&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En el &lt;span style="color: black"&gt;BOIB&lt;/span&gt; nº 16 de día 2-02-2012 salió publicada la modificación de la Ordenanza municipal de rótulos, aprobada por el Pleno del 12-06-2008, publicación que se dejó sin efectos mediante la resolución de la Alcaldía nº 28 del 30-03-2012 (&lt;span style="color: black"&gt;BOIB&lt;/span&gt; núm. 53 de 14-04-2012.)&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A continuación, se transcribe literalmente el contenido de la Ordenanza tal como ha quedado:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;ORDENANÇA MUNICIPAL DE RÓTULOS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;PRIMERO.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. La presente ordenanza tiene por objeto regular las condiciones a las que deberán sujetarse las instalaciones y actividades publicitarias, emplazadas o ejecutadas en el dominio público municipal o perceptibles desde este dominio.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;nbsp;2. Se entiende por&lt;em&gt; publicidad&lt;/em&gt; cualquier acción dirigida a difundir entre el público cualquier tipo de información y el conocimiento de la existencia de cualquier actividad o de productos o de servicios que se &lt;span style="color: black"&gt;ofrezcan&lt;/span&gt; para el consumo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Las licencias que se &lt;span style="color: black"&gt;conceden&lt;/span&gt; para difundir &lt;span style="color: black"&gt;publicidad&lt;/span&gt;, por cualquier medio, estarán condicionadas a la concesión y permanencia de las preceptivas licencias municipales de la actividad.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SEGUNDO.&lt;/strong&gt; La actividad publicitaria, cuando esté permitida y ajustada a las condiciones de esta ordenanza, se podrá realizar mediante algunos de los siguientes medios y desarrollarse mediante los siguientes soportes publicitarios, a partir de ahora llamados genéricamente &lt;em&gt;rótulos:&lt;/em&gt; carteleras, carteles y adhesivos, placas y escudos, banderas, banderolas y pancartas. Se prohíben explícitamente los elementos arquitectónicos, los objetos o los objetos y las figuras. La normativa para la que se regirán dependerá de la colocación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;TERCERO.&lt;/strong&gt; El procedimiento para la solicitud y concesión de licencia de instalación de los mencionados elementos publicitarios se ajustará a lo previsto por la Ley 16/2006, de 17 de octubre, de régimen jurídico de licencias integradas de las Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;CUARTO.&lt;/strong&gt; CONDICIONES PARA LA INSTALACIÓN DE ELEMENTOS PUBLICITARIOS EN EL CASCO ANTIGUO:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se aplicará el Pla Especial de Protecció del Conjunt Històric i Artístic de Ciutadella, aprobado definitivamente en fecha 31-3-99 y publicado en el &lt;span style="color: black"&gt;BOCAIB&lt;/span&gt; del 24-04-99, los artículos 8.3.5 (rótulos), 8.3.6 (iluminación) y 8.3.2 (toldos), que establecen:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;A) RÓTULOS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. Para locales comerciales en planta baja, se &lt;span style="color: black"&gt;autorizan&lt;/span&gt; los tipos de rótulos que se &lt;span style="color: black"&gt;especifican&lt;/span&gt; a continuación:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) En una franja, encajado bajo el dintel del hueco de la fachada, apoyado con respecto a la cara exterior de la valla o del muro. Esta franja o banda no podrá tener una anchura superior a 30 cm.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se podrán hacer de chapa metálica esmaltada o laqueada, cristal, piedra u otros materiales concordes al edificio y al entorno inmediato; se prohíben explícitamente los materiales plásticos y el acero inoxidable, el aluminio &lt;span style="color: black"&gt;visto&lt;/span&gt; o los acabados metalizados brillantes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El rótulo con el nombre del establecimiento, la actividad u otros aspectos se deberán inscribir en esta franja, y se podrá hacer con letras en relieve de bronce o latón, grabadas o pintadas sobre cristal, formadas en placa de hierro, grabadas en bajo relieve o con otras soluciones en armonía con el entorno.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En casos particulares y únicamente en áreas &lt;span style="color: black"&gt;AR&lt;/span&gt; (contramurada) se podrán admitir rótulos de neón, siempre que &lt;span style="color: black"&gt;tengan&lt;/span&gt; una calidad de diseño adecuada, pero nunca sobre los muros, sino solo en el interior de las aperturas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) En placas adosadas en muros de fachada, estas placas deberán tener una forma que esté en armonía con la composición de la fachada y no podrán tener una anchura superior a 2/3 de la anchura del pilar ni de una altura superior a 1/3 de su altura.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Deberán estar separadas de la cara exterior de la pared como mínimo 5 cm y se deberán sujetar mediante grapas o gatillos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Las placas podrán ser de &lt;span style="color: black"&gt;metacrilato&lt;/span&gt; o de cristal transparente, translúcido u opaco, tanto liso como grabado; de madera; de chapa metálica esmaltada o laqueada; de piedra; de bronce, latón o de otros materiales que &lt;span style="color: black"&gt;estén&lt;/span&gt; en armonía. Se prohíben explícitamente otros materiales plásticos, el acero inoxidable, el aluminio &lt;span style="color: black"&gt;visto&lt;/span&gt; y otros acabados metalizados brillantes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El rótulo con el nombre del establecimiento se deberá hacer con los criterios indicados 8 9 7 6 del &lt;span style="color: black"&gt;BOCAIB&lt;/span&gt; nº 71 del 8-06-2000 en el apartado anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Se ejemplifica la disposición en el gráfico “Condiciones de recomposición de locales disconformes en planta baja”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;3. Se prohíben los rótulos en “banderola”.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En cuanto a los rótulos, también intervienen otros artículos normalizados, como:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;B) TOLDOS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se prohíben las marquesinas. (Se define una &lt;em&gt;marquesina&lt;/em&gt; como cubierta de cristal, metal, madera, &lt;span style="color: black"&gt;metacrilato&lt;/span&gt;, cemento armado, que &lt;span style="color: black"&gt;sale&lt;/span&gt; de una fachada &lt;span style="color: black"&gt;sobre&lt;/span&gt; una puerta, una andén, etc., para resguardar de la lluvia a los entrantes y salientes).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los toldos móviles deberán tener todos los puntos, hasta los de la estructura, situados a una altura mínima por encima de la rasante de la acera de 2,25 m. El voladizo sobresaliente, con respecto a la alienación exterior, en ningún caso podrá superar los 2,50 m. Deberán ser de lona y de color natural, hueso, marfil u ocre claro.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se prohíben explícitamente otros colores.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Solo se podrán admitir encajados en cada apertura, sin exceder la anchura.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;C) ILUMINACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La iluminación de fachadas de locales comerciales y, en particular, de los rótulos se deberá hacer mediante focos exteriores, colocados a una distancia máxima de 50 cm con respecto al paramento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La longitud máxima del brazo con respecto a la fachada deberá ser de 50 cm.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En ningún caso se podrán situar a una altura inferior a 2,50 m con respecto al plano de la acera.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los focos deberán ser preferentemente de color blanco, con la finalidad de reducir la presencia visual.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En caso de que &lt;span style="color: black"&gt;sean&lt;/span&gt; modificados estos artículos del Pla Especial, se adoptarán las consiguientes modificaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;QUINTO.&lt;/strong&gt; CONDICIONES PARA LA INSTALACIÓN DE ELEMENTOS PUBLICITARIOS FUERA DEL NÚCLEO ANTIGUO:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;1. En cuanto a los RÓTULOS para locales comerciales en planta baja, se &lt;span style="color: black"&gt;autorizan&lt;/span&gt; los tipos de rótulos que se &lt;span style="color: black"&gt;especifican&lt;/span&gt; a continuación:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;a) En una franja encajada bajo o &lt;span style="color: black"&gt;sobre&lt;/span&gt; el dintel del agujero de la fachada o sobre esta (sobre un hueco o de unos cuantos huecos; en este caso, nunca podrán salir de la agrupación de tres de estos).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta franja no podrá tener una anchura superior a 40 cm cuando el local se &lt;span style="color: black"&gt;sitúe&lt;/span&gt; en el núcleo urbano, ni superior a 60 cm en las urbanizaciones.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El rótulo con el nombre del establecimiento, la actividad, u otros aspectos publicitarios se deberán inscribir en esta franja.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;b) En placas adosadas en muros de fachada.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Estas placas no podrán tener una anchura superior a 2/3 de la anchura del macizo, ni una altura superior a 1/3 de su altura. Deberán estar separadas de la cara exterior de la pared como mínimo 2 cm y se deberán sujetar mediante grapas o gatillos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El rótulo con el nombre del establecimiento se deberá hacer con los criterios indicados en el apartado anterior.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se &lt;span style="color: black"&gt;admiten&lt;/span&gt; rótulos en banderola, en ningún caso se podrán situar a una altura inferior a 2,50 cm respecto al plano de la acera, y de medidas máximas de 60 x 60 cm.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;2. Los TOLDOS móviles deberán tener todos los puntos, hasta los de estructura, a una altura mínima de 2,25 m por encima de la rasante de la acera.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;El voladizo saliente, con respecto a la alineación exterior, en ningún caso podrá superar 2,50 m y siempre 20 cm menos que la anchura de la acera.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SEXTO.&lt;/strong&gt; En el caso de publicidad en los pisos superiores, se seguirán las premisas de los de planta baja para cada área.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SETENA.&lt;/strong&gt; &lt;span style="color: black"&gt;INFRACCIONS&lt;/span&gt; Y SANCIONES.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;INFRACCIONS&lt;/span&gt;. Se considerarán &lt;span style="color: black"&gt;infracciones&lt;/span&gt; MUY GRAVES las que &lt;span style="color: black"&gt;afecten&lt;/span&gt; a la colocación y/o al tamaño de los rótulos, de las placas, de los toldos y de las luminarias en el casco antiguo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se considerarán &lt;span style="color: black"&gt;infracciones&lt;/span&gt; GRAVES las que &lt;span style="color: black"&gt;afecten&lt;/span&gt; a la colocación y/o al tamaño de los rótulos, de las placas, de los toldos y de las luminarias fuera del núcleo antiguo.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se considerarán &lt;span style="color: black"&gt;infracciones&lt;/span&gt; LEVES las referidas a los materiales y al color.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;SANCIONES. Las &lt;span style="color: black"&gt;infracciones&lt;/span&gt; consideradas como MUY GRAVES serán sancionadas con multa económica de hasta 3.000 €, las GRAVES con una multa económica de hasta 1.500 €, y las LEVES con multa económica de hasta 750 €, y &lt;span style="color: black"&gt;pueden&lt;/span&gt; ser acumulativas.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;OCTAVO.&lt;/strong&gt; En cuanto a la aplicación de las sanciones a las &lt;span style="color: black"&gt;infracciones&lt;/span&gt; consignadas en el artículo anterior, se seguirá el procedimiento previsto en el Reglamento 14/1994 de la &lt;span style="color: black"&gt;CAIB&lt;/span&gt; para el ejercicio de la potestad sancionadora en el ámbito de las Illes Balears.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;NOVENO.&lt;/strong&gt; En caso de instalación de cualquier elemento publicitario sin la previa licencia municipal, por parte del Ajuntament se instará al titular, propietario o encargado del establecimiento para que lo retire inmediatamente en el plazo de 48 horas; y si esto no se verifica, se procederá por vía de ejecución forzosa a la retirada subsidiaria por el Ajuntament y a cargo del infractor.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;DÉCIMO.&lt;/strong&gt; Esta ordenanza entrará en vigor una vez transcurridos los plazos legalmente establecidos desde su publicación en el &lt;span style="color: black"&gt;BOIB&lt;/span&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Los rótulos que &lt;span style="color: black"&gt;justifiquen&lt;/span&gt; una existencia previa de 50 años a la publicación de esta ordenanza deberán ser aprobados por el órgano competente.&lt;/span&gt;&lt;/p&gt;
