    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;La Junta de Gobierno Local del Ayuntamiento de Capdepera, en sesión celebrada el día 22 de marzo de 2013, ha aprobado las siguientes bases y la convocatoria de las pruebas selectivas&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;BASES DEL CONCURSO PEL PROCESO DE CONSOLIDACIÓN DE OCUPACIÓN TEMPORAL CONFORME A LA DISPOSICIÓN TRANSITORIA CUARTA DE LA LEY 6/2005, DE 3 DE JUNIO, DE COORDINACIÓN DE LAS POLICÍAS LOCALES DE LES ILLES BALEARS, PARA PROVEER, CON CARÁCTER DE FUNCIONARIOS DE CARRERA, NUEVE PLAZAS DE GUARDIA DE LA POLICÍA LOCAL DEL AJUNTAMENT DE CAPDEPERA.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Primera.-&lt;/strong&gt; Objeto de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El objeto de esta convocatoria es la regulación del procedimiento de consolidación de ocupación temporal de nueve plazas vacantes de funcionario de carrera de la escala de Administración Especial, subescala de servicios especiales, clase Policía Local, ocupadas mediante nombramiento interino o en comisión de servicios antes de la entrada en vigor de la Ley 6/2005, de 3 de Junio, de Coordinación de las Policías Locales de las Islas Baleares, conforme a lo dispuesto en la disposición transitoria cuarta de la mencionada ley, y en cumplimiento de la sentencia 324/2008, de 17 de Diciembre, dictada por el Juzgado de lo Contencioso-Administrativo nº 2 de Palma de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Estas plazas se encuentran incluidas en la oferta pública de ocupación del año 2004 y 2005, que restaban ocupadas mediante nombramiento interino o en comisión de servicios antes de la entrada en vigor de la Ley 6/2005, de 3 de Junio, de Coordinación de Policías Locales de las Islas Baleares, y en cumplimiento de la sentencia antes mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Segunda.-&lt;/strong&gt; Requisitos de los aspirantes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;a) Ser español o tener la nacionalidad de alguno de los Estados miembros de la Unión Europea o de alguno de los países que hayan suscrito un tratado internacional en los términos establecidos en la Disposición Adicional Única de la Ley 17/1993, de 23 de Diciembre, sobre el acceso a determinados sectores de la función pública de los nacionales del resto de estados miembros de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Haber cumplido dieciocho años de edad y no exceder de los treinta y tres años. A estos efectos se compensarán los servicios prestados en la Policía Local como policía local o como auxiliar de policía local, o en cualquiera de los otros cuerpos y fuerzas de seguridad públicos. Sin embargo, se excusará del requisito de la edad máxima exigido para ingresar en esta categoría a las personas que al haber entrado en vigor la Ley 6/2005, de 3 de Junio, ocuparan una plaza con nombramiento interino o en comisión de servicios en municipios de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Estar en posesión de alguno de los títulos siguientes o equivalentes, conforme a la legislación actual: título de Bachiller Superior, título de Bachiller Universitario, título de Bachiller Unificado Polivalente (BUP), título de Bachiller-LOGSE, Formación Profesional de 2º Grado, haber superado las pruebas de acceso para mayores de 25 años o en condiciones de obtenerlo a la fecha en que finalice el plazo de presentación de instancias, salvo la excepción prevista en la Disposición Transitoria Octava de la Ley 6/05 (las personas que al entrar en vigor dicha ley hayan aprobado el curso básico de policía local, estén realizándolo o hayan ejercido en alguno de los municipios de las Islas Baleares restarán exentas del requisito de titulación establecido en el artículo 18 para acceder a la categoría de policía o policía auxiliar como funcionario de carrera durante el plazo de 4 años. En estos casos deberá acreditarse el título de Graduado Escolar, Formación Profesional de primer Grado o equivalente).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Estar en posesión en plena validez del curso de aptitud para Guardia de la Policía Local, expedido o convalidado por la Escuela Balear de la Administración Pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Tener la condición de policía local interino o en comisión de servicios, sean o no funcionarios interinos o en comisión de servicios del Ayuntamiento de Capdepera. Deberá reunir esta condición en el momento de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;f) No tener antecedentes penales por delitos dolosos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;g) Estar en posesión de los permisos de conducción de la clase A, B y BTP.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;h) No sufrir ninguna enfermedad ni defecto físico o psíquico, descritos en el anexo II del Decreto 70/89, de 6 de Julio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i) No haber sido separado ni despedido, mediante expediente disciplinario, del servicio de la Administración local, autonómica o estatal, ni estar inhabilitado para ejercer la función pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;j) Comprometerse a ir armados y, si fuera necesario, llegar a utilizar el arma, y prestar declaración jurada.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;k) Acreditar el conocimiento de la lengua catalana, aportando el certificado de nivel B2, de conocimientos medios de catalán, según la Orden del Consejero de Educación, Cultura y Universidades, de 21 de Febrero de 2013, por el cual se determinan los títulos, diplomas y certificados equivalentes a los certificados de conocimientos de lengua catalana de la Dirección general de Cultura y Juventud u otro organismo reconocido a tal efecto en la legislación vigente (BOIB nº 43, de 12.03.2013). Caso de no poder acreditarse, deberá realizarse una prueba de conocimientos de lengua catalana correspondiente al nivel B2, cuya duración será de una hora, la cual se calificará con “apto” o “no apto”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Esta prueba se organizará en dos áreas, que evaluarán las habilidades siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Área 1. Comprensión oral y expresión escrita&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Área 2. Comprensión lectora y expresión oral&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La calificación de no apto o la no comparecencia del aspirante a la prueba de catalán podrá comportar su exclusión del proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Tercera.- &lt;/strong&gt;Procedimiento de selección.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El procedimiento de selección para consolidar la ocupación temporal será el de concurso, conforme a lo dispuesto en el artículo 32, y en la Disposición Transitoria Cuarta de la Ley 6/2005, de 3 de Junio, de Coordinación de las Policías Locales de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Cuarta.- &lt;/strong&gt;Instancias. Presentación y documentos a presentar en el concurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las solicitudes deberán dirigirse al Presidente de la Corporación, conforme al modelo del Anexo I de estas bases. El plazo de presentación de solicitudes será de veinte días naturales, a contar desde el día siguiente a la publicación en el Boletín Oficial del Estado del anuncio en extracto de esta convocatoria, cuyas bases deberán haber sido publicadas previamente en el BOIB de manera íntegra. Los sucesivos anuncios se publicarán únicamente en el Boletín Oficial de la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las instancias también podrán presentarse en la forma que determina el artículo 38.4 de la Ley de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para ser admitidos y tomar parte en este proceso selectivo bastará que los aspirantes declaren bajo su responsabilidad que reúnen todas y cada una de las&amp;nbsp;condiciones exigidas en la Base Segunda, aportando fotocopia autenticada del DNI, justificantes, originales o fotocopias compulsadas de los méritos para ser evaluados en la fase de concurso. Los méritos aducidos y no justificados por los aspirantes en la forma indicada no serán valorados y en ningún caso se tendrán en cuenta méritos posteriores al haber finalizado el plazo de presentación de instancias. Así mismo, los aspirantes deberán confeccionar un índice en donde se recojan ordenadamente los méritos alegados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Así mismo, los aspirantes, para poder ser dispensados de la realización de la prueba de catalán, deberán presentar, junto con la instancia, los documentos que acrediten dichos conocimientos. A estos efectos no se tendrán en cuenta los documentos presentados con posterioridad a la fecha de presentación de instancias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los aspirantes deberán aportar el original del justificante de haber abonado con carácter previo la cantidad de 100 euros, en concepto de tasa para optar a pruebas de selección de personal. La carencia de justificación del pago de la tasa indicada determinará la exclusión del aspirante. Este pago no sustituye en ningún caso el trámite de presentar la solicitud en el plazo y forma prevista en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El importe de los derechos de examen únicamente será devuelto a aquellos que no hayan sido admitidos por falta de algunos de los requisitos exigidos para tomar parte en las pruebas selectivas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Quinta.-&lt;/strong&gt; Admisión de los aspirantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez finalizado el plazo de presentación de instancias, la Junta de Gobierno deberá aprobar la relación provisional de aspirantes admitidos; efectuar el nombramiento de los miembros del Tribunal; indicar el lugar, día y hora para la realización de las pruebas de conocimientos de lengua catalana para los aspirantes que no hayan acreditado documentalmente la titulación requerida. Dicha lista deberá ser publicada en el BOIB y en el tablón de anuncios de la Corporación, concediéndose un plazo de quince días para la formulación de reclamaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las reclamaciones, en el supuesto de que las hubiera, se aprobarán o excluirán en la resolución que se dicte, en la cual deberá ser aprobada la relación definitiva de aspirantes admitidos o excluidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En caso de que no se formulen reclamaciones en la lista provisional, ésta se elevará a definitiva, sin necesidad de tener que dictar otra resolución y publicación. Los errores de hecho podrán repararse en cualquier momento, de oficio o petición de la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los aspirantes excluidos podrán interponer directamente recurso contencioso-administrativo en el plazo de dos meses o bien recurso de reposición potestativo ante el órgano que ha dictado la resolución, en el plazo de un mes, ambos a contar desde la fecha de publicación de la lista.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Sexta.-&lt;/strong&gt; Tribunal Calificador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. En la misma resolución que declare aprobada la lista provisional de aspirantes admitidos y excluidos se efectuará el nombramiento de los miembros del tribunal calificador, como órgano encargado de valorar los méritos del concurso y hacer la propuesta oportuna al órgano competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. El Tribunal Calificador del proceso selectivo quedará constituido en la forma que determina el artículo 6 del Decreto 146/2001, de 21 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Presidente: Inspector de la Policía Local de Capdepera.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Vocales:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Dos vocales, titulares y suplentes designados por la consellería competente en materia de coordinación de policías locales.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Vocal: miembro de la Policía Local de Capdepera designado por el Alcalde o &amp;nbsp; Regidor en quien delegue.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Vocal: funcionario/a de carrera de la Corporación, designado por el Alcalde o &amp;nbsp; Regidor en quien delegue.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- Secretario: el de la Corporación o &lt;span style="color: black"&gt;funcionario en quien delegue, el cual tendrá &amp;nbsp; voz, pero no voto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Podrán nombrarse asesores del Tribunal, los cuales actuarán con voz pero sin voto. El nombramiento de éstos se hará público en el tablón de edictos de la corporación antes de realizar las pruebas en que participen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Tribunal calificador estará formado por un número impar de miembros, no inferior a cinco, y así mismo deberá designarse el mismo número de suplentes, de entre los cuales deberá figurar un Presidente, un Secretario y tres vocales, los cuales deberán poseer todos ellos un nivel de titulación igual o superior al exigido para acceder a las plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Tribunal no podrá constituirse ni actuar sin la presencia, como mínimo, del Presidente y Secretario -o de quienes les sustituyan- y de la asistencia de más de la mitad de sus miembros titulares o suplentes, indistintamente; las decisiones deberán&amp;nbsp; tomarse por mayoría.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los miembros del Tribunal deberán abstenerse de intervenir, debiéndose notificar a la autoridad que convoca cuando concurra alguna de las circunstancias previstas en el artículo 28 de la Ley de Procedimiento Administrativo o se hayan realizado tareas de preparación de aspirantes a las pruebas selectivas de acceso a las plazas de que se trata, durante los cinco años anteriores a la publicación de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Del mismo modo, los aspirantes pueden recusar a los miembros de los Tribunales cuando acontezcan algunas de las circunstancias previstas en el párrafo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los cargos de naturaleza política, representantes de las empleadas y empleados públicos y el personal eventual de la administración, así como los funcionarios interinos, no podrán formar parte del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A los efectos previstos en el Real Decreto 462/2002, de 24 de Mayo, relativo a indemnizaciones por razón de servicio, este Tribunal queda clasificado con la categoría de segunda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Séptima.&lt;/strong&gt;- Desarrollo del proceso selectivo.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El sistema de selección será el de concurso. Éste se iniciará en la fecha en que se determine una vez hecha pública la lista definitiva de aspirantes admitidos y excluidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Con carácter previo al inicio del proceso selectivo, aquellos aspirantes que no hayan demostrado estar en posesión de los certificados o títulos acreditativos del conocimiento de la lengua catalana deberán realizar una prueba de nivel B2. Es obligatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Si el aspirante ha obtenido la calificación de no apto o no ha comparecido a realizar esta prueba ello podrá comportar la exclusión del proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La fase de concurso será posterior a la prueba de conocimientos de la lengua catalana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En esta fase se valorarán los méritos acreditados por los aspirantes conforme a los criterios de valoración y puntuación que figuran en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez finalizada la valoración del concurso, el Tribunal publicará la lista provisional con las puntuaciones obtenidas por los aspirantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Todos los aspirantes dispondrán de un plazo de 3 días hábiles, a contar a partir del día siguiente a la fecha de publicación de la lista provisional, para efectuar las reclamaciones oportunas. El tribunal dispondrá de un plazo de 5 días hábiles para resolver las reclamaciones presentadas y, a continuación, hará pública la lista definitiva de las puntuaciones de los aspirantes. En caso de no se producirse ninguna reclamación la lista provisional será definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Octava.-&lt;/strong&gt; Relación de aprobados, presentación de documentos y nombramiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez finalizada la calificación de los aspirantes, el Tribunal Calificador hará publica, a través del tablón de anuncios de la Corporación, la relación de aprobados por orden de puntuación obtenida, indicando la respectiva calificación obtenida por cada uno de ellos, y con propuesta de nombramiento a favor de los aspirantes que hayan obtenido las mayores puntuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;En caso que se produzca un empate, se dará prioridad a quién haya obtenido mayor puntuación en el curso de formación básica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Tribunal elevará a la Alcaldía la relación de las calificaciones obtenidas por los aspirantes y propondrá el nombramiento de aquellos que a pesar de cumplir los requisitos exigidos en la convocatoria hayan obtenido la mayor puntuación en la valoración de méritos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los aspirantes propuestos deberán aportar ante la Secretaría General de esta Corporación, dentro del plazo de veinte días naturales, a contar desde el momento en que se haga pública la lista de calificaciones con propuesta de nombramiento, los documentos acreditativos de reunir los requisitos exigidos en la Base Segunda. Aquellos que dentro del plazo señalado no presenten dicha documentación no podrán ser nombrados, quedando anuladas sus actuaciones, sin perjuicio de la responsabilidad en que hayan podido incurrir por falsedad en la instancia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Aquellos que tengan la condición de funcionario público estarán exentos de justificar las condiciones y requisitos ya acreditados para obtener su anterior nombramiento, y únicamente deberán presentar la certificación del Ministerio, Organismo o Corporación Local de que dependan, y acreditar su condición y otras circunstancias que consten en su expediente personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez presentada dicha documentación, se realizarán los nombramientos de los aspirantes, los cuales deberán tomar posesión de las plazas como máximo dentro de los treinta días hábiles posteriores, a contar a partir del día siguiente de haberles sido notificado el nombramiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Novena.-&lt;/strong&gt; Incidencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El Tribunal queda autorizado para resolver las dudas que se presenten y tomar los acuerdos necesarios para el buen orden de las pruebas selectivas, en todo aquello no&amp;nbsp; previsto en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;strong&gt;Décima.&lt;/strong&gt;- Impugnaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La presente convocatoria y los actos administrativos que se deriven podrán ser impugnados por los interesados en los casos y en la forma establecida por la Ley 30/1992, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;BAREMO DE MÉRITOS&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Se aplica a aquellos aspirantes que accedan a un puesto de trabajo del Ayuntamiento en el cual han prestado servicios como funcionarios de cualquier categoría en comisión de servicios o con nombramiento interino antes de la entrada en vigor de la Ley 6/2005, de 3 de Junio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;B. Se aplica a los aspirantes que acceden a un puesto de trabajo del Ayuntamiento en el cual han prestado servicios como funcionarios de cualquier categoría en comisión de servicios o con nombramiento interino, durante 9 meses como mínimo, a contar desde la entrada en vigor de la Ley 6/2005, de 3 de Junio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;C. Se aplicará al resto de aspirantes no incluidos en los apartados a) y b).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;b) Por los servicios prestados en la plaza objeto de la convocatoria. Puntuación máxima: 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Por cada mes de servicio completo, se multiplicará por 0’033.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;c) Por antigüedad, por los servicios reconocidos como funcionario de carrera o interino en cualquier categoría, por cada año de servicio completo, se multiplicará por 0’2, hasta un máximo de 5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;d) Por poseer titulaciones académicas oficiales superiores a la exigida para la categoría a la cual se accede, hasta un máximo de 4 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Diplomatura universitaria, ingeniería técnica, arquitectura técnica o equivalente: 2,5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Licenciatura, ingeniería, arquitectura o equivalente: 3,5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Doctorado, en cursos de posgrado regulados como estudios oficiales por una&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;universidad: 0’5 punto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;e) Conocimiento de lengua catalana, hasta un máximo de 2,5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se reconocerán las titulaciones expedidas por la CAIB, la Escuela Balear de Administración, la Escuela Oficial de Idiomas (EOI) o las equivalentes según la normativa reguladora de la comunidad autónoma de las Islas Baleares (Orden del Consejero de Educación, Cultura y Universidades de 21 de Febrero de 2013, BOIB nº 34, de 12 de Marzo de 2013).&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sólo se valorará la de nivel superior, excepto en el caso del nivel LA, que se podrá sumar al del nivel C1 o C2.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se considerarán únicamente los valores superiores exigidos para ocupar el puesto de trabajo objeto de la provisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Nivel C o C1: 1.50 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Sólo se valorará la de nivel superior, salvo el caso de idiomas distintos. Considerando la progresiva implantación y adaptación de estos organismos a Marco Europeo Común de Referencia, se establece el siguiente cuadro comparativo, a efectos de establecer la correspondiente puntuación para cada nivel de idiomas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;i) Otros méritos determinados por la Corporación: hasta 6 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Sólo podrán responder a la valoración de aspectos objetivos. La corporación interesada los determinará en la provisión de puestos de trabajo, una vez negociados con la representación sindical, mediante su combinación. En todo caso se respetará la puntuación aplicable a cada uno y sin exceder con la combinación propuesta de la puntuación máxima de 6 puntos. &lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;C) Acreditación de conocimientos del término municipal de Capdepera, mediante la realización de pruebas objetivas homologadas por la Escuela Balear de Administración Pública: hasta 2 puntos.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;D) Atribución de funciones relacionadas con la coordinación de los cuerpos de policía local de la comunidad autónoma de las Islas Baleares: de 0,01 hasta un punto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;E) Atribución de funciones relacionadas con la dirección, supervisión, o apoyo a Protección Civil del Ayuntamiento de Capdepera: de 0,01 hasta 1 punto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;F) Máster, posgrado, o estudios equivalentes, homologados por el EBAP, relacionados con la función policial, la seguridad y las emergencias, la gestión de calidad y la dirección y gestión local: de 0,01 hasta 2 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La puntuación global máxima que podrá otorgarse en la fase de concurso por todos los méritos alegados será de 45 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
