    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En relación con el asunto de referencia, y de acuerdo con la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se comunica que el Pleno de la CMAIB, en sesión de 03 de abril de 2013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CONSIDERANDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Que CEMEX ESPAÑA SA ha solicitado una modificación de la AAI consistente en la valorización energética de neumáticos fuera de uso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Que la documentación aportada justifica que se trata de una modificación no sustancial, en cumplimiento del art. 10.2 de la Ley 16/2002, de 1 de julio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Que en fecha 7 de abril de 2009, el Consejero de Medio Ambiente dictó resolución por la cual se denegaba la modificación no sustancial de la AAI de la planta de fabricación de cemento de CEMEX, consistente en la valorización energética de neumáticos fuera de uso (M05/2008) (BOIB núm.78 de 30/05/2009).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. Que en fecha 26 de agosto de 2010, el Consejero de Medio Ambiente y Movilidad dictó resolución desestimativa en relación al recurso potestativo de reposición interpuesto por CEMEX SA en fecha 15 de junio de 2009 contra la resolución de 7 de abril de 2009 del Consejero de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5. Que la Sentencia 824, de 28/11/2012, dictada por la Sala de lo Contencioso Administrativo del TSJIB falla:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;a. Que ESTIMAMOS el presente recurso contencioso administrativo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;b. DECLARAMOS disconforme con el ordenamiento jurídico el acto administrativo impugnado y, en consecuencia, lo ANULAMOS.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;c. RECONOCEMOS el derecho de la recurrente a la obtención de la Modificación no Sustancial, de la Autorización Ambiental Integrada de la que es titular la recurrente y para la valoración energética de neumáticos fuera de uso en su fábrica de cemento ubicada en el término municipal de Lloseta en los términos solicitados y con los condicionantes técnicos expresados en el informe de 1 de diciembre de 2008, de la Jefe de Sección de Atmósfera de la Consejería de Medio Ambiente, sin perjuicio de que dicha valoración energética precisa de las demás autorizaciones sectoriales que en cada caso procedan.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;d. No se hace expresa declaración en cuanto a costas procesales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6. Que el informe de la Sección de Contaminación Atmosférica de la D.G. de Medio Natural, Educación Ambiental y Cambio Climático propone mantener los valores límites de emisión fijados en la AAI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;ACUERDA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;otorgar la modificación no sustancial de la Autorización Ambiental Integrada de la fábrica de cemento, consistente en la valorización energética de neumáticos fuera de uso, con las condiciones de explotación, capacidad y procesos indicados en la solicitud y con sujeción a las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Modificar el condicionante 5.6.13 para añadir la valorización de neumáticos fuera de uso:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;“5.6.13 La presente autorización se concede única y exclusivamente para la valorización de los residuos no peligrosos descritos a continuación:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;(1) En cumplimiento de los vigentes Planes Directores Sectoriales de Residuos Urbanos y no peligrosos, que establecen que la gestión y tratamiento de estos residuos tiene carácter de servicio público obligatorio insularizado, y siempre y cuando CEMEX no disponga de la autorización expresa del órgano competente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;- CEMEX no podrá producir este tipo de combustible en sus instalaciones a partir de otros residuos, procedentes de la recogida domiciliaria, etc.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;- CEMEX tendrá que recibir estos residuos de proveedores e instalaciones fuera de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;- CEMEX tendrá que cumplir las normas vigentes relativas a residuos no peligrosos de vigencia nacional o autonómica en cuanto a su transporte (si fuera el caso), almacenamiento y tratamiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;(2) Los residuos antes codificados se podrán valorizar siempre y cuando se mantengan los siguientes condicionantes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;- CEMEX no podrá recibir ni gestionar los residuos antes codificados procedentes de otros gestores o productores.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;- CEMEX tendrá la consideración de autogestor para estos residuos y así tendrá que constar en las memorias y declaraciones anuales a presentar sometidas a la legislación sobre residuos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;- CEMEX tendrá que dar cumplimiento a la normativa exigida en materia de incineración y coincineración de residuos peligrosos sometida a normativa competencia otros departamentos del Gobierno de las Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;(3) Su tratamiento requerirá las autorizaciones sectoriales que procedan del Consell de Mallorca”.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Antes de la primera valorización de neumáticos fuera de uso, CEMEX ESPAÑA OPERACIONES SLU tendrá que presentar copia de las correspondientes autorizaciones sectoriales ante el órgano ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
