    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Aprobadas por la Junta de Gobierno Local en sesión ordinaria celebrada día 22 de marzo de 2013 las bases de las AYUDAS ECONÓMICAS PARA ESTUDIANTES EMPADRONADOS EN EL MUNICIPIO DE ANDRATX, ESCOLARIZADOS EN EDUCACIÓN INFANTIL, PRIMARIA, MÓDULOS VOLUNTARIOS Y SECUNDARIA OBLIGATORIA, CURSO 2012/2013, se hace público el presente acuerdo:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;“Analizado por esta Corporación Municipal el esfuerzo económico que representa para la mayoría de las familias el comienzo del curso escolar, considerando que la Educación Primaria y Secundaria es obligatoria, se ha dispuesto subvencionar los gastos de material escolar a todos los residentes empadronados en Andratx que cursen Educación Infantil, Primaria, Módulos Voluntarios y Secundaria Obligatoria, independientemente del centro en el que estudien.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Esta ayuda se tramitará a cargo de la partida presupuestaria 324-48900 y con un importe máximo de 30.000,00€.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Basándose en todo lo expuesto anteriormente, la regidora que lo subscribe eleva a la Junta de Gobierno la siguiente &lt;strong&gt;PROPUESTA&lt;/strong&gt;&lt;strong&gt;:&lt;/strong&gt; &lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;PRIMERO&lt;/strong&gt;.- Aprobar las Bases que se adjuntan para la convocatoria de ayudas para estudiantes del municipio de Andratx escolarizados en Educación Infantil, Primaria y Secundaria Obligatoria, para el curso 2012/2013.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;BASES PARA LA CONVOCATORIA DE AYUDAS ECONÓMICAS PARA ESTUDIANTES DE SEGUNDO CICLO DE EDUCACIÓN INFANTIL, PRIMARIA, MODULOS VOLUNTARIOS Y SECUNDARIA OBLIGATORIA PARA EL CURSO 2012/2013&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1.- CONVOCATORIA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Se convocan ayudas para todos los alumnos que cursen Educación Infantil, Primaria, Secundaria Obligatoria y módulos voluntarios; con independencia del centro en el que estén matriculados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2.- OBJETO.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El objeto de esta subvención es ayudar a las familias con los gastos escolares, durante el curso escolar 2012/2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3.- REQUISITOS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Los solicitantes de esta ayuda, padre, madre o tutores legales, tendrán que cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;- El alumno tiene que estar empadronado en el municipio de Andratx con una antigüedad mínima del día 15 de septiembre de 2012.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Estar al corriente de sus obligaciones fiscales con este Ayuntamiento, y no ser deudores por cualquier otro concepto no tributario. Por ello, una vez finalizado el plazo para presentar las solicitudes, el tesorero del Ayuntamiento expedirá de oficio una certificación acreditativa de que los peticionarios estén al corriente de sus obligaciones fiscales con este Ayuntamiento, y no como deudores por cualquier otro concepto no tributario. Los peticionarios que no estuvieran al corriente de sus obligaciones tributarias, tendrán 10 días hábiles para subsanar la deficiencia detectada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- El cumplimiento de estos requisitos se comprobará de oficio, excepto cuando los estudios se cursen en centros no ubicados en el municipio de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Los hijos/as, tienen que estar matriculados en un centro público, privado o concertado; en Educación Infantil, Primaria, módulos voluntarios, Secundaria Obligatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- No ser beneficiario del programa de reutilización de libros por parte de su centro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;El simple hecho de presentar la solicitud de las becas 2013, supone aceptar estas bases y en caso de falsedad u omisión total o parcial de la documentación presentada se incurrirá en responsabilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4.- DOCUMENTACIÓN.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Para solicitar esta ayuda se tendrá que presentar en lengua castellana o catalana la siguiente documentación (en el caso de tener documentación en lengua extranjera la tendrá que presentar oficialmente traducida):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Modelo de solicitud correctamente rellenado, mediante la instancia facilitada por el Ayuntamiento de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Fotocopia del DNI/NIE del padre y de la madre o tutores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;- &lt;/strong&gt;Fotocopia del libro de familia.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Si los estudios se cursan fuera de los centros del municipio de Andratx se tendrá que presentar un certificado de escolarización en el cual se indique: el nombre y los apellidos del alumno, la fecha de nacimiento, el centro educativo y el curso en el cual está matriculado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Si el solicitante de la ayuda es el tutor o la tutora del alumno, se tendrá que presentar la documentación que lo acredite.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- Documento de transferencia bancaria del Ayuntamiento de Andratx o, en el supuesto de que el Ayuntamiento ya disponga del núm. de cuenta, los dígitos de la cuenta, en todo caso, siempre a nombre del solicitante de la ayuda (Documento facilitado por el Ayuntamiento)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin: 0px"&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;- En el caso de padres separados, convenio de separación o sentencia de divorcio o documento equivalente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Todos los documentos necesarios los podrán encontrar en la página web www.andratx.cat &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5.- PLAZOS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las solicitudes tendrán que presentarse al SAC del Ayuntamiento de Andratx (Servicio de Atención a la Ciudadanía), de 8:30h a 13:30h. Así mismo también se podrán presentar en los lugares establecidos en el apartado 4, del arte. 38, de la Ley 30/1992, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, modificada por la Ley 4/1999; una vez aprobadas estas bases por la Junta de Gobierno Local y a partir del día siguiente de la publicación de estas bases en el BOIB hasta un mes después.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;6.- NATURALEZA DE LAS AYUDAS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Son de carácter voluntario y temporal; serán irrevocables cómo precedente y no se podrá exigir aumento o revisión de la cantidad asignada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;7.- AYUDAS Y CUANTÍAS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 1º de Educación Infantil: 20€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 2º de Educación Infantil: 45€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 3º de Educación Infantil: 45€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 1º de Educación Primaria: 35€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 2º de Educación Primaria: 35€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 3º de Educación Primaria: 55€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 4º de Educación Primaria: 55€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 5º de Educación Primaria: 75€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 6º de Educación Primaria: 75€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 1º de ESO: 100€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 2º de ESO: 100€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 3º de ESO: 100€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 4º de ESO: 100€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 1º de módulos voluntarios: 100€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Ayuda para matriculados en 2º de módulos voluntarios: 100€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;8.- PROCEDIMIENTO POR CONCURRENCIA COMPETITIVA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Una vez acabe el plazo para presentar las solicitudes de subvención, se comprobará si estas reúnen los requisitos exigibles; en caso contrario, se requerirá la persona interesada porque, en un plazo de 10 días hábiles, subsane la falta o acompañe los documentos preceptivos, con indicación que, si así no lo hiciera se tendrá por desistida su petición, la cual se archivará previa resolución que tendrá que ser dictada en los términos del arte. 71.1, de la Ley 30/1992, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, modificada por la Ley 4/1999, de 13 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;A continuación se estudiarán y comprobarán los requisitos generales de las solicitudes presentadas, se formulará una propuesta de concesión y se cursarán las denegaciones de ayudas. Finalmente, previa propuesta motivada del regidor delegado del área de Educación, la Junta de Gobierno Local resolverá la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las ayudas concedidas se expondrán en el tablón de anuncios de este Ayuntamiento, en los términos previstos al arte. 59, de la Ley 30/1992, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, modificada por la Ley 4/1999.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Las solicitudes resueltas favorablemente serán objeto de publicación en el tablón de anuncios del Ayuntamiento de Andratx y no serán objeto de notificación individual. Por otra parte las solicitudes resueltas negativamente si serán objeto de notificación individual.&lt;/span&gt;&lt;br /&gt; &lt;span style="color: black"&gt;Contra la resolución de estas ayudas se podrá interponer un recurso de reposición en el plazo de un mes ante el mismo organismo que lo ha resuelto, o bien directamente un recurso contencioso administrativo en el plazo de dos meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;9.- PAGO.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;La cuantía total de la partida presupuestaria prevista en los presupuestos del Ayuntamiento de Andratx para el año 2013 de la partida: 324-48900 asciende a 30.000€ para la educación obligatoria: infantil, primaria, secundaria obligatoria y módulos voluntarios, para el curso 2012/2013. En cualquier caso, de no existir crédito presupuestario suficiente se prorrateará el tanto por ciento necesario en todas las ayudas (arte. 22.1 “in fino” de la Ley 38/2003, de 17 de noviembre)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;10.- DERECHO SUPLETORIO&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Todo aquello que no se prevé en estas Bases, será de aplicación la Ordenanza Municipal reguladora de la concesión de ayudas y subvenciones; la Ley 30/1992, de 26 de diciembre, del Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, modificada por la Ley 4/1999; la Ley 38/2003, de 17 de noviembre, General de Subvenciones; y el Reglamento de los Servicios de las Corporaciones Locales, de 17 de junio de 1955.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;11.- PUBLICACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Publicar estas Bases en el BOIB, y en el tablón de anuncios y en la página web del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;.- Aprobar el gasto de 30.000,00€ a cargo de la partida presupuestaria 324-48900.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;.- Publicar estas bases en el BOIB para información pública, en el tablón de anuncios y en la página web del Ayuntamiento.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;CUARTO&lt;/strong&gt;.- Dar cuenta a la Intervención Municipal y al Departamento de Educación&lt;strong&gt;”&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &amp;nbsp;&lt;/p&gt;
