    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En relación con el asunto de referencia, y de acuerdo con la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se comunica que el Pleno de la CMAIB, en sesión de 03 de abril de 2013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;CONSIDERANDO QUE&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;la emisión de la autorización de emisión de gases de efecto invernadero (AEGEI) de la instalación Ladrillerías Mallorquinas S.A. por el periodo 2013-2020, de acuerdo con la normativa vigente en la materia, justifica la modificación de oficio en cumplimiento del art. 26.e de la Ley 16/2002, de 1 de julio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;ACUERDA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;otorgar la modificación de oficio de la Autorización Ambiental Integrada de la fábrica de bloques cerámicos y similares, consistente en la eliminación de las referencias al comercio de derechos de emisión de gases de efecto invernadero, con sujeción a las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Se modifica el condicionante 7.2 para eliminar las referencias al régimen de comercio de derechos de emisión de gases de efecto invernadero quedando la nueva redacción:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“7.2 Foco de emisión a la atmósfera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Según el anexo del Real decreto 100/2011, de 28 de enero, por el cual se actualiza el catálogo de actividades potencialmente contaminadoras de la atmósfera y se establecen las disposiciones básicas para su aplicación, la actividad está clasificada como Actividad Potencialmente Contaminadora de la Atmósfera del grupo A, código 03 03 19 01”Producción de ladrillos, tejas u otros materiales de construcción asimilables no especificados en otros epígrafes con capacidad de producción mayor o igual a 75 t/día”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En la tabla siguiente se identifican los focos emisores de la fábrica de material cerámico de Ladrillerías Mallorquinas, SA según el anexo del Real decreto 100/2011:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.1 Plan de autoprotección&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad tiene que disponer del preceptivo Plan de emergencia interior registrado en la dirección general competente en materia de emergencias e implantado en la totalidad de las instalaciones y procesos que conforman la actividad, según el Real decreto 1254/1999, de 16 de julio, por el cual se aprueban las medidas de control de los riesgos inherentes a los accidentes graves en que intervengan sustancias peligrosas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.2 Seguridad industrial&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El titular de la actividad tendrá que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Inscribir las instalaciones correspondientes de la Dirección general de Industria, según las normativas vigentes de seguridad industrial, minera, etc… Las instalaciones previstas o existentes tienen que cumplir con la legislación vigente en materia de Industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Revisar la inscripción en el Registro Industrial y obtener el Documento de Calificación Empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Dar cumplimiento al Reglamento para suprimir las barreras arquitectónicas (Decreto 20/2003) en todo lo que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Prevenir los riesgos laborales y velar por la salud y seguridad de los trabajadores, y éstos tienen el deber de cumplir las medidas de prevención que se adopten, según lo establecido por la Ley estatal 31/95, de prevención de los riesgos laborales. Las condiciones de trabajo se tienen que ajustar a lo establecido en las disposiciones específicas y reglamentarias en materia de seguridad laboral. Se tiene que poner especial atención en el cumplimiento del Real decreto 374/2001, sobre protección de los trabajadores contra los riesgos relacionados con los agentes químicos durante el trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Hacer cumplir en los edificios de carácter industrial las prescripciones de protección contra incendios indicadas en el Real decreto 2267/2004, de 3 de diciembre, por el cual se aprueba el Reglamento de seguridad contra incendios en los establecimientos industriales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por otra parte:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Las instalaciones de protección contra incendios y el mantenimiento se tienen que ajustar a lo dispuesto en el Reglamento de instalaciones de protección contra incendios (RD1942/1993) y normas UNE correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-El almacenamiento de productos químicos se tendrá que adaptar al Real decreto 379/2001, de 6 de abril, por el cual se aprueba el Reglamento de almacenamiento de productos químicos y las instrucciones técnicas complementarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.3 Contaminación acústica&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se hará una campaña anual de caracterización real de los niveles de ruido emitidos en el exterior durante las diversas fases típicas de la operación (encendidos, etc.) en horario nocturno y diurno, para comprobar el cumplimiento de los límites establecidos en la normativa autonómica vigente en esta materia, es decir, la disposición adicional quince de la Ley 25/2006, de 27 de diciembre, de medidas tributarias y administrativas, y la Ley 1/2007, contra la contaminación acústica en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.4 Contaminación lumínica&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se cumplirá con lo que establece la Ley 3/2005, de 20 de abril, de protección del medio nocturno de las Illes Balears”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.Dentro del punto 9.3.2 Informe anual se elimina la obligación de presentar el informe anual sobre la verificación de las emisiones de gases de efecto invernadero y se modifica la fecha tope de presentación del informe anual marcada ahora por la declaración anual de residuos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;“9.3.2 Informe anual&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Antes del 1 de marzo, el titular de la actividad tiene que enviar al Órgano Ambiental encargado de tramitar la AAI un informe único, del periodo precedente en el que se incluirá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Residuos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+La declaración anual de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Emisiones e inmisiones al medio hídrico:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Justificantes de vaciado de las fosas sépticas emitido por gestor autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Ruidos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Informe anual en el cual se remitirán los controles de emisiones de ruidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-En carácter general:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Memoria anual explicativa de la metodología utilizada para la determinación de los datos notificados antes de ser incorporadas al registro informático PRTR-España.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+Los datos exigidos por el RD 508/2007 y Reglamento (CE) 166/2006, de 18 de enero, se tienen que comunicar telemáticamente al Registro informático PRTR-España, dentro de los plazos que correspondan, de forma anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;+El Órgano Ambiental encargado de tramitar las AAI tiene que enviar a cada Dirección general o administración competente la documentación de la que tenga competencias. Toda la información que sea susceptible de tratamiento informático se tiene que aportar en papel y en formato informático estándar”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
