&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;“DECRETO DE DELEGACIÓN DE COMPETENCIAS EXPEDIENTES SANCIONADORES EN MATERIA DE TENENCIA DE ANIMALES DOMÉSTICOS Y DE COMPAÑÍA&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;El Pleno del Ajuntament, reunido en sesión ordinaria del pasado día 26 de marzo de 2013, acordó nombrar Batle del Ajuntament de Santa Margalida al Sr. Antoni Reus Darder. habiendo tomado posesión del cargo en el mismo pleno.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;El entonces Primer &amp;nbsp;Teniente de Alcalde y Regidor de Urbanismo, Sr. Antoni Reus Darder, había sido designado instructor de los siguientes expedientes sancionadores incoados por presuntas infracciones administrativas en materia de tenencia de animales domésticos y de compañía:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;De acuerdo con del artículo 24 del Ordenanza municipal sobre tenencia de animales domésticos y de compañía (BOIB Núm. 143 14-10-2006 BOIB Núm. 106 21-07-2012, 5 del Decreto 14/1994), 5 del Decreto 14/1994, de 10 de febrero y 21.1.s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, el órgano competente para resolver el procedimiento es el Alclade.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En consecuencia, nos encontramos que la misma persona a quien corresponde la instrucción de los procedimientos es la competente para dictar la resolución de los mismos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La garantía de separación de la fase instructora y de la sancionadora establecida en el artículo 134.2 de la Ley 30/1992, de 26 de noviembre, se traduce en la necesidad de que la fase instructora y la fase sancionadora recaigan en personas distintas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Visto que el arte. 13 de la Ley 30/1992 y el artículo 43 del Real decreto 2568/1986, de 28 de noviembre, por el que se aprueba el Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales permite la delegación de competencias atribuidas a esta Alcaldía y atendida la circunstancia antes mencionada, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;PRIMERO.- Delegar a la primera teniente de Alcalde, Sra. Beatriu Gamundí Molina, las competencias propias de Alcaldía relativas a los Expedientes Sancionadores que a continuación se relacionan, pudiendo dictar la resolución del procedimiento, actos administrativos que afectan a terceros así como resolver los recursos administrativos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;TERCER.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Notificar, con independencia de su publicación en el BOIB, la presente resolución individualmente al interesado indicando los recursos que procedan” &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra la presente resolución se podrá interponer recurso contencioso-administrativo ante el Juzgado Contencioso Administrativo de Palma, en el plazo de dos meses a contar desde el día siguiente de su notificación. Alternativamente y de forma potestativa, se puede interponer recurso de reposición ante el mismo órgano que lo ha dictado, en el plazo de un mes a contar desde el día siguiente de su notificación. Todo esto sin perjuicio de cualquiera otro recurso o reclamación que consideráis conveniente de interponer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
