    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;ASUNTO: NOTIFICACIÓN POR EDICTO DEL ACUERDO DE CONSEJO EJECUTIVO DE FECHA 20 DE MARZO DE 2013 RELATIVO AL INICIO DE EXPEDIENTE PÉRDIDA DEL DERECHO DE COBRO DE LA SUBVENCIÓN RELATIVA A LA CONVOCATORIA DE SUBVENCIONES PARA EL ALQUILER PARA ASOCIACIONES DE GENTE MAYOR POR EL PERIODO COMPRENDIDO ENTRE LOS MESES DE NOVIEMBRE DE 2010 I OCTUBRE DE 2011&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;De conformidad con lo que se dispone en el artículo 59.5 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, se procede mediante esta publicación a la formal notificación, a la Asociación Hermandad de Antiguos Caballeros Legionarios de Mallorca, que el Consejo Ejecutivo fecha 20 de marzo de 2013 ha adoptado el siguiente acuerdo:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&amp;quot;&lt;u&gt;Primero&lt;/u&gt;.- Iniciar el expediente para la declaración de la pérdida del derecho al cobro de la subvención concedida, a la convocatoria de subvenciones por el alquiler para asociaciones de gente mayor por el periodo comprendido entre los meses de noviembre de 2010 y octubre de 2011, ambos incluidos, por falta de justificación del total de la subvención concedida, a las asociaciones y por los importes (diferencia entre los documentos contables &amp;quot;D&amp;quot; y&amp;quot;O&amp;quot;) que se detallan:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;y consiguientemente dejar sin efecto los correspondientes documentos contables de disposición de gasto.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;u&gt;Segundo&lt;/u&gt;. - Nombrar como instructor de este procedimiento al señor Miquel Barceló Llompart, secretario técnico de la Vicepresidencia de Cultura, Patrimonio y Deportes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;u&gt;Tercero&lt;/u&gt;. - Notificar este acuerdo a las asociaciones interesadas y concederle un plazo de quince días para que alegue o presente los documentos que estime pertinentes.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;u&gt;Cuarto&lt;/u&gt;. - Notificar este acuerdo a la Intervención General del Consell de Mallorca.&amp;quot;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra este Acuerdo - que no agota la vía administrativa- se puede interponer un RECURSO DE ALZADA ante la Comisión de Gobierno del Consell Insular de Mallorca dentro del plazo de UN MES, contador desde el día siguiente de haber recibido la notificación.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la desestimación expresa del recurso de alzada se puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo en el plazo de dos meses contadores desde el día siguiente de la notificación de la desestimación del recurso mencionado.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la desestimación por silencio del recurso de alzada se puede interponer el recurso contencioso administrativo ante el Juzgado mencionado anteriormente, en el plazo de seis meses contadores a partir del día siguiente de la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado el Acuerdo).&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No obstante, se puede interponer, si procede, cualquier otro recurso que se estime oportuno y pertinente. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa y de la Ley 4/1999, de 13 de enero, de modificación de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
