    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El Pleno del Ayuntamiento&amp;nbsp; en sesión ordinaria celebrada el día 31.05.13 aprobó provisionalmente la modificación de la tasa para las actividades de carácter cultural (Escuela Municipal de Enseñanzas Artísticas) y los artículos 4, 5 y 6 de su ordenanza fiscal reguladora.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el BOIB núm. 81 de día 06.06.13 se publica el anuncio de dicha aprobación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Atendiendo que durante el período establecido al efecto no se han presentado&amp;nbsp; alegaciones, la modificación de dicha ordenanza se entiende aprobada&amp;nbsp; definitivamente.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Atendiendo a la legislación vigente, se publica íntegramente la ordenanza indicada:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ORDENANZA REGULADORA DE LA TASA PARA LAS ACTIVIDADES DE CARÀCTER CULTURAL (ESCUELA MUNICIPAL DE ENSEÑANZAS&amp;nbsp; ARTÍSTICAS)&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 1 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Concepto &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Haciendo uso de las facultades conferidas por los artículos 133.2 y 142 de la Constitución Española y por el artículo 106 de la Ley&amp;nbsp; 7/85, de 2 de abril, Reguladora de las Bases de Régimen Local, y conforme a lo que disponen los artículos 15 al 27 del Real decreto legislativo, 2/2004, de 5 de marzo, que aprueba el Texto refundido&amp;nbsp; de la Ley Reguladora de las Haciendas Locales, se establece la tasa por actividades de carácter cultural, (Escuela Municipal de Enseñanzas Artísticas - EMEA). &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La tasa por actividades de carácter cultural (EMEA) se rige por esta ordenanza fiscal, las normas de la cual se atienden a lo dispuesto en el artículo 57 del RDL 2/2004, de 5 de marzo. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 2 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Hecho imponible&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Constituye el hecho imponible de la tasa la prestación de los servicios de carácter cultural. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 3&amp;nbsp; &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Obligados al pago&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Están obligados a pagar la tasa regulada por esta ordenanza las personas que se beneficien de los servicios o actividades que se regulan en ella o que asisten a los cursos que programan los Servicios Municipales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;Artículo 4 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: left"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Actividades y cuotas tributarias&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4.1.- Actividades&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El conjunto de actividades que se podrán ofrecer de forma colectiva o individual, son las siguientes:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Departamento de Artes Plásticas&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Dibujo y Pintura&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Costura&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Departamento de expresión corporal&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Baila con tu bebe&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Danza en familia&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Psico-danza&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Danza clásica&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Danza africana&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Danza oriental&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Bailes en línea &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Departamento de Música&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Música y movimiento&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Lenguaje musical&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Canto coral&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Armonía aplicada&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Combos&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Conjunto instrumental&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Colectiva de instrumento&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Canto&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Instrumentos harmónicos: piano, guitarra clásica y guitarra de acompañamiento&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Instrumentos melódicos: flauta travesera, clarinete, saxo, instrumentos de viento-metal (trombón, trompa, tuba)&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Violín&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Trompeta&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Instrumentos de percusión: batería y percusión&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. Otras actividades: actividades no previstas en los apartados anteriores.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el caso de las clases colectivas, el número mínimo de alumnos para poder formar grupo será de 5. En caso de formarse grupos de 3 o 4 personas, los precios se verán incrementados según el siguiente baremo:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Grupo de tres personas: incremento de un 20%&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Grupo de cuatro personas: incremento de un 10%&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En estos casos especiales, para iniciarse la actividad siempre habrá el visto bueno de los alumnos.&amp;nbsp; En caso que estos grupos pasen a tener cinco alumnos por el hecho de haber nuevas matrículas, los precios serán los establecidos más arriba.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Para grupos de dos o menos alumnos, no se iniciará la actividad.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4.2.- Cuotas&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A) Tasa obligatoria de inscripción (tasa de Secretaria):&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Nuevos alumnos: 25,00 € (se consideran nuevos alumnos a aquellos que nunca se hayan inscrito en les actividades de la EMEA o que haga dos cursos lectivos que no asisten al centro)&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Antiguos alumnos: 5,00 €&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El importe de esta tasa siempre será el mismo, independientemente del mes en el cual el alumno se inscriba.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los alumnos que se matriculen pero que renuncien dentro de las dos primeras semanas de inscripción, no se les cobrará la tasa de Secretaria,&amp;nbsp; pero deberán de abonar el 50% de la primera cuota de la actividad o actividades a las cuales se han inscrito.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;B) Las cuotas de las diferentes materias quedan definidas según los siguientes baremos de tiempo:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;F) En la temporización de las diferentes materias se tendrán en cuenta los criterios pedagógicos del profesorado, la ocupación de las aulas y la edad del alumno. Los criterios a seguir se definirán al inicio de cada curso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El importe de la tasa de secretaria no estará sujeta a descuentos ni a bonificaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se aplican los siguientes descuentos, acumulativos e individuales, sobre el total de la suma de las cuotas de las actividades a las cuales un usuario se haya matriculado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Descuento por más de un miembro de la misma familia: a partir del segundo miembro, se aplicará el siguiente baremo:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Descuento para jubilados: 10%&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Descuento para discapacitados: 10% (se deberá de justificar aportando una fotocopia compulsada del informe que indique el grado de discapacidad).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Descuentos para personas en situació de parados: 10% (se deberá de justificar mensualmente aportando la tarjeta del paro correctamente sellada). En caso de no justificarse, automáticamente se eliminará el descuento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En caso de que un usuario se dé de baja de una actividad y se haya beneficiado de algún tipo de descuento, éste quedará anulado en el momento de efectuar el trámite (si hay más que no se vean afectados por esta baja, no se anularán).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Bonificaciones&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los alumnos que forman parte de las actividades que la Escuela Municipal de Enseñanzas Artísticas organice con entidades externas de carácter especial (p.ex., la Fundación para Personas con Discapacidad, el Geriátrico de Sant Lluís,&amp;nbsp; el Club de Jubilados, el Centre de Menores, etc.) tendrán un 40% de bonificación en el total de la cuota mensual (no a la Tasa de Secretaria).&amp;nbsp;&amp;nbsp; En el caso que surjan nuevas relaciones con otras entidades a las cuales se les pueda beneficiar las actividades que organice la EMEA, la bonificación se deberá de aprobar por acuerdo de la Junta de Gobierno Local.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se podrán aplicar bonificaciones de hasta un 60% a las personas empadronadas en el municipio, previo informe emitido por los Servicios Sociales. Las bonificaciones necesitarán, para que puedan ser aprobadas, una solicitud previa de los sujetos pasivos, a la cual deberán de adjuntar la documentación que acredite su circunstancia. Desde la Secretaria de la EMEA se informará de esta posibilidad a los usuarios empadronados que tengan dificultades económicas para poder acceder a las actividades que se ofrecen. Esta bonificación únicamente se aplicará a las cuotas mensuales —nunca a la Tasa de Secretaria— y es indispensable a las que el centro pueda aportar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Artículo 6 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Gestión&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La tasa regulada en esta ordenanza se cobra por medio de un recibo emitido por el Ayuntamiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. No se admitirán pagos en efectivo o ingresos a cuenta, a excepción de que se trate del pago de recibos devueltos o de casos especiales que puedan surgir, previamente consensuados con el Servicio de Secretaria.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Las tarifas mensuales se meritan el primer día de cada mes y han de ser satisfechas durante la primera quincena de cada mes, a excepción del mes de octubre, en el que se cobra a partir del día 20 y se incluirá la primera cuota, la tasa de secretaria y el seguro de accidentes, en caso que esta se solicite.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;4. El mes de junio se cobra la mitad de la cuota total correspondiente, teniendo en cuenta que las actividades finalizan el día 15 de junio o el viernes antes de día 15.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;5. Dependiendo del momento en que se produzca el alta en la Escuela Municipal de Enseñanzas Artísticas, la liquidación de la cuota que se efectúa es como sigue (siempre teniendo en cuenta el momento que el usuario inicia una actividad):&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- De día 1 a día 10: 100% de la cuota&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- De día 11 a día 20: 75% de la cuota&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- De día 21 a día 31: 50% de la cuota&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;6. Todos los usuarios tienen derecho a una clase gratuita de prueba: en caso de solicitarse se ha de hacer siempre a través de la Secretaria de la EMEA de forma que se formalizará la inscripción a partir del día siguiente de clase. En caso que no se haga la solicitud previa o no se haga correctamente, se contará la inscripción des del día en que se ha ido a probar la actividad.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;7. Las bajas en la realización de actividades se han de notificar a la Secretaria de la EMEA mediante el modelo de solicitud disponible,&amp;nbsp; que habrá de presentar,&amp;nbsp; como máximo, antes del día anterior al primer día de clase de la actividad dentro del mes que se quiera dar de baja. En caso de no respetar ni el plazo ni la forma establecida,&amp;nbsp; la baja no será efectiva hasta el mes siguiente al deseado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;8. En caso de devolución de recibos impagados, la Secretaria de la EMEA notificará por escrito al titular del recibo de esta eventualidad para que en un plazo de quince días proceda a regularizar esta situación.&amp;nbsp; Si no hace el ingreso de la cuota correspondiente durante este plazo, el recibo pasará al servicio de recaudación municipal para que lo tramite. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Disposición adicional &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Todo lo que no está previsto en esta ordenanza se regirá por el Texto Refundido de la Ley Reguladora de las Haciendas Locales, la Ley General Tributaria y el Reglamento general de Recaudación. &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Disposición final &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta Ordenanza reguladora de la tasa por actividades de carácter cultural (Escuela Municipal de Enseñanzas Artísticas)&amp;nbsp; entrará en vigor el mismo de día que se publicará&amp;nbsp; en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; y será aplicable a partir del día 1 de octubre de 2012. Su período de vigencia se mantendrá hasta que no se modifique o se derogue expresamente.&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
