    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;De acuerdo con el artículo 8 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, hacemos público el convenio “Convenio de colaboración entre el Consejo Insular de Formentera y la Asociación de ayuda al enfermo oncológico de Baleares (ADAMOB)”, que literalmente dice: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;CONVENIO DE COLABORACIÓN ENTRE EL CONSEJO INSULAR DE FORMENTERA Y LA ”ASOCIACIÓN DE AYUDA AL ENFERMO ONCOLÓGICO DE BALEARES” (ADAMOB)&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Formentera, a 10 de mayo de 2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;REUNIDOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;De una parte, el Hble. Sr. Jaume Ferrer Ribas, Presidente del Consejo Insular de Formentera, quien actúa en nombre y representación de este, con CIF núm. P-0702400-C y con domicilio social en la plaza de la Constitución núm. 1, de Sant Francesc Xavier, en virtud del Acto del Pleno del Consejo Insular de Formentera de fecha 11 de junio de 2011, y de acuerdo con lo que dispone el artículo 136 del Reglamento orgánico del Consejo Insular de Formentera (ROC), los artículos 34 y 41.3 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local y el artículo 9 de la Ley 8/2000, de 27 de octubre, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Y de la otra parte:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;D. Jaime Coll Sureda, mayor de edad, con DNI núm. 41.371.288-S, en calidad de Gerente de la Asociación de Ayuda al Enfermo Oncológico de Baleares, en adelante ADAMOB, a la que representa en el presente acto, con domicilio a los efectos de notificaciones en Palma de Mallorca, c/ Venezuela, núm. 1, C.P. 07014 y teléfono 971733473.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Ambas partes se reconocen mutua y recíprocamente la capacidad legal suficiente y necesaria para formalizar este convenio y libremente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;EXPONEN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;I. La Ley 9/1987, de 11 de febrero, de acción social, tiene como finalidad principal conseguir el mayor bienestar social posible al territorio de las Islas Baleares, de forma progresiva y en todos sus aspectos, mediante un sistema de acción social integrado por servicios sociales y medidas de asistencia social que favorezcan el desarrollo pleno de la persona dentro de la sociedad para superar y prevenir las causas determinantes de su marginación y promover la plena integración social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;II. Entre los principios básicos y prioritarios de la Ley de acción social está la solidaridad con las personas y los grupos sociales, para atender las necesidades sociales de manera global y procurar que toda la ciudadanía reciba las prestaciones en el ámbito del sistema de acción social, y la colaboración con la iniciativa privada sin ánimo de lucro, que será especialmente promovida e impulsada por el Gobierno de la Comunidad Autónoma, por los consejos insulares y por los ayuntamientos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;III. La Ley orgánica 1/2002, de 22 de marzo, reguladora del derecho de asociación, en su artículo núm. 31 menciona que las administraciones públicas, en el ámbito de las respectivas competencias, promoverán y facilitarán el desarrollo de las asociaciones que persigan finalidades de interés general, respetando siempre la libertad y la autonomía ante los poderes públicos, así como el establecimiento de ayudas y subvenciones para llevar a cabo sus actividades. Así mismo, las administraciones públicas podrán establecer, con las asociaciones que persigan objetivos de interés general, convenios de colaboración en programas de interés social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;IV. El Consejo Insular de Formentera tiene atribuidas en virtud de la Ley 12/1993, de 20 de diciembre, competencias en materia de servicios sociales y asistencia social, y en concreto se prevé la asunción como propias de las competencias en materia de concesión y gestión de las subvenciones y ayudas con finalidades asistenciales a personas físicas y en centros o entidades para beneficiarios residentes en el ámbito territorial de cada uno de los consejos, sobre las materias de tercera edad, marginados, minorías étnicas, infancia, familias, hogares e instituciones análogas. Ley ampliada por la Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social, (BOIB núm. 135, de 10 de noviembre) modificada por la Ley 6/2003 de 8 de julio (BOIB núm. 99, de 10 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;V. Que ADAMOB es una entidad dedicada a apoyar a las familias y a los enfermos de cáncer, y, según contemplan sus Estatutos, el objetivo prioritario es el de movilizar todos aquellos recursos necesarios con el fin de mejorar la calidad de vida de los enfermos de cáncer residentes a las Baleares y por este motivo articula diversos programas de ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;VI. Que tanto el Consejo Insular de Formentera como ADAMOB tienen objetivos comunes y que, por lo tanto, hace falta una estrecha colaboración que permita precisar el desarrollo de las actividades especificadas en las cláusulas especificadas a continuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Y por todo lo expuesto, ambas partes otorgan el presente convenio con sujeción a las siguientes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;CLÁUSULAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;strong&gt;PRIMERA.&lt;/strong&gt; Que ADAMOB se compromete a desarrollar y poner a disposición de los residentes en Formentera los servicios y programas que desarrolla, concretamente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Proporcionar alojamiento en el piso de acogida (una vez realizados los trámites y comprobaciones necesarias) para las personas desplazadas por motivos oncológicos desde Formentera a Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Apoyo psicológico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Información y asesoramiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Apoyo social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Proporcionar el personal que sea necesario para el normal funcionamiento de los programas, ya sea voluntario o contratado, y ocuparse en este último caso de las obligaciones que comporta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Someterse a las actuaciones de comprobación y organización que los órganos competentes del Consejo realicen respecto de la gestión de la solvencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-&amp;nbsp; Notificar al Consejo Insular de Formentera cualquier modificación que se pretenda realizar al proyecto inicialmente presentado, que tendrá que ser previamente autorizada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-&amp;nbsp; Presentar antes de 1 de diciembre de 2013 los documentos acreditativos de la justificación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;SEGUNDA.&lt;/strong&gt; Que el Consejo Insular de Formentera, en virtud del establecido en el artículo 28 del Decreto legislativo 2/2005, de 28 de diciembre y en el artículo 15 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, se compromete a asumir las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Aportar la cantidad económica de 2.000 euros a ADAMOB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Proporcionar todo el apoyo material y humano para favorecer y mejorar en lo posible la consecución de los objetivos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;TERCERA.&lt;/strong&gt; El Consejo Insular de Formentera subvencionará a ADAMOB la cantidad total de 2.000 euros (dos mil euros) de los presupuestos generales del Consejo Insular de Formentera para el ejercicio de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;a) El pago de la subvención se hará de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Un 50 % de la subvención a la firma del Convenio. Esta cantidad se tendrá que justificar como máximo en un plazo de tres meses desde el pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- El 50 % restante una vez que se haya justificado el total de la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;b) La justificación de la actividad se tendrá que constatar mediante la presentación de la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Listado de justificantes y su relación con el programa subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Facturas originales justificativas de los gastos originados como consecuencia de la ejecución de la actividad objeto de subvención, la suma de las cuales será igual, como mínimo, a la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Memoria detallada justificativa de las actividades llevadas a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Certificación expedida por el secretario/a de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Los documentos de justificación de la subvención tendrán que presentarse antes del 1 de diciembre de 2013 en el Registro de Entrada del Consejo Insular de Formentera e irán dirigidos al Área de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Para hacer efectivo el pago de la subvención se tendrá que acreditar previamente estar al corriente de las obligaciones con la Agencia Tributaria, la Tesorería General de la Seguridad Social y con el Consejo Insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Para el pago de la subvención, el Consejo Insular podrá solicitar cualquier otra documentación o informes que se consideren adecuados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;En caso de que la justificación de la subvención sea inferior al presupuesto presentado se reducirá proporcionalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;CUARTA.&lt;/strong&gt; Se establece la obligación por parte de ADAMOB de reintegrar los fondos en el supuesto de incumplimiento de los requisitos y obligaciones establecidas para la concesión y, en todo caso, en los supuestos regulados en el artículo 44 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones de las Islas Baleares, en el artículo 37 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y en los artículos 91 a 93 del Real decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;QUINTA.&lt;/strong&gt; En cumplimiento con lo que dispone el artículo 11 de Decreto legislativo 2/2005, de 28 de diciembre (BOIB 31.12.05), por el cual se aprueba el texto refundido de la Ley de subvenciones, ADAMOB queda sometido a las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Llevar a cabo la actividad o la inversión o adoptar el comportamiento que fundamenta la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Justificar la realización de la actividad, como también el cumplimiento de los requisitos y las condiciones que determinan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-&amp;nbsp; Someterse a las actuaciones de comprobación que lleven a cabo los órganos competentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;-&amp;nbsp; Comunicar a este Consejo Insular la obtención de otras subvenciones para la misma finalidad, dentro del plazo de tres días hábiles desde la solicitud o la obtención de la subvención concurrente y, en cualquier caso, antes de justificar la aplicación que se tenga que dar a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Dejar constancia de la percepción y la aplicación de la subvención en los libros de contabilidad o en los libros registro que tenga que llevar el beneficiario de acuerdo con la legislación mercantil o fiscal que sea aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Conservar los documentos justificativos de la aplicación de los fondos percibidos mientras puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 de esta Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Respecto de las actividades subvencionadas, se hará constar en un lugar privilegiado y visible el escudo oficial del Consejo Insular con el siguiente texto: Consejo Insular de Formentera; Área de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;SEXTA.&lt;/strong&gt; El área de Bienestar Social del Consejo Insular de Formentera comprobará la justificación de la aplicación de la subvención, la realización de la actividad y el cumplimiento de la finalidad por la cual se concede, de acuerdo con lo que establece el artículo 39 del Decreto legislativo 2/2005, de 28 de diciembre (BOIB 31.12.05), por el cual se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;SÉPTIMA.&lt;/strong&gt; El convenio se resolverá si se dan las siguientes causas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Incumplimiento de las obligaciones por parte de cualquier de las partes firmantes, o de ambas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- La disolución de la entidad que subscribe el Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- La anulación o la revocación del acto de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Imposibilidad material o legal de cumplir las obligaciones que se derivan del objeto del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;- Denuncia de cualquiera de las partes manifestada por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;OCTAVA.&lt;/strong&gt; Las partes que subscriben este Convenio se comprometen a intentar resolver en común las diferencias que puedan surgir en la aplicación y la interpretación de este Convenio. Pero si esto no es posible, las cuestiones litigiosas que puedan afectar la interpretación y la ejecución de este Convenio tienen que ser del conocimiento y la competencia del orden jurisdiccional contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;NOVENA.&lt;/strong&gt; El presente convenio tendrá vigencia hasta el 31 de diciembre de 2013, desplegando sus efectos desde el inicio de la actividad por parte de ADAMOB el 1 de enero de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;DECENA.&lt;/strong&gt; En aquello no previsto en este Convenio se estará a lo que se disponga al Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la ley de subvenciones en las Islas Baleares, a la Ley 38/2003, de 17 de noviembre, General de Subvenciones y al Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman, times, serif"&gt;&lt;span style="color: black"&gt;Y para que así conste y en prueba de conformidad, ambas partes firman este convenio por duplicado ejemplar y en un solo efecto, en el lugar y la fecha mencionados al encabezamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
