    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En relación con el asunto de referencia, y de acuerdo con la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se comunica que el Pleno de la CMAIB, en sesión de 28 de febrero de 2013&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;CONSIDERANDO&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Que Gas y Electricidad Generación, SAU ha solicitado una revisión de la AAI consistente en la revisión de los límites de emisión atmosférica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.Que el informe emitido por la Sección de Contaminación Atmosférica de la D.G. de Medio Natural, Educación Ambiental y Cambio Climático es favorable a la revisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;ACUERDA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;informar favorablemente la revisión de la Autorización Ambiental Integrada de la CT de Maó, consistente en la revisión de los límites de emisión atmosférica, con sujeción a las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.Se modifica el punto 7 en lo referente a los condicionantes de contaminación atmosférica de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se eliminan los puntos 7.1 y 7.2 referentes al acuerdo voluntario y el convenio entre Gesa y la Consejería.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se modifican los límites máximos de emisión de los motores BW.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se elimina el punto 7.5.13 en lo referente a los derechos de emisión de los gases de efecto invernadero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Se modifica la redacción de los puntos 7.5.14 y 7.6.6.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;-Los puntos referentes a contaminación acústica y lumínica se trasladan al título de seguridad y actividades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La redacción del punto 7 queda de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;“ 7. Condicionantes de Atmósfera&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.1 Clasificación como actividad potencialmente contaminante de la atmósfera&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Esta central térmica, además de su inclusión en el epígrafe 1.1.a. de la Ley 16/2002, está incluida en el grupo A, punto 1.1.1 del anexo II de Actividades potencialmente contaminantes de la atmósfera, del Decreto 833/1975, de desarrollo de la Ley 34/2007.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.2 Reuniones con el departamento competente en materia de contaminación atmosférica y cambio climático&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Gesa Generación se reunirá al menos una vez al año con el departamento competente en materia de contaminación atmosférica y cambio climático para establecer un calendario para el cumplimiento de los objetivos de calidad de los datos de inmisiones, así como los datos de emisiones, mejoras en los equipamientos, etc.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3 Emisiones&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.1 Los puntos de muestreo de todas las chimeneas cumplirán los requisitos de la Orden Ministerial de 18 de octubre de 1976. En caso de que no sea posible se hará llegar una propuesta de punto de muestreo al departamento competente en materia de contaminación atmosférica y cambio climático. Tiene que cumplir con la normativa vigente en cuanto a riesgos laborales y dispondrá de sistemas automáticos como polipastos para la subida de equipos de análisis y material auxiliar.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.2 Se tiene que mantener actualizado el libro de registro con los datos de emisiones así como el libro de registro de operaciones de paradas, mantenimiento, incidencias, etc de acuerdo con lo dispuesto en la Ley 34/2007, de 15 de noviembre, de calidad del aire y protección de la atmósfera, y su normativa de desarrollo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.3 Todos los parámetros de proceso (contenido en oxígeno, presión, temperatura, …) así como las emisiones de contaminantes canalizadas se medirán y controlarán. El método de medida para cada contaminante será preferiblemente la UNE-EN; en caso de que no se pueda aplicar se tendrá que justificar la utilización de otros métodos, que serán, por este orden: EN, UNE-ISO, UNE, y otros métodos internacionales. Siempre que se publiquen nuevas normas que sustituyan las indicadas, se aplicarán las más recientes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.4 Se utilizará el método UNE-EN 14181: 2005 (Emisiones de fuentes estacionarias. Garantía de calidad de los sistemas automáticos de medida) para garantizar la calidad de todas las determinaciones automáticas en continuo de los contaminantes. Los sistemas de medida en continuo se calibrarán con los métodos de referencia una vez al año, por parte de una entidad especializada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.5 Para poder definir los límites de emisiones aplicables a los motores diesel de esta central se tienen que tener en cuenta: el Decreto 833/1975, según lo dispuesto en la Disposición transitoria primera, sobre emisiones de centrales térmicas de carbón o de fuel existentes, del Real decreto 430/2004; los valores históricos de los autocontroles quincenales; así como los valores de referencia indicados en el documento los valores históricos de los autocontroles quincenales; así como los valores de referencia indicados en el documento de referencia BREF para la aplicación de las Mejores Técnicas Disponibles (MTD) para estos tipos de instalaciones y con el mismo tipo de combustible elaborado por la Comisión Europea.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.6 Se tienen que medir en continuo los contaminantes SO2, NOx y partículas para los grupos BW1 a BW3.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.7 Los valores límites de emisión para los grupos BW1 a BW3 serán los siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;1.º Dióxido de azufre y partículas: un 97 por ciento de todos los valores medidos de cada 48 horas no supere el 110 por ciento de los valores límite de emisión.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;2.º Óxidos de nitrógeno: un 95 por ciento de todos los valores promedio de cada 48 h no supere el 110 por ciento de los valores límite de emisión.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;No se tendrán que considerar en estas valoraciones los periodos de encendido y parada o en momentos de mal funcionamiento o avería de equipos de reducción contemplados en el artículo 7.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.9 Para poder definir los límites de emisiones aplicables a las tres turbinas de gas existentes y la turbina que tiene previsto entrar en funcionamiento en junio de 2008 se tiene que considerar la fecha de puesta en funcionamiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Las turbinas de gas TG1 y TG2 están autorizadas antes de marzo de 2004, y la TG3 está autorizada en junio de 2004. Por lo tanto, se los aplica la disposición transitoria tercera del Real decreto 430/2004, sobre exclusión de la aplicación del capítulo II a las turbinas de gas autorizadas antes de la entrada en vigor de este RD.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.10 Por lo tanto, se tienen que tener en cuenta: el Decreto 833/1975, según lo dispuesto en la Disposición transitoria tercera; el Real decreto 430/2004; los valores históricos de los autocontroles quincenales; las horas de funcionamiento durante 2007 de estas turbinas de gas; así como los valores de referencia indicados en el documento de referencia BREF para la aplicación de las Mejores Técnicas Disponibles (MTD) por estos tipos de instalaciones y con el mismo tipo de combustible elaborado por la Comisión Europea.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Para los grupos TG1 y TG2 se pueden hacer autocontroles quincenales, considerando los históricos de funcionamiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Los autocontroles se podrán realizar con periodicidad trimestral, siempre y cuando los grupos funcionen únicamente como grupos de emergencia, es decir siempre que las horas de funcionamiento sean inferiores a las 500 anuales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Se harán controles anuales por parte de un Organismo de Control Autorizado (OCA).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.3.13 Con carácter general, los datos de emisiones se remitirán en continuo al departamento competente en materia de contaminación atmosférica. Si hay alguna superación de límites o alguna anomalía de funcionamiento se notificará inmediatamente después de su conocimiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.4.2 Las ubicaciones de las estaciones no son las más apropiadas según lo expuesto en los modelos de dispersión que se adjuntan en la Evaluación de Impacto Ambiental que acompaña al proyecto. Por lo tanto, se tendrán que determinar otras posibles ubicaciones donde se tendrán que trasladar, de acuerdo con el departamento competente en materia de contaminación atmosférica y cambio climático. Las nuevas ubicaciones tendrán que cumplir los criterios de macro y microimplantación de la normativa de evaluación de la calidad del aire ambiente. Además, en virtud del Acuerdo de la Comisión Permanente de Medio Ambiente de fecha 22 de febrero de 2008, se tendrá que instalar una nueva estación de medida en la ciudad de Maó.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.4.3 Los equipos tendrán que cumplir con las normas UNE y CEN establecidas y se tendrán que someter a mantenimiento, verificación, calibración y participación en ejercicios de intercomparación. Para cumplir con este requisito se establecerá un calendario acordado con el departamento competente en materia de contaminación atmosférica y cambio climático.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;7.4.4 Se tendrá que cumplir con los objetivos de calidad de los datos establecidos en la normativa de evaluación de la calidad del aire ambiente, en cuanto a cobertura de datos anuales e incertidumbres de medida.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;“8. Requisitos de Seguridad y Actividades&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;8.1 Plan de autoprotección&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;El titular de la actividad tendrá que disponer del preceptivo plan de Emergencia Interior registrado en la Dirección general competente en materia de Emergencias e implantado a la totalidad de las instalaciones y procesos que conforman la actividad, según el RD 1254/1999, de 16 de julio, por el cual se aprueban las medidas de control de los riesgos inherentes a los accidentes graves en el que intervengan sustancias peligrosas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;8.2 Seguridad industrial&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;El titular de la actividad tendrá que:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Inscribir las instalaciones correspondientes de la Dirección general de Industria, según las normativas vigentes de seguridad industrial, minera, etc… Las instalaciones previstas o existentes tienen que cumplir con la legislación vigente en materia de Industria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Revisar la inscripción en el Registro Industrial, y obtener el Documento de Calificación Empresarial.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Dar cumplimiento al Reglamento para la supresión de las barreras Arquitectónicas (Decreto 20/2003) en todo el que le sea de aplicación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Prevenir los riesgos laborales y velar por la salud y seguridad de los trabajadores, y éstos el deber de cumplir las medidas de prevención que se adopten, según lo establecido en la ley estatal 31/95 de prevención de los riesgos laborales. Las condiciones de trabajo se tendrán que ajustar a lo establecido en las disposiciones específicas y reglamentarias en materia de seguridad laboral. Teniendo que poner especial atención en el cumplimiento del RD 374/2001 sobre protección de los trabajadores contra los riesgos relacionados con los agentes químicos durante el trabajo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Hacer cumplir en los edificios de carácter industrial las prescripciones de protección contra incendios indicadas en el Real decreto 2267/2004, de 3 de diciembre, por el que se aprueba el Reglamento de Seguridad contra incendios en los establecimientos industriales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Por otro lado:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Las instalaciones de protección contra incendios y su mantenimiento se tendrán que ajustar a lo dispuesto en el Reglamento de instalaciones de protección contra incendios (RD1942/1993) y normas UNE correspondientes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-El almacenamiento de productos químicos se tendrá que adaptar al RD 379/2001, de 6 de abril, por el cual se aprueba el Reglamento de almacenamiento de productos químicos, y sus instrucciones técnicas complementarias.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-El almacenamiento de productos petrolíferos se tendrá que adaptar a lo que dispone el RD 2085/1994 por el que se desarrolla el Reglamento de instalaciones de productos petrolíferos, así como sus posteriores modificaciones.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Cuando se realicen ampliaciones de grupos de la Central, los grupos que se instalen tendrán que ser compatibles con el uso del gas natural. Se empleará gas natural en estas posibles ampliaciones, así como en aquellos grupos actuales que sean compatibles con el uso de gas natural, siempre que este combustible ya esté disponible.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;8.3 Contaminación Acústica&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Se efectuará una campaña anual de caracterización real de los niveles de ruido emitidos en el exterior durante las diversas fases típicas de la operación (encendidos, etc.) en horario nocturno y diurno, por la comprobación del cumplimiento de los límites establecidos en la normativa autonómica vigente en esta materia, es decir, la disposición adicional quince de la Ley 25/2006, de 27 de diciembre, de medidas tributarias y administrativas, y la Ley 1/2007, contra la contaminación acústica en las Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;8.4 Contaminación lumínica&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;Se cumplirá con aquello que establece la Ley 3/2005 de 20 de abril, de protección del medio nocturno de las Illes Balears.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;3.Se modifica el punto 9.3 de Control Documental para distinguir entre el control que periódicamente los organismos de control tienen que presentar ante la administración competente del informe anual que se tiene que presentar ante el órgano ambiental. Además, se elimina de la autorización ambiental integrada el informe sobre derechos de emisión.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;“9.3 Control documental&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;9.3.1 Control documental periódico&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Los informes anuales de emisiones de contaminantes a la atmósfera realizados por un Organismo de control autorizado (OCA), de acuerdo con lo dispuesto en el Decreto 104/2010, de 10 de septiembre, y en el Real decreto 100/2011, de 29 de enero, serán enviados por parte de la OCA al departamento competente en materia de contaminación atmosférica.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;9.3.2 Informe anual&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;El titular de la actividad enviará al Órgano Ambiental encargado de tramitar la AAI un único informe del periodo precedente, antes del 1 de marzo, en el que se incluirá:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Residuos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+La declaración anual de residuos de acuerdo con aquello que dispone el artículo 41.1 de la Ley 22/2011 y el artículo 18 del RD 833/1988.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+Declaración anual de los aparatos sometidos al inventario previsto en su punto tercero del RD 228/2006.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Emisiones e inmisiones al medio hídrico&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+Informe anual sobre los vaciados de las fosas sépticas de las aguas sanitarias.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+Informe anual sobre los puntos y volúmenes mensuales de extracción de las aguas subterráneas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+El informe anual de los parámetros indicados en el plan de vigilancia y control del vertido de la tierra al mar recogido en la presente AAI del efluente procedente de la central, de las aguas marinas receptoras y de los sedimentos y organismos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Ruidos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+Informe anual en el que se remitirán los controles de emisiones de ruidos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;-Con carácter general&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+Los datos exigidos por el RD 508/2007 y Reglamento (CE) 166/2006, de 18 de enero, se tendrán que comunicar telemáticamente al Registro informático PRTR-España, dentro de los plazos que correspondan, de forma anual.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+El Órgano Ambiental encargado de tramitar las AAI enviará a cada Dirección general o administración competente la documentación de la que tenga competencias.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: black"&gt;+Toda la información que sea susceptible de tratamiento informático se aportará en papel y en formato informático estándar.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
