    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;Aprobadas por la Junta de Gobierno Local en sesión ordinaria celebrada día 22 de marzo de 2013 las bases de las Ayudas económicas para estudios postobligatorios, curso 2012/2013, se hace público el presente acuerdo: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;“Como en años anteriores el Ayuntamiento quiere ayudar a los estudiantes de Andratx que continúan su formación postobligatoria y que no pueden realizarla en nuestro municipio. Visto que la educación de los jóvenes de Andratx es un motivo suficientemente importante como para considerar valioso ofrecerles todos los medios posibles para tal causa, y visto que es voluntad de esta corporación destinar ayudas de carácter económico para satisfacer los gastos que tienen los estudiantes al realizar sus estudios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;Esta ayuda se tramitará a cargo de la partida presupuestaria 324-48100 y con un importe&amp;nbsp; máximo de 25.000€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;Basándose en todo lo expuesto anteriormente, la Regidora que lo subscribe propone a la Junta de Gobierno Local:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;1.-Aprobar las bases adjuntas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;BASES REGULADORAS DE LA CONVOCATORIA DE AYUDAS ECONÓMICAS PARA ESTUDIOS POSTOBLIGATORIOS CURSO 2012/2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;1.- CONVOCATORIA Y OBJETO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Se convocan becas para estudiantes empadronados en el municipio que cursan estudios postobligatorios (curso 2012/2013). El objeto de estas bases es regular las ayudas que conceda el Ayuntamiento de Andratx durante el curso 2012/2013 para estudiantes que cursan estudios postobligatoris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;2.- REQUISITOS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- El alumno tiene que estar empadronado en el municipio de Andratx con una antigüedad mínima de un año en el momento de formalizar la solicitud.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Estar matriculado en un curso postobligatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Estar al corriente de las obligaciones fiscales con este Ayuntamiento, y no ser deudores por cualquier otro concepto tributario. De no ser así, tendrán 10 días hábiles para subsanar la deficiencia detectada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- &amp;nbsp;El simple hecho de presentar la solicitud de las becas 2013, supone aceptar estas bases y en caso de falsedad u omisión total o parcial de la documentación presentada se incurrirá en responsabilidad&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;3.- DOCUMENTACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Para solicitar esta ayuda se tendrá que presentar la solicitud (que se encuentra en la página www.andratx.cat ) debidamente rellenada y la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Fotocopia del DNI del estudiante, y del padre y de la madre (o tutores) en caso de ser menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Fotocopia de la matrícula.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Documento de transferencia bancaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;4.- PLAZOS Y LUGAR DE PRESENTACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Las solicitudes se tendrán que presentar en el SAC (Servicio de Atención a la Ciudadanía) en el Ayuntamiento y en cualquier otro de los lugares admitidos por el artículo 38 de la Ley 30/1992, de 26 de noviembre de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común. Plazo 1 mes a partir del día siguiente de su publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;5.- NATURALEZA DE LAS AYUDAS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Se establece la compatibilidad con otras subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualquier Administración o ente público o privado, nacional, de la Unión Europea o de organismos internacionales.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;6.- CUANTÍA Y CRÉDITO PRESUPUESTARIO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;La dotación económica total de la convocatoria para el curso 2012/2013 es de 25.000€ a cargo de la partida presupuestaria 324.48100. No podrá gastarse más de lo presupuestado para esta subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Alumnos que estudian Bachiller 200€&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Estudiantes de Ciclos Formativos y estudios de régimen especial: 200€&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Estudiantes en la universidad (estudios de Grau, licenciaturas, diplomaturas, másters, posgrados...): 8€ por crédito hasta un máximo de 300€.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Alumnos universitarios que estudian fuera de la Comunidad de las Islas Baleares (porque los estudios no se imparten en la isla de Mallorca): 12€ por crédito hasta un máximo de 400€&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;- Los alumnos que estudian fuera de la comunidad de las Islas Baleares por decisión propia serán considerados como estudiantes de la universidad de las Islas, en cambio aquellos que no han podido entrar en la carrera escogida por carencia de plaza, si que podrán optar a la beca de estudios de fuera de la comunidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;En caso de no existir crédito presupuestario suficiente se prorrateará el tanto por ciento necesario en todas las becas (arte. 22.1 “*in fino” de la Ley 38/2003, de 17 de noviembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;7.- PROCEDIMIENTO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Una vez acabe el plazo para presentar las solicitudes de subvención, se comprobará si estas reúnen los requisitos exigibles; en caso contrario, se requerirá la persona interesada para que, en un plazo de 10 días hábiles, subsane la falta o acompañe los documentos preceptivos, con indicación que, si así no lo hiciera se tendrá por desistida su petición, la cual se archivará previa resolución que tendrá que ser dictada en los términos del arte. 71.1, de la Ley 30/1992, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, modificada por la Ley 4/1999, de 13 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;A continuación se estudiarán y comprobarán los requisitos generales de las solicitudes presentadas, el órgano instructor, el regidor delegado del área de Educación, formulará la propuesta de resolución provisional, debidamente motivada, que se tendrá que notificar a los interesados en la forma que establezca la convocatoria, y se concederá un plazo de 10 días para presentar alegaciones. Se podrá prescindir del trámite de audiencia cuando no figuren en procedimiento ni sean tenidos en cuenta otros hechos ni otras alegaciones y pruebas que las aducidas por los interesados. En este caso, la propuesta de resolución formulada tendrá el carácter de definitiva. Examinadas las alegaciones aducidas si procede por los interesados, se formulará la propuesta de resolución definitiva. La resolución del procedimiento se llevará a cabo por parte de la Junta de Gobierno Local se resolverá en el plazo máximo de 6 meses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;Transcurrido este plazo, sin que la Junta de Gobierno Local hubiera resuelto, las personas interesadas podrán entender desestimadas sus solicitudes por silencio administrativo, sin perjuicio de la resolución por parte del Ayuntamiento con posterioridad al vencimiento del plazo para resolver.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Las solicitudes resueltas favorablemente serán objeto de publicación en el tablón de anuncios del Ayuntamiento de Andratx y no serán objeto de notificación individual. Por otra parte las solicitudes resueltas negativamente si serán objeto de notificación individual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Contra la resolución de estas ayudas se podrá interponer un recurso de reposición en el plazo de un mes ante el mismo organismo que lo ha resuelto, o bien directamente un recurso contencioso administrativo en el plazo de dos meses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;strong&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;8.- DERECHO SUPLETORIO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="color: black"&gt;&lt;span style="font-family: times new roman"&gt;Con todo, lo no previsto por las bases será de aplicación la Ordenanza municipal reguladora de la concesión de ayudas y subvenciones y la Ley 30/1992, de 26 de noviembre, del Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, Ley 38/2003, de 17 de noviembre, General de Subvenciones y el Reglamento de servicios de las Corporaciones Locales del 17 de junio de 1955. Del mismo modo al RD 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, a la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares y al Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones de la CAIB&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;2.- Aprobar el gasto que supone la concesión de las ayudas económicas para estudios postobligatorios curso 2012/2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;3.- Publicar en el BOIB para información pública, en el tablón de anuncios y en la página Web del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman"&gt;4.- Dar cuenta a la Intervención Municipal.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
