/1994, de 10 de febrero, por el cual se aprueba el Reglamento de procedimiento a seguir por la administración de la comunidad autónoma en el ejercicio de la potestad sancionadora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 34.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Obligación de reparar el daño causado o de abonar su coste.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La imposición de las sanciones procedentes no exonera al autor de la obligación de reparar los daños causados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 35. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Adopción de medidas cautelares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Ayuntamiento, en el supuesto de que la instalación situada en el dominio público municipal no cuente con la preceptiva autorización o licencia, podrá adoptar las siguientes medidas cautelares:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha"&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Requerimiento al infractor para que en el plazo de 48 horas proceda a la retirada de instalaciones y bienes en los cuales desarrolla su actividad. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En el supuesto de que no sean retirados estos elementos en el plazo concedido, lo realizará el Ayuntamiento a expensas del infractor, sin perjuicio de proseguir la tramitación del expediente con audiencia del interesado hasta su normal resolución e imposición de la multa que proceda en el caso, conforme al que disponen los artículos precedentes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las denuncias y/o actas que pueda realizar la Policía Local en el ejercicio de sus funciones de control de las ocupaciones de la vía pública, tendrán valor de requerimientos a los efectos del plazo de 48 horas referido en su punto a), siempre y cuando sean posteriormente ratificadas por la autoridad competente. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Artículo 36.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Cuando, por su emplazamiento, las instalaciones supongan un grave trastorno que atente contra la seguridad del tránsito de peatones o rodado y cuando, por el continuo cambio de ubicación de una determinada instalación, se llegue a una situación de reincidencia habitual que suponga un fraude al espíritu de esta ordenanza, podrá procederse a la retirada de las instalaciones y bienes de oficio por este Ayuntamiento, sin requerimiento previo al titular de la instalación y sin perjuicio de la normal tramitación de expediente sancionador en la forma antes establecida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;DISPOSICIÓN ADICIONAL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Todas las disposiciones municipales que contradigan a la presente ordenanza en el momento de su entrada en vigor se considerarán derogadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Con todo el previsto a la presente ordenanza, regirán las ordenanzas generales de la Corporación y otras normas aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente ordenanza entrará en vigor el día de su publicación en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares, estando en vigor hasta su modificación o derogación expresa&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
