&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;No habiendo sido posible la notificación personal al interesado en el domicilio indicado en el expediente y de acuerdo con lo establecido en el artículo 59.5 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y de Procedimiento Administrativo Común, se procede a la publicación del presente anuncio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;PRIMERO&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. - En fecha 24 de septiembre de 2012 los agentes de la Policía Local de Formentera n º F010005 y F010026, procedieron a la denuncia de actos de edificación sin licencia en &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
  &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. Los actos consisten en la &lt;strong&gt;&amp;quot;Instalación de una caseta de jardín sin LMO&amp;quot;&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;SEGUNDO&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. - En fecha 25 de septiembre de 2012, mediante Decreto de Presidencia se iniciaron las correspondientes acciones de restablecimiento contra el &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
  &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;, como promotor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;TERCERO&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. - En el mismo decreto, notificado al interesado el 2 de octubre de 2012, se acordó: REQUERIR al promotor para que en un plazo de dos meses solicite la correspondiente licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

 &lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;CUARTO&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. - El instructor solicitó informe, en fecha 21 de febrero de 2013 a los servicios técnicos del Departamento de Urbanismo. Dicho informe fue emitido e incorporado al expediente en fecha 6 de marzo de 2013 y se transcribe a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;/div&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;INFORME SS.TT.EXP. 35/2012 &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;RESTABLECIMIENTO LEGALIDAD URBANÍSTICA&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;De acuerdo con el oficio interno de fecha 21/02/2013, el instructor del Exp. 35/2012 de Restablecimiento de la legalidad urbanística solicita a los SS.TT. del Área de Urbanismo, la emisión de un informe referente a la instalación de una caseta prefabricada ubicada en “ &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family: times new roman"&gt;&lt;span style="font-size: 11pt"&gt; 
    &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt; de Formentera. Este deberá contener:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Descripción de las obras realizadas sin licencia y carácter legalizable de las mismas.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Valoración de las obras realizadas sin licencia.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Detalle de lo que ha de ser objeto de demolición o retirada.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Plazo previsto para llevara cabo el restablecimiento de la legalidad urbanística.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Pronunciamiento en relación a la intervención preceptiva de técnico competente.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Situación y datos catastrales de la finca:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;(Fotografía 1)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;De la consulta realizada en la web de la Oficina Virtual del Catastro se ha obtenido la siguiente documentación:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Referencia catastral &lt;/em&gt; &lt;/span&gt; 
  &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Descripción de las obras realizadas sin licencia:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;De acuerdo con el boletín de denuncia de la Policia Local de fecha 24/09/2012, el hecho denunciado es la instalación de una caseta prefabricada de unos 9 m2 (3x3m) sobre la finca.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Carácter legalizable del acto edificatorio o de uso del suelo:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Los SS.TT. informan que la colocación del elemento prefabricado denunciado, de acuerdo con la normativa de aplicación resulta prohibido (D.A.6ª &lt;/em&gt;&lt;em&gt;Ley 6/1997, de 8 de julio, del suelo rústico de las Islas Baleares y art. 62.2 Revisión NNSS Formentera 2010), &lt;/em&gt;&lt;em&gt;por tanto las obras denunciadas no serían legalizables.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Valoración de las obras denunciadas realizadas sin licencia:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Caseta prefabricada: 600 € (PEM)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Detalle de lo que tiene que ser objeto de demolición o retirada:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Se deberá proceder a la retirada del elemento prefabricado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Plazo prudencial para desinstalación y/o retirada de la obra:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Se propone un plazo para la desinstalación y/o retirada del elemento denunciado de 1 semana.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;u&gt;Intervención preceptiva o no de facultativo competente:&lt;/u&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;Debido a la escasa entidad constructiva del elemento instalado, el técnico que suscribe considera que no resulta necesaria la intervención de un técnico facultativo competente para la desinstalación y/o retirada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;El presente informe se ha redactado según mi saber y entender y sin perjuicio del mejor criterio a que se someta.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;El presente informe será adjuntado al resto de informes (técnicos y jurídicos) del expediente a fin de dar cumplimiento al articulo 7.6 de la ley 10/1990 de Disciplina Urbanística.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;em&gt;(...)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;QUINTO&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;. - Transcurrido el plazo concedido, no se ha procedido, por parte del interesado, a la solicitud de la correspondiente licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;A los hechos mencionados, son de aplicación los siguientes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;FUNDAMENTOS DE DERECHO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;I. - DE RESTABLECIMIENTO DE LA LEGALIDAD.&lt;/span&gt; - &lt;/strong&gt;Establece el art. 66 de la Ley 10/1990, que transcurrido el plazo de dos meses desde el requerimiento de legalización, &amp;quot;si el interesado no hubiera instado a la citada licencia, la instructor formulará propuesta de demolición o de reconstrucción de las obras a costa del interesado, y propondrá lo que proceda para impedir definitivamente los usos que se le habían querido dar. Se procederá de igual manera si la licencia fuese denegada por ser el otorgamiento contrario a las prescripciones de la normativa urbanística oa las ordenanzas &amp;quot;.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;II. - RESPONSABLES. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; En aplicación de lo dispuesto en el Art. 30 de la Ley 10/1990, es responsable de la infracción el &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
  &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;, en su condición de promotor y/o propietario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;Por todo lo anterior,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;SE PROPONE&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;- &lt;strong&gt;ORDENAR&lt;/strong&gt; LA DEMOLICIÓN Y/O DESINSTALACIÓN DE LOS ACTOS DE EDIFICACIÓN denunciados por la Policía Local: &lt;strong&gt;&amp;quot;Instalación de una caseta de jardín sin LMO&amp;quot;&lt;/strong&gt; a &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(42, 42, 42)"&gt; 
  &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(42, 42, 42)"&gt;- &lt;strong&gt;NOTIFICAR&lt;/strong&gt; la presente propuesta a los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Contra la propuesta de resolución, no cabe interponer recurso administrativo, dado que es un trámite que no determina la imposibilidad de continuar el procedimiento, ni produce indefensión o perjuicio irreparable a derechos o intereses legítimos.&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt; &lt;span style="font-family: times new roman, times, serif; font-size: 12px"&gt;Lo que se comunica al interesado, concediéndole un plazo de QUINCE DÍAS, para formular alegaciones y presentar los documentos e informaciones que estime oportunos ante el Instructor del procedimiento&lt;/span&gt;&lt;/p&gt;
