    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Pleno del Ayuntamiento en sesión ordinaria celebrada &amp;nbsp;el día 18 de marzo de 2013, acordó la aprobación inicial de la Ordenanza sobre regulación y protección de animales domésticos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Publicado anuncio sobre dicha aprobación al BOIB núm. 45 de fecha 4-04-2013 y habiendo transcurrido un mes sin presentación de reclamaciones ni alegaciones, dicha Ordenanza es definitiva, quedando el texto íntegro de la siguiente manera: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;“ORDENANZA SOBRE REGULACIÓN Y PROTECCIÓN De ANIMALES DOMÉSTICOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo Preliminar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente Ordenanza se dicta al amparo del dispuesto por los artículos 25.2-a) y h) y 84.1 de la Ley 7/1985, de 2 de Abril, Reguladora de las Bases de Régimen Local; artículo 55 a 59 del Real decreto Legislativo 781/1986, de 18 de abril, por el cual se aprueba el Texto Refundido de Régimen Local; artículo 1 del Reglamento de Servicios de las Corporaciones Locales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se aplica de forma supletoria la Ley 1/1992, de 8 de abril, de protección de los animales que viven al entorno humano de las Islas Baleares ( *BOIB *núm.58 de fecha 14 de mayo de 1992 ).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 1.- Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Esta Ordenanza tiene como finalidad fijar la normativa que asegure una posesión de animales domésticos compatible con la higiene, la salud pública y la seguridad de personas y bienes, así como la garantía del buen trato a los propios animales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 2.- Ámbito de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Esta Ordenanza será de aplicación a los animales de compañía y a los animales abandonados que se encuentren dentro el Término Municipal de Llubí, independientemente del lugar de residencia de los propietarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 3.- Definiciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Animales de Compañía: Son animales de compañía los que siendo domésticos o estante como animales de compañía son mantenidos por los propietarios por placer y compañía sin intención de lucro por su parte ni actividad económica ejercida sobre aquellos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Animales de explotación: Son todos aquellos que siendo domésticos son mantenidos por el hombre con hasta lucrativos y/o productivos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Animales salvajes: Son los que, perteneciendo a la fauna autóctona o no, tanto terrestre como acuática o aérea, hacen muestras de no domesticación por su conducta o por falta de identificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Animales abandonados: Son los que sin ser silvestres, no tienen amo ni domicilio conocido, ni traen identificación de su procedencia o propietario, ni los acompaña ninguna persona que pueda demostrar su propiedad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 4.- Condiciones Sanitarias.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El propietario o poseedor de un animal de compañía está obligado a mantenerlo en buenas condiciones higiénico sanitarias., alojarlo en condiciones adecuadas y realizar los tratamientos preventivos declarados obligatorios por la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 5.- Identificación.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los propietarios o poseedores de animales domésticos tendrán que proveerlos de un sistema de identificación.. La actuación tiene que ser ejecutada necesariamente por un facultativo veterinario. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 6.- Animales en viviendas.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La posesión de animales en viviendas urbanas está condicionada a la existencia de un alojamiento adecuado y condiciones de tenencia, a no atentar contra la higiene pública y a no causar molestias a los vecindarios; sin que el número de animales pueda servir de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si la autoridad municipal decide que, por sus condiciones o número, no es aceptable la permanencia de animales en una determinada vivienda o local, sus propietarios tendrán que proceder a desalojarlos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 7.- Canes en vías públicas.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los canes que estén por la vía pública tendrán que ir acompañados de sus responsables mediante cadenas, correas o cordones resistentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los canes potencialmente agresivos tendrán que circular proveídos del correspondiente bozal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los canes y otros animales podrán ser libres, acompañados de las personas responsables. En ningún caso, se tolerará esta circunstancia cuando se trate de animales potencialmente agresivos con las personas o con los animales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los responsables de los animales tendrán que impedir que depongan sus excrementos a lugares de uso público, y, en general, a cualquier lugar destinado al tránsito de peatones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El responsable del animal tendrá que recoger y retirar los excrementos, y, también, limpiar la parte de la vía pública afectada. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 8.- Animales abandonados. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los animales aparentemente abandonados, serán recogidos y entregados a su propietario, si se puede identificar, recordándole sus obligaciones contenidas en esta Ordenanza. La recogida de animales de compañía , con chip, a la vía pública por parte de los servicios municipales (Brigada y/o Policía local) tendrá un coste de 60 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En caso de no poder identificar al propietario, el animal recogido será puesto a disposición de la Fundación Natura Parco. De aparecer el propietario con posterioridad, podrá recuperarlo una vez haya pagado los gastos ocasionados por su traslado más las correspondientes a manutención, chips y atención sanitaria, entre otras. Independientemente de la sanción antes dicha.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 9.- De las agresiones. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los animales que hayan causado lesiones a una persona u otro animal, así como los que hayan sido mordidos o los que sean sospechosos de tener la rabia, tendrán que ser sometidos a control veterinario oficial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sus propietarios están obligados a poner al animal a disposición de los servicios veterinarios correspondientes en la forma, plazos y condiciones que estos determinen, así como a satisfacer los gastos derivados del control del animal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 10.- Infracciones &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- De acuerdo con esta Ordenanza, las infracciones se clasifican en leves, graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;2.-Serán infracciones leves:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a. El uso de artefacto destinados a limitar o impedir la movilidad de los animales en condiciones prohibidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b. El incumplimiento por parte del poseedor del animal de las condiciones de limpieza y salubridad a las casetas de los animales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c. El incumplimiento que no tenga la consideración de grave o muy grave.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d. El abandono temporal no reiterado de un animal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;3. Serán infracciones graves:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a. Obligar a los animales a producir en caso de enfermedad o desnutrición o a una sobreexplotación que pueda hacer peligrar su salud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b. El suministro a un animal de sustancias no permitidas, siempre que esto no suponga perjuicio a tercero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c. La esterilización, la práctica de mutilaciones innecesarias, las agresiones físicas graves y el sacrificio de animales de compañía sin control facultativo o en contra del establecido por la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d. Las agresiones físicas que produzcan lesiones graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e. La alienación de animales con enfermedad no contagiosa, excepto que fuera desconocido por el vendedor en el momento de la transacción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f. La venta ambulante de animales fuera de los mercados y ferias legalizados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g. La no vacunación o la no realización de tratamientos sanitarios obligatorios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;4. Serán infracciones muy graves:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a. El abandono de animales de compañía, domesticados o salvajes en cautividad, o el reiterado aunque sea individualizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b. El suministro de sustancias no permitidas a los animales, excepto en el caso contemplado en el párrafo b del apartado anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c. La alienación de animales con enfermedad contagiosa, excepto si fuera indetectable en el momento de la transacción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d. La celebración de espectáculos de peleas de gallos y canes, u otros animales, sean o no de la misma especie, o de animales con el hombre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e. El uso de animales en fiestas o espectáculos en los cuales estos puedan ser objeto de daños, sufrimientos, tratamientos antinaturales, maltratos, burlas o en los cuales se pueda herir la sensibilidad del espectador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 11.- Sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Las infracciones cometidas contra los preceptos de esta Ordenanza serán sancionadas con multas de hasta 3.000 euros, tal y cómo establece la Ley reguladora de Bases de Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. La imposición de una multa por falta muy grave podrá comportar la confiscación de los animales objeto de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Los establecimientos donde se cometan infracciones muy graves de forma reiterada podrán así mismo ser objeto de cierre temporal, durante un periodo máximo de dos años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 12.- Graduación de las sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Las infracciones leves serán sancionadas con multa de hasta 750 euros; las graves, con multa de hasta 1.500 euros; las muy graves lo serán con multa de hasta 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Las conductas susceptibles de sanción administrativa, una vez tipificadas y en caso de ser objeto de sanción divisible o multa, se graduarán según los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a. La trascendencia social y el perjuicio causado por la infracción cometida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b. El ánimo de lucro ilícito y la cuantía del beneficio obtenido en la comisión de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 80px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c. La reiteración o reincidencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. En caso de reincidencia, se impondrá la sanción máxima del nivel que corresponda. Y si a esta ya se había establecido una sanción en su grado máximo, la infracción será calificada en el nivel inmediatamente superior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. A efectos de la presente Ordenanza, habrá reincidencia cuando existan dos resoluciones firmes por el mismo hecho infractor en el periodo de dos años o tres por hechos de diferente naturaleza en el mismo periodo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 13.- Responsabilidad y daños y perjuicios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La imposición de cualquier sanción prevista por la presente Ordenanza no excluye la responsabilidad civil, penalti y patrimonial y la eventual indemnización de daños y perjuicios que puedan corresponder al sancionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 14.- Procedimiento Administrativo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para imponer las sanciones a las infracciones previstas por la presente Ordenanza habrá que seguir el procedimiento sancionador regulado por la Ley de Procedimiento Administrativo (Ley 30/1992, de 26 de noviembre, Régimen Jurídico y Procedimiento Administrativo Común).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 15.- Órgano competente&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. La imposición de las sanciones corresponderá a la Junta de Gobierno local&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 16.- Recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las resoluciones que consten en los expedientes incoados se podrán recorrer en reposición ante el órgano que las hubiera dictado, como recurso previo a la interposición del proceso contencioso- administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Artículo 17.- Prescripción y caducidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Las infracciones leves al hecho que se refiere esta Ordenanza prescribirán a los dos meses de haberse cometido, las graves, al año, y las muy graves, a los dos años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px 0px 0px 40px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. El procedimiento sancionador caducará a los seis meses desde la última actuación y se entenderá que así ha ocurrido cuando no se haya llevado a cabo en este tiempo ninguna notificación de actuación o diligencia, sin perjuicio que el instructor del expediente pueda acordar un plazo mayor en resolución motivada y notificada al interesado, cuando la naturaleza o las circunstancias de la actuación o la diligencia en curso lo requieran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;DISPOSICIÓN DEROGATORIA ÚNICA.&lt;/strong&gt;- Queda derogada la Ordenanza sobre protección de animales domésticos y regulación de su tenencia (BOIB 24 de noviembre de 2009).”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Lo que se hace público para general conocimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
