&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Que en el procedimiento SEGURIDAD SOCIAL 0000575 /2011 de este Juzgado de lo Social, seguidos a instancia de D/Dª EL MILOUD YOUB contra la empresa&amp;nbsp; MUTUA BALEAR MUTUA BALEAR,&amp;nbsp; TRIGO GALLARDO SL&amp;nbsp; ,&amp;nbsp; TIARAMONICO CONSTRUCCIONS SL&amp;nbsp; ,&amp;nbsp; INSTITUTO NACIONAL DE LA SEGURIDAD SOCIAL&amp;nbsp; ,&amp;nbsp; TESORERIA GENERAL DE LA SEGURIDAD SOCIAL&amp;nbsp; , sobre ORDINARIO, se ha dictado la siguiente resolución, cuya parte dispositiva se adjunta:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SENTENCIA&amp;nbsp; núm. 174/2013&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;En la Ciudad de Palma, a&amp;nbsp; 9 de mayo de 2013.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Vistos por el Ilmo. Sr. Magistrado-Juez del Juzgado de lo Social número tres de Palma de Mallorca, Don Juan-Gabriel Alvarez Rodríguez, los precedentes autos número 575/2011 seguidos a instancia de &lt;strong&gt;DON EL MILOUD YOUB , &lt;/strong&gt;frente al &lt;strong&gt;INSS&lt;/strong&gt;, &lt;strong&gt;TGSS, MUTUA BALEAR, MATEPSS Nº 183, TRIGO GALLARDO, S.L. y&amp;nbsp; TIARAMONICO CONSTRUCCIONS, S.L.&lt;/strong&gt; sobre PRESTACIONES POR INCAPACIDAD PERMANENTE&amp;nbsp; TOTAL.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px; text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;FALLO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;Que, desestimando la demanda&lt;/strong&gt; origen de las presentes actua­ciones, promovida por &lt;strong&gt;DON EL MILOUD YOUB , &lt;/strong&gt;frente al &lt;strong&gt;INSS&lt;/strong&gt;, &lt;strong&gt;TGSS, MUTUA BALEAR, MATEPSS Nº 183, TRIGO GALLARDO, S.L. y&amp;nbsp; TIARAMONICO CONSTRUCCIONS, S.L.&lt;/strong&gt; sobre PRESTACIONES POR INCAPACIDAD PERMANENTE&amp;nbsp; TOTAL, debo declarar y declaro que la parte actora no se encuentra incapacitada en grado alguno y de forma permanente&amp;nbsp; para su profesión habitual de albañil, confirmando la resolución del INSS de 3-2-2011, y debo absolver y absuelvo a las demandadas de la pretensión deducida en su contra. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Notifíquese esta resolución a las partes, haciéndoles saber que contra la misma cabe interponer &lt;strong&gt;Recurso de Suplicación&lt;/strong&gt; ante &lt;strong&gt;la Sala de lo Social del Tribunal Superior de Justicia de Baleares, &lt;/strong&gt;anunciándolo ante este Juzgado por comparecencia o por escrito en el plazo de los &lt;strong&gt;cinco días hábiles siguientes a la notificación del presente fallo,&lt;/strong&gt; de conformidad con lo dispuesto por los arts. 190 y ss de la LJS; siendo indispensable para el Ente Gestor, presentar ante este Juzgado, al anunciar el Recurso, la Certificación acreditativa de que comienza el abono de la prestación y que lo proseguirá puntualmente durante la tramitación del mismo.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Así por esta mi sentencia lo pronuncio, mando y firmo.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Diligencia de Publicación.- La extiendo yo la Sra. Secretaria&amp;nbsp; para dar fe de que la anterior resolución se publicó en el día de su fecha, estando el Ilmo. Sr. Magistrado que la dictó celebrando Audiencia Pública. Reitero fe.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Y para que sirva de notificación en legal forma a&amp;nbsp; TRIGO GALLARDO SL,&amp;nbsp; TIARAMONICO CONSTRUCCIONS SL, en ignorado paradero, expido la presente para su inserción en el Boletín Oficial de la Provincia de BALEARES.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &amp;nbsp;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Se advierte al destinatario que las siguientes comunicaciones se harán fijando copia de la resolución o de la cédula en el tablón de anuncios de la Oficina judicial, salvo el supuesto de la comunicación de las resoluciones que deban revestir forma de auto o sentencia, o cuando se trate de emplazamiento.&lt;/span&gt;&lt;/p&gt;
