Aprobación de las bases y la convocatoria de las ayudas del Consejo Insular de Menorca en materia cinegética año 2013]] ![CDATA[<p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-weight: normal"> <span style="font-family: times new roman, times, serif; font-size: 12px">Se hace público que el Consejo Ejecutivo del Consejo Insular de Menorca, en sesión ordinaria de 3 de junio de 2013, adoptó, entre otros, el acuerdo siguiente:</span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">PRIMERO.- Aprobar las bases que rigen la concesión de ayudas del Consejo Insular de Menorca para la realización de actividades en materia cinegética y sus anexos.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">SEGUNDO.- Aprobar, simultáneamente, la convocatoria correspondiente al año 2013, que se regirá por las bases a que se ha hecho referencia en el punto anterior, de acuerdo con las siguientes condiciones:</span></span></p> <p style="margin-top: 0.1cm; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">BASES QUE RIGEN LA CONCESIÓN DE SUBVENCIONES DEL CONSEJO INSULAR DE MENORCA EN MATERIA CINEGÈTICA</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. OBJETO</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">El objeto de estas ayudas es apoyar determinadas actividades sin ánimo de lucro realizadas en el territorio de Menorca en materia cinegètica entre los días 16 de diciembre de 2012 y 30 de noviembre de 2013.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. FINALIDAD</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">De acuerdo con el principio de gestión sostenible del patrimonio faunístico y de sus hábitats, gestión calificada de interés público por la Ley 6/2006, de 12 de abril, de caza y pesca de las Islas Baleares, la finalidad de esta convocatoria es socioambiental, y va destinada a fomentar iniciativas sin ánimo de lucro que promuevan la mejora ambiental y, en consecuencia, la mejora del potencial conegético.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">3. FINANCIACIÓN E IMPORTE MÁXIMO</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1.Las ayudas que se otorguen en el marco de estas bases se harán con cargo a las partidas y el importe máximo que se establezcan en la convocatoria.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. Cuando el importe de las solicitudes de ayudas sea superior a la cantidad máxima fijada en la convocatoria, se aplicará lo establecido en la base 9.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">4. LINEAS SUBVENCIONABLES Y DOTACIÓN ECONÓMICA</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Las actividades subvencionables son diversas actividades sin ánimo de lucro llevadas a cabo por los beneficiarios, en el marco de su actividad cinegética, que impliquen la mejora ambiental, de calidad o cantidad de aprovechamiento de los recursos cinegéticos de uso racional y sostenible, la formación sobre el ejercicio de la caza por parte de los practicantes y sobre los recursos explotados y las practicas y modalidades tradicionales, el desarrollo socioeconòmico de la zona donde se encuentren los terrenos gestionados y el funcionamiento y la organización del beneficiario para la consecución de su objeto social.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. En ningún caso el valor del gasto subvencionable podrá ser superior al valor del mercado.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">3. En caso de alquiler de terrenos para coto de caza por parte de las sociedades de cazadores, se debe justificar que se ha elegido la mejor opción.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">4. Líneas de subvención:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Línea 1: Alquiler de terrenos de caza o de campos de adiestramiento educativo para le uso de las entidades solicitantes.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">A esta línea se destinará una cantidad máxima de 5.000€.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Línea 2: A esta línea se destinará una cantidad máxima de 15.000€ por las siguientes actividades.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">a. Vigilancia y señalización de los cotos o campos de entrenamiento educativo de las sociedades.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">b. Control selectivo de predadores y especies invasoras.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">c. Siembras para la caza con variedades vegetales de interés para la fauna cinegetica con parcelas identificadas catastralmente que cumplan su función biológica durante el período de reproducción y crianza de las especies cinegéticas, con un máximo del 5% de la superficie del coto hasta un máximo de 10 ha, en las que no se podrá levantar el cultivo o deberán dejar dos metros en las aceras para la fauna cinegética hasta el 30 de septiembre. Si se han de volver a sembrar, se podrá volver a arar estas parcelas entre el 15 de agosto y el 15 de septiembre, pero siempre previa comunicación al órgano administrativo competente en tramitar la solicitud de subvención. Sólo en estos casos podrá entrar el ganado 15 días antes de la próxima siembra.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">d. Repoblaciones con especies cinegéticas propias.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">e. Actividades relacionadas con el cuidado de los animales de caza.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">f. Promoción de las modalidades tradicionales de caza propias de Menorca y actividades cinegéticas con razas autóctonas de perros.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 120px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">g. Actividades federativas y ferias.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Pueden ser subvencionadas las actuaciones realizadas y pagadas desde el 16 de diciembre de 2012 hasta el 30 de noviembre de 2013.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">5. REGIMEN DE COMTABILIDAD CON OTRAS AYUDAS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Las ayudas que se otorguen de conformidad con estas bases son compatibles con la concesión de otras ayudas, sin perjuicio de la obligación de las entidades beneficiarias de comunicarlo al Consejo Insular en la forma establecida en estas bases.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. El importe de las subvenciones o ayudas que se concedan no puede superar en ningún caso , de manera aislada o en concurrencia con otras ayudas, el coste de la actividad subvencionada.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">6. REQUISITOS DE LOS BENEFICIARIOS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Pueden tener la condición de beneficiario:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">a. Asociaciones, sociedades, clubes, federaciones , fundaciones y cualesquiera otras entidades benéficas o sin ánimo de lucro.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">b. Las sociedades de cazadores locales que prevee la Ley 6/2006 balear de caza y pesca fluvial.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Las entidades referidas deberán acreditar que se encuentran legalmente constituidas y que su finalidad y su objeto social tienen relación directa con la actividad cinegética en cualquiera de sus vertientes.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. En cualquier caso, no pueden ser beneficiarios las personas o entidades en las que concurra alguna de las prohibiciones establecidas en el art. 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones y en el art. 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">7. PRESENTACIÓN DE LAS SOLICITUDES</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Las solicitudes se deben formalizar mediante el modelo normalizado que se adjunta como anexo I de estas bases y que se facilitará en la sede del Consejo Insular de Menorca en Maó, en las oficinas administrativas de Ciutadella, en Sa Granja (Maó) y Sa Roqueta (Ciutadella).</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. En la solicitud, se debe adjuntar la siguiente documentación:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Documentación administrativa común a las dos líneas:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">a. Copia compulsada del documento de identificación del representante (NIF).</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">b. Copia compulsada del documento de identificación fiscal de la entidad (NIF).</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">c. Original o copia compulsada de la escritura de constitución o modificación, de los estatutos o del reglamento interno de funcionamiento inscritos en el registro correspondiente.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">d. Acreditación de la representación en virtud de la cual actúa la persona que firma la solicitud.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">e. Si fuera necesario de conformidad con sus estatutos, han de aportar certificado del acuerdo adoptado por el órgano de gobierno de la entidad para solicitar la ayuda y para designar representante.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">f. Declaración responsable firmada por el solicitante o por su representante legal de no estar sometido a ninguna de las circunstancias que determinan la imposibilidad de obtener la condición de beneficiario o entidad colaboradora de las subvenciones públicas recogidas en el art. 13. 2 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE núm. 276 de 18 de noviembre de 2003), el modelo se adjunta como anexo II de estas bases.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">g. Declaración responsable firmada por el solicitante o por su representante legal relativa a las subvenciones o ayudas obtenidas o solicitadas de otras instituciones públicas o privadas, para realizar la misma actividad. Anexo III .</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">h. Las solicitudes y toda la documentación transcrita en el apartado anterior se presentarán, dentro del plazo establecido en la convocatoria, en los puntos del Servicio de Atención al Ciudadano del Consejo Insular de Menorca que hay en la sede del CIM de Mahón, en las oficinas administrativas del Ciutadella, en las dependencias de Sa Roqueta y Sa Granja y en aquellos ayuntamientos que tengan suscrito un convenio con el CIM para la prestación de este servicio.Asimismo se pueden presentar en cualquier otro punto de acuerdo con lo establecido en el art. 38 de la Ley 30/92, de 26 de noviembre, de régimen jurídico de las administraciones públicas y de procedimiento administrativo común.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">4. Si la solicitud o la documentación fueran incorrectas o incompletas, el Consejo Insular de Menorca requerirá la rectificación o el complemento necesarios. Si en el plazo de diez días hábiles, contados desde el día siguiente de la fecha de recepción del requerimiento de subsanación de la solicitud, la persona interesada no hace la rectificación reclamada o no presenta la documentación requerida, se entenderá que ha desistido de su petición de conformidad con el artículo 71 Ley 30/92 de 26 de noviembre.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">8. DETERMINACIÓN DEL IMPORTE DE LA SUBVENCIÓN</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. PROCEDIMIENTO Y ÓRGANOS COMPETENTES PARA LA CONCESIÓN DE LAS AYUDAS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Las ayudas se concederán, de acuerdo con los principios de objetividad, transparencia, igualdad, no discriminación y publicidad, mediante el procedimiento de concurrencia competitiva.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. El inicio del expediente se efectuará por medio de la aprobación de la convocatoria correspondiente.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">3. La persona a quien corresponda la instrucción se determinará en la convocatoria, y le corresponde realizar de oficio todas las actuaciones necesarias para la determinación, conocimiento y comprobación de los datos en virtud de las cuales se dictará resolución sobre la concesión de las ayudas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">4. Las solicitudes presentadas dentro del plazo establecido en la convocatoria se someterán al examen de la Comisión Evaluadora.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">5. Una vez examinadas las solicitudes por la Comisión Evaluadora, y después de que ésta haya emitido su informe, el consejero ejecutivo jefe del departamento elevará la correspondiente propuesta de resolución al órgano competente, que en este caso es el Consejo Ejecutivo del Consejo Insular de Menorca, que dictará resolución sobre la concesión o denegación de las ayudas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">6. Cuando la cuantía de la ayuda propuesta pro el órgano instructor sea sustancialmente inferior al solicitado, se podrá instar al beneficiario a reformular su solicitud para ajustar los compromisos y condiciones de la subvención otorgable.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">7. La resolución del expediente de otorgamiento de las subvenciones debe ser expresa y motivada, y debe fijar, con carácter definitivo, la cuantía específica de cada una de las subvenciones concedidas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">8. El plazo máximo para dictar y notificar la resolución expresa de concesión de subvención será de dos meses contados desde la fecha de finalización del plazo de presentación de solicitudes. El silencio administrativo tendrá carácter desestimatorio.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">9. La resolución del expediente de concesión o denegación de las ayudas se publicará en el <i>Boletín Oficial de las Islas Baleares,</i> sin perjuicio de notificar de forma individual a las personas interesadas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">10. La concesión de la ayuda se puede instrumentar mediante la formalización de un convenio de colaboración con la entidad beneficiaria donde se determinarán los derechos y las obligaciones de las partes.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">12. ABONO DE LAS AYUDAS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Las ayudas se abonarán, por norma general, cuando el beneficiario haya justificado la realización de la actividad subvencionada de conformidad con lo establecido en estas bases.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. La ayuda se hará efectiva en el plazo máximo de 60 días contados desde la justificación correcta y completa de la actividad y siempre que la disponibilidad de tesorería lo permita.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">3. No se podrá pagar la subvención en tanto el beneficiario no se encuentre al corriente en el cumplimiento de sus obligaciones tributarias y frente a la Seguridad Social.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">13. JUSTIFICACIÓN DE LOS GASTOS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. Las entidades beneficiarias están obligadas a justificar los gastos efectuados con cargo a la ayuda económica concedida antes del día 30 de noviembre del año de la convocatoria, salvo que existan causas excepcionales que lo impidan y que los beneficiarios deben alegar por escrito. A la vista de lo anterior, el CIM podrá ampliar el plazo de justificación de las ayudas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. Para la Línea 1:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">-Los alquileres de terrenos de caza o campos de entrenamiento educativo para el uso de las entidades solicitantes.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">b. Para la Línea 2:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Los gastos de vigilancia y señalización de los cotos o campos de entrenamiento educativo pertinentes a las sociedades solicitantes. Se entiende por vigilancia, aparte de la vigilancia en sí, la gestión ambiental de los terrenos de caza, gastos derivados de la formación, importe de adquisición de equipamientos y las compras del material necesario para llevar a cabo estas tareas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Los gastos necesarios para hacer el control selectivo de predadores y especies invasoras.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Los gastos generados por las siembras objeto de subvención.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Las repoblaciones con especies cinegèticas propias. Engloban los gastos de compra, transporte, alimentación asociada y de mejoras de infraestructuras asociadas a la repoblación.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Los gastos derivados de actividades relacionadas con el cuidado de los animales de caza. Engloba las siguientes actividades: chips de identificación canina, gastos veterinarios de vacunas y desparasitaciones de perros de caza y seguros.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Los gastos necesarios para llevar a cabo la promoción de las modalidades tradicionales de caza propias de Menorca y actividades cinegèticas con razas autóctonas de perros. Incluye:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Gastos derivados de la organización y relación de pruebas funcionales, festividades y actividades de promoción de perros de caza autóctonas y modalidades tradicionales.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Gastos de utensilios propios de la actividad: adquisición y reparación, destinados a los beneficiarios definidos en la base 6.1, inventariables y gestionados por la sociedad ( se debe presentar certificado del beneficiario que acredite este punto).</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 80px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Las actividades federativas y ferias: engloban los gastos federativos como cuotas, material de oficina y gastos varios.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">4. Si la documentación presentada es incompleta o incorrecta, el servicio responsable pedirá al beneficiario que haga la rectificación oportuna en el plazo improrrogable de diez días hábiles.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">5. Si el gasto justificado excede del importe concedido, la posible desviación presupuestaria irá a cargo de la entidad subvencionada.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">6. Si el gasto justificado es inferior al importe del presupuesto solicitado y subvencionado se reducirá proporcionalmente la subvención concedida.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">7. El Consejo Insular de Menorca podrá inspeccionar las actividades subvencionadas, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">14. OBLIGACIONES DE LOS BENEFICIARIOS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Deben cumplir las obligaciones siguientes:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">a. Los beneficiarios de esta convocatoria deben facilitar en cualquier momento la información que le solicite en CIM sobre las tareas que desarrollen.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">b. Comunicar al CIM la aceptación de la subvención en los términos en que ésta se conceda. En cualquier caso la subvención se entenderá aceptada tácitamente cuando hayan transcurrido quince días hábiles desde que el beneficiario haya recibido la notificación de la concesión.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">c. Realizar la actividad objeto de subvención en el plazo máximo que se establezca.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">d. Llevar a cabo las actividades que fundamentan la concesión de las ayudas y justificar su realización,en los plazos y en las condiciones establecidas en estas bases y en la resolución de concesión de las ayudas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">e. Comunicar al Consejo Insular de Menorca la solicitud y la obtención de subvenciones y ayudas para la misma finalidad.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">f. Hacer constar, de manera expresa, el apoyo del Consejo Insular de Menorca en la realización de las actividades subvencionadas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">g. Comunicar inmediatamente al Consejo Insular de Menorca cualquier eventualidad que altere o dificulte gravemente el desarrollo del proyecto subvencionado, en particular si se pueden derivar retrasos en la ejecución o si pueden efectar al coste total, y solicitar la autorización previa y expresa del Consejo Insular para hacer cualquier modificación sustancial del proyecto objeto de ayuda. Las solicitudes de modificación deben ser motivadas, se deben formular inmediatamente a la aparición de las circunstancias que la justifiquen y han de especificar las repercusiones presupuestarias que impliquen.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">h. Someterse a las actuaciones de comprobación que efectúe el Consejo Insular de Menorca y el resto de organismos competentes para la fiscalización de las cuentas públicas.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">y. Acreditar, cuando el Consejo Insular lo solicite, que se encuentran al corriente de las obligaciones tributarias y con la seguridad social. La acreditación de estar al corriente de las obligaciones tributarias no será necesaria en el caso de que se haya autorizado expresamente al Consejo Insular a consultar estos datos a través de la Agencia Tributaria.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">15.RENOVACIÓN Y REINTEGRO DE LAS AYUDAS. CRITERIOS DE GRADUACIÓN DE POSIBLES INCUMPLIMIENTOS</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">En cuanto a la revocación y el reintegro de las subvenciones, se aplicará lo dispuesto en la Ley 38/2003, de 17 de noviembre, general de subvenciones y el resto de normativa que sea aplicable. En caso de incumplimiento se debe reintegrar la cuantía recibida mediante la aplicación de un porcentaje de minoración en función de la naturaleza del incumplimiento. Para la determinación del porcentaje se debe valorar, en todo caso, el grado de incumplimiento, si éste se ha debido a actuaciones dolosas o negligentes y si ha habido buena o mala fe. Este porcentaje se fijará previo informe del instructor y se debe notificar al beneficiario. Las causas de reintegro y el procedimiento para su exigencia se regirán por lo establecido en el artículo 44 del DLEG 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">La gradación del reintegro será mayor cuando el incumplimiento sea total o muy alto y hayan incurrido causas dolosas y mala de fe, en cambio, se irá aminorando en función del grado de cumplimiento del proyecto subvencionado y cuando haya sido causado por actuaciones negligentes y con buena fe.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">En el caso de que la causa del reintegro determine la invalidez de la resolución de concesión se debe revisar previamente esta resolución en los términos establecidos en el artículo 25 del DLEG 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones, y en el resto de disposiciones aplicables.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">En el caso e que se hayan hecho unos pagos anticipados, la persona beneficiaria debe reintegrar las cantidades recibidas más el interés de demora a contar desde que el pago se hizo efectivo.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Las cantidades que se deban reintegrar tienen la consideración de ingresos de derecho público y se les puede aplicar vía de apremio.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">La obligación de reintegro establecida en este artículo es independiente de las sanciones que en su caso sean exigibles.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">16. INFRACCIONES Y SANCIONES</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">1. El régimen de infracciones y sanciones administrativas aplicables será el establecido en el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y el título V del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">2. El órgano competente para imponer las sanciones que se deriven de infracciones de lo establecido en estas bases y de la normativa aplicable en materia de subvenciones es la Presidencia del Consejo Insular de Menorca, de conformidad con lo establecido en el art. 9 de la Ley 8/2000,de 28 de octubre, de consejos insulares.</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none"> <strong><span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">17. OTRAS DISPOSIONES</span></span></strong></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal; text-decoration: none; margin-left: 40px"> <span style="font-family: times new roman, times, serif; font-size: 12px"><span style="background: none repeat scroll 0% 0% transparent">Recursos administrativos:</span></span></p> <p style="margin-top: 0.1cm; margin-bottom: 0.1cm; font-style: normal; font-weight: normal;
